FINAL PROGRAMMATIC BIOLOGICAL OPINION ON U.S. NAVY ACTIVITIES IN THE HAWAII RANGE COMPLEX 2008-2013<br />
INCIDENTAL TAKE STATEMENT<br />
Secti<strong>on</strong> 9 of the ESA and Federal regulati<strong>on</strong> pursuant to secti<strong>on</strong> 4(d) of the ESA prohibits the take of endangered and<br />
threatened species, respectively, without special exempti<strong>on</strong>. Take is defined as to harass, harm, pursue, hunt, shoot,<br />
wound, kill, trap, capture or collect, or to attempt to engage in any such c<strong>on</strong>duct. Harm is further defined by <str<strong>on</strong>g>NMFS</str<strong>on</strong>g> to<br />
include significant habitat modificati<strong>on</strong> or degradati<strong>on</strong> that results in death or injury to listed species by significantly<br />
impairing essential behavioral patterns, including breeding, feeding, or sheltering. Incidental take is defined as take<br />
that is incidental to, and not the purpose of, the carrying out of an otherwise lawful activity. Under the terms of<br />
secti<strong>on</strong> 7(b)(4) and secti<strong>on</strong> 7(o)(2) of the ESA, taking that is incidental to and not intended as part of the agency<br />
acti<strong>on</strong> is not c<strong>on</strong>sidered to be prohibited taking under the Act provided that such taking is in compliance with the<br />
terms and c<strong>on</strong>diti<strong>on</strong>s of this Incidental Take Statement.<br />
The Nati<strong>on</strong>al Marine Fisheries Service is not including an incidental take authorizati<strong>on</strong> for marine mammals at this<br />
time beca<strong>us</strong>e the incidental take of marine mammals has not been authorized under secti<strong>on</strong> 101(a)(5) of the Marine<br />
Mammal Protecti<strong>on</strong> Act of 1972, as amended. If and when such regulati<strong>on</strong>s or authorizati<strong>on</strong>s are issued, the Nati<strong>on</strong>al<br />
Marine Fisheries Service may amend this biological opini<strong>on</strong> to include an incidental take statement for the<br />
endangered and threatened species that have been c<strong>on</strong>sidered in this <str<strong>on</strong>g>Opini<strong>on</strong></str<strong>on</strong>g>, as appropriate. C<strong>on</strong>sequently, <str<strong>on</strong>g>NMFS</str<strong>on</strong>g><br />
will identify the amount or extent of take that would be associated with the <strong>training</strong> and other activities the U.S.<br />
<strong>Navy</strong> proposes to c<strong>on</strong>duct in the Hawai'i Range Complex when we review any annual letters of authorizati<strong>on</strong> the<br />
Permits Divisi<strong>on</strong> issues for the activities c<strong>on</strong>sidered in this <str<strong>on</strong>g>Opini<strong>on</strong></str<strong>on</strong>g>.<br />
CONSERVATION RECOMMENDATIONS<br />
Secti<strong>on</strong> 7(a)(1) of the Act directs Federal agencies to utilize their authorities to further the purposes of the Act by<br />
carrying out c<strong>on</strong>servati<strong>on</strong> programs for the benefit of endangered and threatened species. C<strong>on</strong>servati<strong>on</strong><br />
recommendati<strong>on</strong>s are discreti<strong>on</strong>ary agency activities to minimize or avoid adverse effects of a proposed acti<strong>on</strong> <strong>on</strong><br />
listed species or critical habitat, to help implement recovery plans, or to develop informati<strong>on</strong>.<br />
The following c<strong>on</strong>servati<strong>on</strong> recommendati<strong>on</strong>s would provide informati<strong>on</strong> for future c<strong>on</strong>sultati<strong>on</strong>s involving the<br />
issuance of marine mammal permits that may affect endangered whales as well as reduce harassment related to<br />
research activities:<br />
1. Cumulative Impact Analysis. The U.S. <strong>Navy</strong> should work with <str<strong>on</strong>g>NMFS</str<strong>on</strong>g> Endangered Species Divisi<strong>on</strong> and<br />
other relevant stakeholders (the Marine Mammal Commissi<strong>on</strong>, Internati<strong>on</strong>al Whaling Commissi<strong>on</strong>, and the<br />
marine mammal research community) to develop a method for assessing the cumulative impacts of<br />
