PURPOSE<br />
DEFINITIONS<br />
To summons an unlicensed tow truck operator.<br />
For the purpose of this procedure the following definitions will be utilized:<br />
EXEMPT TOW TRUCK - A tow truck owned or operated by/for:<br />
a. A governmental agency<br />
b. A vehicle dismantler<br />
c. Franchised public transportation<br />
d. A bus company<br />
e. A utility company<br />
f. An owner of a taxi(s) or a livery vehicle which is licensed to operate by<br />
the Taxi and Limousine Commission<br />
g. A school bus company<br />
h. A vehicle rental agency.<br />
TOWING - The moving of a vehicle where a fee, charge or other consideration is<br />
directly or indirectly imposed for such moving or where the towing service is<br />
performed by a person engaged in the servicing or repairing of vehicles.<br />

NOTE<br />
When a uniformed member of the service observes an unlicensed tow truck operator:<br />
1. Issue summons, if operator is eligible, for violation of Administrative<br />
Code Section 20-496(b), returnable to Criminal Court.<br />
2. Prepare REPORT OF VIOLATION (PD672-151), and enter under “Details”:<br />
a. Violation of Unlicensed Tow Truck Operator, Administrative<br />
Code, Section 20-496(b).<br />
b. List registered owner/address from the Certificate of Registration. If<br />
Certificate of Registration is not available, issue summons and obtain<br />
FINEST printout of the identity and address of registered owner.<br />
Uniformed members of the service observing an unlicensed tow truck parked unattended<br />
will prepare a REPORT OF VIOLATION and complete as fully as possible.<br />
3. Submit REPORT OF VIOLATION with FINEST System printout of<br />
registered owner if applicable, to the desk officer.<br />
NOTE<br />
It is of extreme importance that the REPORT OF VIOLATION be properly prepared<br />
since information contained thereon forms the basis for subsequent imposition of<br />
administrative sanctions by the Department of Consumer Affairs.<br />

DESK OFFICER 4. Review the REPORT OF VIOLATION for completeness and accuracy.<br />
5. Forward the white and blue copy, with FINEST printout of registered owner<br />
attached, when applicable, to the Department of Consumer Affairs, Licensing<br />
Enforcement Section, 42 Broadway, New York, New York 10004.<br />

Each person operating a tow truck must have in their possession a Tow Truck Operator<br />
Driver’s License issued by the Department of Consumer Affairs. These licenses include<br />
the name of the driver, identification number and photo.<br />
