• If the trust is funded only from the proceeds <strong>of</strong> a<br />
life <strong>in</strong>surance policy, the terms <strong>of</strong> the trust have<br />
been established by an <strong>in</strong>dividual dur<strong>in</strong>g his or<br />
her lifetime and the trust is separate from that<br />
<strong>in</strong>dividual’s estate, CRA will consider that trust<br />
as a testamentary trust<br />
• The document creat<strong>in</strong>g the trust must be a<br />
“testamentary <strong>in</strong>strument” under prov<strong>in</strong>cial law<br />
• Plac<strong>in</strong>g the designation directly <strong>in</strong> the will is<br />
therefore preferable
