administration concerned; and in the case <strong>of</strong> any public works as aforesaid, in such authority as the Central<br />

Government may by general or special order direct.<br />

(3) Notwithstanding anything contained in the regulations, the stability <strong>of</strong> such railway, road, works,<br />

building or structure shall not be endangered until it has been dismantled, diverted or vacated, as the case<br />

may be.<br />

(4) Where the stability <strong>of</strong> such railway, road, works, buildings or structure has been endangered due to any<br />

mining operations, the Chief Inspector may, by an order, in writing, require the owner to construct in the<br />

mine belowground or on the surface such protective works within such time as he may specify in the order.<br />

110. Protective works before a mine is closed – [(1) The Chief Inspector may, by an order in writing,<br />

require the owner <strong>of</strong> any mine to which regulation 6 applies, to construct in the mine belowground or on<br />

the surface such protective works within such time as he may specify therein.<br />

(2) If the owner fails to construct such protective works within the time specified in the order, the Chief<br />

Inspector may get the works executed by any other agency, and the cost there<strong>of</strong>, as certified by the Chief<br />

Inspector shall be defrayed by the owner <strong>of</strong> the mine and recoverable from him as an arrear <strong>of</strong> land<br />

revenue.<br />

(3) Until the protective works have been constructed to the satisfaction <strong>of</strong> the Chief Inspector, the means <strong>of</strong><br />

entering the mine at not less than two entrances shall be kept intact and in working order.<br />

111. Working near mine boundaries – 2[(1) The owner, agent or manager <strong>of</strong> every mine shall fixed<br />

boundaries <strong>of</strong> the mine. Notwithstanding anything contained in sub-regulation (2), the shall not be changed<br />

except with the permission <strong>of</strong> the Chief Inspector in writing and subject to such conditions as he may<br />

specify therein].<br />

3[(2)] No working shall be made within a distance <strong>of</strong> 7.5 metres <strong>of</strong> the boundary <strong>of</strong> any mine and, in case<br />

<strong>of</strong> a disputed boundary, no working shall be made within a distance <strong>of</strong> 7.5 metres <strong>of</strong> the boundary claimed<br />

by the owner <strong>of</strong> an adjacent mine until such time as a binding agreement has been reached as to the correct<br />

boundary or the question has been finally determined by a court <strong>of</strong> law:<br />

1[Provided further that, where the workings <strong>of</strong> any 2[mine], for any reason, are extended or get extended<br />

within any shorter distance than what is laid down herein above, the Chief Inspector may, by an order in<br />

writing, require the owner to construct such protective works within such time as he may specify in the<br />

order].<br />

3[(3)] Notwithstanding anything contained in sub-regulation (1), the Chief Inspector may, by an order in<br />

writing and subject to such conditions as he may specify therein, permit the workings <strong>of</strong> any mine or part<br />

there<strong>of</strong> to extend within any shorter distance than 7.5 metres aforesaid, or may require that the said working<br />

shall not extend further than a specified distance, not exceeding 60 metres, <strong>of</strong> such boundary.<br />

112. Support <strong>of</strong> workings. – (1) The ro<strong>of</strong> or back, hanging wall, footwall and sides <strong>of</strong> every roadway and<br />

working place, including airways and travelling roadways to second outlets, shall be made and kept secure.<br />

(2)(a) If the Regional Inspector is <strong>of</strong> the opinion with respect to any mine or part there<strong>of</strong> that systematic<br />

support for the ro<strong>of</strong> or back hanging wall, footwall and sides, or either, or them, ought to be provided an<br />

maintained for the purpose <strong>of</strong> securing the safety <strong>of</strong> persons employed therein, he may serve upon the<br />

owner, agent or manager an order in writing specifying the mine or part, stating that he is <strong>of</strong> opinion<br />

aforesaid and requiring the provision and maintenance <strong>of</strong> support in accordance with a code <strong>of</strong> Timbering<br />

Rules which he may specify in the order.<br />

(b)The manager shall hand over copies <strong>of</strong> the code <strong>of</strong> Timbering Rules to the assistant manager, the<br />

underground manager and to all other supervising <strong>of</strong>ficials concerned, and shall also post such copies at<br />

conspicuous places in the mine.
