FINAL PROGRAMMATIC BIOLOGICAL OPINION ON U.S. NAVY ACTIVITIES IN THE HAWAII RANGE COMPLEX 2008-2013<br />

1.3.1 A Letter of Instructi<strong>on</strong>, Mitigati<strong>on</strong> Measures Message or Envir<strong>on</strong>mental Annex to the<br />

Operati<strong>on</strong>al Order will be issued prior to the exercise to further disseminate the pers<strong>on</strong>nel<br />

<strong>training</strong> requirement and general marine mammal protective measures.<br />

1.3.2 Commanding Officers will make <strong>us</strong>e of marine species detecti<strong>on</strong> cues and informati<strong>on</strong> to<br />

limit interacti<strong>on</strong> with marine species to the maximum extent possible c<strong>on</strong>sistent with<br />

safety of the ship.<br />

1.3.3 All pers<strong>on</strong>nel engaged in passive aco<strong>us</strong>tic s<strong>on</strong>ar operati<strong>on</strong> (including aircraft, surface<br />

ships, or submarines) will m<strong>on</strong>itor for marine mammal vocalizati<strong>on</strong>s and report the<br />

detecti<strong>on</strong> of any marine mammal to the appropriate watch stati<strong>on</strong> for disseminati<strong>on</strong> and<br />

appropriate acti<strong>on</strong>.<br />

1.3.4 During MFAS operati<strong>on</strong>s, pers<strong>on</strong>nel will utilize all available sensor and optical systems<br />

(such as night visi<strong>on</strong> goggles) to aid in the detecti<strong>on</strong> of marine mammals.<br />

1.3.4 <strong>Navy</strong> aircraft participating in exercises at sea will c<strong>on</strong>duct and maintain, when<br />

operati<strong>on</strong>ally feasible and safe, surveillance for marine species of c<strong>on</strong>cern as l<strong>on</strong>g as it<br />

does not violate safety c<strong>on</strong>straints or interfere with the accomplishment of primary<br />

operati<strong>on</strong>al duties.<br />

1.3.5 Aircraft with deployed s<strong>on</strong>obuoys will <strong>us</strong>e <strong>on</strong>ly the passive capability of s<strong>on</strong>obuoys when<br />

marine mammals are detected within 200 yards of the s<strong>on</strong>obuoy.<br />

1.3.6 Marine mammal detecti<strong>on</strong>s will be immediately reported to assigned Aircraft C<strong>on</strong>trol<br />

Unit for further disseminati<strong>on</strong> to ships in the vicinity of the marine species as appropriate<br />

where it is reas<strong>on</strong>able to c<strong>on</strong>clude that the course of the ship will likely result in a closing<br />

of the distance to the detected marine mammal.<br />

1.3.7 Safety Z<strong>on</strong>es—When marine mammals are detected by any means (aircraft, shipboard<br />

lookout, or aco<strong>us</strong>tically), the <strong>Navy</strong> will ensure that MFA transmissi<strong>on</strong> levels are limited to<br />

at least 6 decibels (dB) below normal operating levels if any detected animals are within<br />

1,000 yards of the s<strong>on</strong>ar dome (the bow)<br />

(i)<br />

Ships and submarines will c<strong>on</strong>tinue to limit maximum MFA transmissi<strong>on</strong> levels<br />

by this 6-dB factor until the marine mammal has been seen to leave the area, has<br />

not been detected for 30 minutes, or the vessel has transited more than 2,000<br />

yards bey<strong>on</strong>d the locati<strong>on</strong> of the last detecti<strong>on</strong>.<br />

(ii) The <strong>Navy</strong> will ensure that MFA s<strong>on</strong>ar transmissi<strong>on</strong>s will be limited to at least 10<br />

dB below the equipment's normal operating level if any detected animals are<br />

within 500 yards of the s<strong>on</strong>ar dome. Ships and submarines will c<strong>on</strong>tinue to limit<br />

maximum ping levels by this 10-dB factor until the marine mammal has been<br />

seen to leave the area, has not been detected for 30 minutes, or the vessel has<br />

transited more than 2,000 yards bey<strong>on</strong>d the locati<strong>on</strong> of the last detecti<strong>on</strong>.<br />
