F-173 Ombudsman Access to Records. The facility must<br />

allow representatives of the State Ombudsman to<br />

examine a resident’s clinical records with the<br />

permission of the resident or the resident’s legal<br />

representative, and consistent with State law.<br />

F-174 Telephone. The resident has the right to have<br />

reasonable access to the use of a telephone where calls<br />

can be made without being overheard.<br />

F-175 Married Couples. The resident has the right to share a<br />

room with his or her spouse when married residents<br />

live in the same facility and both spouses consent to the<br />

arrangement.<br />

F-176 <strong>Self</strong> Administration of Drugs. The resident has the<br />

right to self-administer drugs if the interdisciplinary<br />

team has determined that this practice is safe.<br />

F-177 Refused of Certain Transfers. The resident has the<br />

right to refuse a transfer to another room within the<br />

facility if it does not affect the resident’s eligibility or<br />

entitlement to Medicare or Medicaid benefits.<br />

F-201 Transfer & Discharge Requirements. The facility must<br />

permit each resident to remain in the facility and not<br />

transfer or discharge the resident from the facility<br />

unless:<br />

1. The transfer or discharge is necessary for the<br />

resident’s welfare;<br />

2. The transfer or discharge is appropriate because the<br />

resident’s health has improved;<br />

3. The safety of individuals in the facility is<br />

endangered;<br />

4. The resident (or Medicare or Medicaid) has failed to<br />

pay for a stay at the facility.<br />

5. The facility ceases to operate.<br />

F-202 Documentation of Transfer & Discharge. The<br />

resident’s clinical record must be documented when the<br />

facility transfers or discharges a resident<br />
