8.6.3 RESPONSIBILITIES<br />

The responsibilities of the Sponsors <strong>and</strong> the NRCS, set forth in the original work plan, will<br />

continue in accordance with this Supplemental Watershed <strong>Plan</strong>-EA <strong>and</strong> with the Supplemental<br />

Watershed Agreement.<br />

The NRCS will provide technical assistance to the Sponsors with the design <strong>and</strong> construction of the<br />

decommissioning project. NRCS will:<br />

• Provide contract administration technical assistance<br />

• Provide construction management technical assistance<br />

• Provide financial assistance equal to 65% of project costs, not to exceed 100% of actual<br />

construction costs<br />

• Execute a cooperative agreement with the Sponsors before either party initiates work<br />

involving funds of the other party. Such agreements will set forth in detail the financial <strong>and</strong><br />

working arrangements <strong>and</strong> other conditions that are applicable to the specific works of<br />

improvement.<br />

The Sponsors will:<br />

• Secure all needed permits, easements (if required), <strong>and</strong> rights for installation, operation, <strong>and</strong><br />

maintenance of the new channels.<br />

• It is anticipated that some utilities will require relocation <strong>and</strong>/or protection (including a<br />

waterline located along the existing <strong>Powerline</strong> FRS auxiliary spillway which is owned by<br />

others). Utilities need to be researched as part of the design phase of the project. Utility<br />

relocations are the responsibility of the utility owner.<br />

• The Sponsors will provide leadership in updating their existing Emergency Action <strong>Plan</strong><br />

(EAP) prior to construction <strong>and</strong> will update the EAP annually with local emergency<br />

response officials. The purpose of the EAP is to outline appropriate actions <strong>and</strong> to designate<br />

parties responsible for those actions in the event of a potential failure of the channels.<br />

• Execute an updated Operation <strong>and</strong> Maintenance agreement with NRCS for the <strong>Powerline</strong><br />

Channel <strong>and</strong> North Diversion Channel.<br />

• Execute a cooperative agreement with NRCS before either party initiates work involving<br />

funds of the other party. Such agreements will set forth in detail the financial <strong>and</strong> working<br />

arrangements <strong>and</strong> other conditions that are applicable to the specific works of improvement.<br />

• Provide nonfederal funds for cost-sharing of the project at a rate equal to, or greater than,<br />

35% of project costs.<br />

• Provide local administrative <strong>and</strong> construction management services necessary for<br />

installation of the project.<br />

• Comply with all applicable Federal, State, <strong>and</strong> local floodplain management laws,<br />

ordinances <strong>and</strong> regulations.<br />

• Be responsible for enforcing all associated project easements <strong>and</strong> rights-of-way.<br />
