<strong>Virginia</strong> <strong>Dealer</strong>’s <strong>Manual</strong><br />

1.2.9 Inspection by DMV Investigator/MVDB Field Representative<br />

After you have applied for a dealer license certificate, a DMV/MVDB representative will come to<br />

your proposed business site and conduct an opening inspection. The investigator/representative will<br />

notify you ahead <strong>of</strong> time by phone <strong>of</strong> the date and time the inspection will take place.<br />

In general, the following will be confirmed regarding your place <strong>of</strong> business during the inspection:<br />

a. a permanent building (cannot be a residence)<br />

b. at least 250 square feet <strong>of</strong> sales and service <strong>of</strong>fice space and additional space to display at least 10<br />

vehicles<br />

c. a properly executed lease or document <strong>of</strong> ownership for your property<br />

d. all local zoning requirements have been met<br />

e. desks, chairs, file cabinets(s) working telephone, working utilities, including electricity and heat<br />

and other facilities adequate to maintain the records required by DMV/MVDB<br />

f. business hours posted at the front entrance for a minimum <strong>of</strong> twenty hours per week, ten <strong>of</strong> which<br />

must be between the hours <strong>of</strong> 9:00 a.m. and 5:00 p.m. Monday through Friday, except for used<br />

Manufactured Home <strong>Dealer</strong>s only, without inventory; a minimum <strong>of</strong> two consecutive hours per<br />

week between 9:00am and 5:00 pm.<br />

g. a sign showing the “trading as” name with letters six inches in height<br />

h. a sign, displayed in the public sales area showing the dealer processing fee (if any) (The sign must<br />

be 8 ½ inches by 11 inches lettering no smaller than one-half inch to be approved by the<br />

Commissioner)<br />

i. When inspection is complete, either the DMV investigator completes and files with DMV, Form<br />

DSD-38, <strong>Department</strong> <strong>of</strong> <strong>Motor</strong> <strong>Vehicles</strong>’ “<strong>Dealer</strong> Record <strong>of</strong> Inspection” or the MVDB field<br />

investigator completes and files with the MVDB, Form MVDB-38, indicating if your location has<br />

passed inspection.<br />

1.2.10 Issuance <strong>of</strong> Your <strong>Dealer</strong> License Certificate<br />

If all aspects <strong>of</strong> your application and inspection meet DMV’s/MVDB’s requirements, DMV/MVDB will<br />

issue you a <strong>Dealer</strong> License Certificate, and any supplemental licenses and certificates and salespersons<br />

licenses you have requested. The requested items will be delivered to you at the time <strong>of</strong> your opening<br />

inspection.<br />

1.2.11 Denial or Revocation <strong>of</strong> License Certificate<br />

• Code <strong>of</strong> <strong>Virginia</strong>: § 46.2-1575.<br />

Your <strong>Dealer</strong> License Certificate may be denied if your proposed business site fails DMV’s/MVDB’s<br />

Inspection.<br />

In addition, a dealer’s application may be denied or a <strong>Dealer</strong>’s License Certificate may be revoked at any<br />

time after it is issued if the dealer commits any <strong>of</strong> the following:<br />

a. makes a material misstatement or omission in application for License, Certificate <strong>of</strong> Registration<br />

or Certificate <strong>of</strong> Title<br />

b. fails to comply subsequent to receipt <strong>of</strong> written warning from the <strong>Virginia</strong> DMV or the MVBD<br />

c. fails to have an established place <strong>of</strong> business as required, with minimum space <strong>of</strong> 250 square feet<br />

d. fails to have as the dealer-operator an individual who holds a valid certificate <strong>of</strong> qualification<br />
