SUMMONS NOTIFICATION<br />

PURPOSE<br />
PROCEDURE<br />
To notify agencies or units concerned in certain summons cases.<br />
When a summons has been served for the following offenses, follow normal<br />
summons processing procedure and:<br />
DESK OFFICER 1. Make telephone notification to agency concerned as indicated below:<br />
OFFENSE<br />
a. Soliciting contributions in public (Section<br />
603-11.0, Administrative Code.)<br />
b. Traffic offense by operator of Parks<br />
Department vehicle.<br />
c. Moving traffic infraction committed by<br />
school bus operator while actually<br />
transporting children.<br />
d. Summonses issued to private carting vehicle<br />
for moving violations under the NYS Vehicle<br />
and Traffic Law and the NYC Traffic Rules;<br />
violations of the Environmental Control<br />
Board; and, violations of the NYC<br />
Department of Consumer Affairs or the NYC<br />
Department of Health.<br />

2. Forward REPORT OF VIOLATION (PD672-151) to:<br />
a. Department of Consumer Affairs when summons issued to towing<br />
car owner or driver.<br />
NOTE<br />
Tow trucks of certain organizations and tow truck operators who are employed by and<br />
are actually operating a tow truck of such organization are exempt from Department of<br />
Consumer Affairs licensing regulations. Those EXEMPT ORGANIZATIONS are:<br />
a. Governmental agencies<br />
b. Franchise public transportation companies<br />
c. Taxi companies - licensed by Taxi and Limousine Commission<br />
d. School bus companies (as defined in VTL)<br />
e. Public utility companies<br />
f. Motor vehicle rental agencies.<br />

3. Prepare report on OFFICIAL LETTERHEAD (PD158-151) and forward<br />
direct to Bureau of Enforcement, N.Y.C. Department of Air Resources, 120<br />
Wall Street, New York 10005, when a summons is served for an air<br />
pollution violation (other than a smoking vehicle). Report will include:<br />
a. Summons number<br />
b. Violation (full section number)<br />
c. Time and date<br />
d. Place of occurrence<br />
e. Details<br />
f. Defendant’s name and address<br />
g. Rank, name, shield number and command of summonsing officer.<br />
4. Forward a duplicate copy of summons served for violation of Section 11-801,<br />
Administrative Code “no commercial motor vehicle tax stamp” to the Chief<br />
of Department, Investigation and Review Section accompanied by a Typed<br />
Letterhead indicating reason summons was served.<br />
a. Investigation and Review Section will forward the duplicate<br />
summons to New York City Department of Finance.<br />
