(3) Except as aforesaid examination fee paid shall not once be refundable.<br />

22. Exchange Certificates – (1) The Board may grant to any person holding a Manger’s<br />

Surveyor’s, Overman’s or Foreman’s, Sirdar’s or Mate’s or Engine-driver’s or shotfirer’s<br />

or Blaster’s Certificate granted under any Act for the regulation <strong>of</strong> mines for the time<br />

being in force in any other country, a certificate <strong>of</strong> similar class under these regulations if<br />

he 2[ possesses such practical experience and] passes such examination as the Board may<br />

stipulate :<br />

Provided that a candidate fo the grant <strong>of</strong> a Manger’s Exchange Certificate shall<br />

also satisfy the Board that he has undergone, for a period <strong>of</strong> not less than six months, a<br />

course <strong>of</strong> practical training in India in the manner and in the mines approved by the Chief<br />

Inspector for the purpose. Before the commencement <strong>of</strong> his practical training in India as<br />

aforesaid, every such candidate shall submit to the Chief Inspector an application in a<br />

form supplied for the purpose.<br />

(2) The Board may grant to any person holding a certificate referred to in sub -<br />

regulation (1) granted under the Coal <strong>Mines</strong> <strong>Regulations</strong> made under the Act a similar<br />

certificate under these relations if he 3[possesses such practical experience and] passes<br />

such examination as the Board may stipulate :<br />

4[Provided that the Board may, subject to such conditions as it may specify,<br />

exempt any person from appearing at the examination or part there<strong>of</strong>, for the grant <strong>of</strong> an<br />

Exchange Certificate].<br />

5[(2-A) An Exchange Certificate other than a Winding Engine drive’ or Blaster’s<br />

Certificate granted under sub-regulation (1) or (2) may be restricted to mines having<br />

open-cast working only, and in such a case the certificate shall contain an endorsement to<br />

that effect].<br />

(3) Every application for the grant <strong>of</strong> an Exchange Certificate under this<br />

regulation shall be accompanied by :<br />

(i)<br />

(ii)<br />

a medical certificate obtained not more than two years prior to the date <strong>of</strong><br />

his application, from a qualified medical practitioner not below the rank <strong>of</strong><br />

a Civil Assistant Surgeon or from a Certifying Surgeon, certifying the<br />

candidate to be free from deafness, defective vision or any other infirmity,<br />

mental or physical likely to interfere with the efficient discharge <strong>of</strong> his<br />

duties ; and<br />

a certificate from some person <strong>of</strong> good repute as to the general good<br />

conduct and sobriety <strong>of</strong> the candidate.<br />

(4) Fees on the scale laid down in regulation 21 shall be paid in respect <strong>of</strong> every<br />

examination under the regulation.
