31. 4[Retirement age for Managers and Official etc. – (1) No person shall act as a<br />
manger or an <strong>of</strong>ficial or a blaster or a winding engine man in a mine after attaining the<br />
age <strong>of</strong> 60 years unless he has obtained, within the preceding one year, a medical<br />
certificate <strong>of</strong> fitness certifying him fit to carry out the duties prescribed for him in the Act<br />
and in the regulations and orders made thereunder :<br />
Provided that if the Chief Inspector or the Regional Inspector is <strong>of</strong> the opinion<br />
that a person as aforesaid though less than 60 years’ <strong>of</strong> age, is medically unfit to carry on<br />
the duties prescribed fo r him in the Act and in the regulations and orders made<br />
thereunder, the Chief Inspector or the Regional Inspector may, by an order in writing,<br />
exceeding three months as he may specify therein; and no such person shall continue to<br />
act in any capacity as aforesaid after the period so specified unless he has obtained a<br />
medical certificate <strong>of</strong> fitness.<br />
(2) The medical certificate <strong>of</strong> fitness as aforesaid shall be obtained from such<br />
authority and in such manner and after the payment <strong>of</strong> such fees as the Board may<br />
prescribe.<br />
1[31. A. Right <strong>of</strong> the workers’ representative to inspect the register maintained under the<br />
<strong>Mines</strong> Rules 1955 – The register maintained in Form ‘B’ under the <strong>Mines</strong> Rules, 1955<br />
shall be made available for inspection to a workers’ representative duly authorized by the<br />
persons employed in the mine on an application made by him in his behalf].<br />
CHAPTER IV – Inspection and Mine Officials<br />
32. Qualifications <strong>of</strong> Inspectors – (1) After the coming into force <strong>of</strong> these regulations, no new person shall<br />
be appointed as Chief Inspector unless he holds a degree or diploma in mining engineer <strong>of</strong> an educational<br />
institution approved by the Central Government and also a First Class Manager’s Certificate granted under<br />
these regulations.<br />
(2) After the coming into <strong>of</strong> these regulations, no person shall be appointed as in Inspector unless he holds<br />
a degree or diploma in mining engineering <strong>of</strong> an educational institution approved by the Central<br />
Government and also a First Class Manager’s Certificate granted under these regulations:<br />
Provided that –<br />
(i)<br />
(ii)<br />
(iii)<br />
in relation to electrical machinery installed in mines, a persons holding a degree or diploma in<br />
electrical engineering <strong>of</strong> an educational institution approved by the Central Government may be so<br />
appointed;<br />
in relation to other machinery or mechanical appliances installed in mines, a person holding a<br />
degree or diploma in mechanical engineering <strong>of</strong> an educational institution approved by the Central<br />
Government may be so appointed; and<br />
in relation to the provisions <strong>of</strong> the Act and <strong>of</strong> the regulations, and <strong>of</strong> orders made thereunder,<br />
which relate to matters concerning the health and welfare <strong>of</strong> persons, a person holding a degree or<br />
diploma in medicine, surgery, and/or social science or labour welfare, as the case may be, <strong>of</strong> an<br />
educational institution approved by the Central Government 2[or a person holding such other<br />
qualifications as the Central Government may approve in this behalf] may be so appointed.
