than a gold mine until such date or dates as the Central Government ma y notify in that<br />
behalf in the Official Gazette :<br />
Provided that, till such date as aforesaid, if any doubt arises as to whether any<br />
person appointed as a manager, assistant manager, underground manager, surveyor, mine<br />
foreman, mining mate, winding engine man or blaster is competent to perform the duties<br />
assigned to that post, it shall be referred to the Chief Inspector for decision.<br />
187. Officials to be literate. – After coming into force <strong>of</strong> these regulations, no person<br />
shall be appointed as an <strong>of</strong>ficial <strong>of</strong> a mine unless he is literate and is conversant with the<br />
language <strong>of</strong> the district in which the mine is situated or with the language understood by a<br />
majority <strong>of</strong> the persons employed in the mine :<br />
Provided that this regulation shall not apply to any <strong>of</strong>ficial employed in any mine<br />
on the date <strong>of</strong> coming into force <strong>of</strong> these regulations :<br />
Provided further that so much <strong>of</strong> this regulation as requires a person to be<br />
conversant with the language <strong>of</strong> the district or <strong>of</strong> the majority <strong>of</strong> persons shall not apply<br />
to assistant managers, underground managers, engineers, and surveyors.<br />
188. Writing <strong>of</strong> reports. – If any person required to make any report is unable to write, he<br />
shall be present when his report is written for him, and shall have it read over to him, and<br />
shall then attach his thumb mark to it or sign it. The person writing the report shall certify<br />
that it has been read over to the person for whom it was written, and shall sign the<br />
certificate an date his signature.<br />
189. Payment <strong>of</strong> fees. – Any fees payable under these regulations shall be paid directly<br />
into the Treasury or a branch <strong>of</strong> the State Bank <strong>of</strong> India or by means <strong>of</strong> a Crossed Indian<br />
Postal Order and the receipt <strong>of</strong> the Treasury or Bank or Postal Order shall be sent to the<br />
Chief Inspector along with the application to which the fee relates.<br />
2[190. Place <strong>of</strong> accident. – (1) Whenever an accident occurs in or about a mine causing<br />
loss <strong>of</strong> life or serious bodily injury to any person, the place <strong>of</strong> accident shall not be<br />
disturbed or altered before the arrival or without the consent <strong>of</strong> the Chief Inspector or the<br />
Inspector to whom notice <strong>of</strong> the accident is required to be given under sub-section (1) <strong>of</strong><br />
section 23 <strong>of</strong> the Act unless such disturbance or alteration is necessary to prevent any<br />
further accident, to remove bodies <strong>of</strong> the deceased, or to rescue any person from danger,<br />
or unless discontinuance <strong>of</strong> work at the place <strong>of</strong> accident would seriously impede the<br />
working <strong>of</strong> the mine:<br />
Provided that the work may be resumed at the place <strong>of</strong> accident in case the chief<br />
inspector or the inspector fails to inspect the place <strong>of</strong> accident within seventy-two hours.<br />
(2) Before the place <strong>of</strong> accident involving a fatal or serious accident is disturbed<br />
or altered due to any reason whatsoever, a sketch <strong>of</strong> the site illustrating the accident and<br />
all relevant details shall be prepared (in duplicate) and such sketch shall be duly signed
