7.3.6 <strong>Dealer</strong> Responsibility for Uninsured <strong>Motor</strong> Vehicle Fee<br />

If you issue a temporary registration receipt for an uninsured vehicle and are required to<br />

collect a UMV fee, you are held responsible to DMV for the amount <strong>of</strong> the uninsured<br />

motor vehicle fee. If you do not collect the fee on the day the temporary registration<br />

receipt is issued, or if you collect the fee, but later lose or misplace it, you will be<br />

required to pay the applicable fee to DMV before DMV will process the title and license<br />

transactions for your customer.<br />

7.4 DLR 715-WHAT TO DO IF A SALES CONTRACT IS CANCELLED<br />

7.4.1 Cancellation After Customer Takes Possession <strong>of</strong> Vehicle<br />

7.4.1.1 Requirements Concerning DMV Fees & Forms For DMV Licensed <strong>Dealer</strong>s<br />

If a sales contract between you and your customer is canceled and your customer actually<br />

took possession <strong>of</strong> the vehicle before cancellation <strong>of</strong> the contract, you cannot refund any<br />

<strong>of</strong> the following fees:<br />

a. Title Fee<br />

b. License Fee (either transfer or original purchase)<br />

c. SUT<br />

d. UMV Fee<br />

Even if funds are still being held at your dealership, they are legally due DMV and you<br />

must submit them. You should:<br />

e. Complete all DMV required forms relating to the sale including title application<br />

and license application.<br />

f. Submit to DMV all completed forms, title fee, license fee, sales and use tax, and<br />

the uninsured motor vehicle fee. (if any).<br />

If you issued temporary plates to the customer you must:<br />

g. Void all copies <strong>of</strong> the VSA-01, “Temporary Certificate <strong>of</strong> Registration.<br />

h. Void the customer’s temporary plates (whether issued by PoD or not).<br />

i. Retain the dealer’s copy <strong>of</strong> the VSA-01, on file at your dealership.<br />

7.4.1.2 How Your Customer May Get a Refund <strong>of</strong> DMV Fees<br />

In order for your customer to get a refund on registration DMV fees because <strong>of</strong> the<br />

cancellation (or rescission) <strong>of</strong> the sales contract, the following steps should be taken:<br />

- 80 - <strong>Virginia</strong> <strong>Department</strong> <strong>of</strong> <strong>Motor</strong> <strong>Vehicles</strong>
