FINAL PROGRAMMATIC BIOLOGICAL OPINION ON U.S. NAVY ACTIVITIES IN THE HAWAII RANGE COMPLEX 2008-2013<br />

anthropogenic noise <strong>on</strong> cetaceans, pinnipeds, sea turtles, and other marine animals. This includes the<br />

cumulative impacts <strong>on</strong> the distributi<strong>on</strong>, abundance, and the physiological, behavioral and social ecology of<br />

these species.<br />

In order to keep <str<strong>on</strong>g>NMFS</str<strong>on</strong>g> Endangered Species Divisi<strong>on</strong> informed of acti<strong>on</strong>s minimizing or avoiding adverse effects or<br />

benefitting listed species or their habitats, the Permits, C<strong>on</strong>servati<strong>on</strong> and Educati<strong>on</strong> Divisi<strong>on</strong> of the Office of<br />

Protected Resources should notify the Endangered Species Divisi<strong>on</strong> of any c<strong>on</strong>servati<strong>on</strong> recommendati<strong>on</strong>s they<br />

implement in their final acti<strong>on</strong>.<br />

REINITIATION NOTICE<br />

This c<strong>on</strong>cludes formal c<strong>on</strong>sultati<strong>on</strong> <strong>on</strong> the U.S. <strong>Navy</strong>’s proposal to undertake <strong>training</strong> activities in the Hawai'i Range<br />

Complex from December 2008 through December 2013 and Nati<strong>on</strong>al Marine Fisheries Service’s Permits, Educati<strong>on</strong>,<br />

and C<strong>on</strong>servati<strong>on</strong> Divisi<strong>on</strong>’s proposal to promulgate regulati<strong>on</strong>s that would authorize the “take” of marine mammals<br />

in associati<strong>on</strong> with those activities. As provided in 50 CFR 402.16, reinitiati<strong>on</strong> of formal c<strong>on</strong>sultati<strong>on</strong> is required<br />

where discreti<strong>on</strong>ary Federal agency involvement or c<strong>on</strong>trol over the acti<strong>on</strong> has been retained (or is authorized by<br />

law) and if: (1) the amount or extent of incidental take is exceeded; (2) new informati<strong>on</strong> reveals effects of the agency<br />

acti<strong>on</strong> that may affect listed species or critical habitat in a manner or to an extent not c<strong>on</strong>sidered in this opini<strong>on</strong>; (3)<br />

the agency acti<strong>on</strong> is subsequently modified in a manner that ca<strong>us</strong>es an effect to the listed species or critical habitat<br />

not c<strong>on</strong>sidered in this opini<strong>on</strong>; or (4) a new species is listed or critical habitat designated that may be affected by the<br />

acti<strong>on</strong>. In instances where the amount or extent of incidental take is exceeded, secti<strong>on</strong> 7 c<strong>on</strong>sultati<strong>on</strong> m<strong>us</strong>t be<br />

reinitiated immediately.<br />
