<strong>Virginia</strong> <strong>Dealer</strong>’s <strong>Manual</strong><br />

No salesperson shall be employed by more than one dealer, unless the dealerships are owned by the same<br />
person, (firm, partnership or corporation).<br />
If you wish to operate either a Permanent supplemental location or a Temporary supplemental location,<br />
T&M, trailer and motorcycle dealers must obtain a supplemental dealer license certificate from DMV.<br />
<strong>Dealer</strong>s, submit form DSD-13, “Application for Permanent/Temporary or Supplemental <strong>Motor</strong> <strong>Dealer</strong><br />
License” and the $20.00 fee. <strong>Motor</strong> vehicle dealers must obtain a supplemental dealer license certificate<br />
from the MVDB, submit form MVDB-22, “Application for Permanent/Temporary or Supplemental <strong>Motor</strong><br />
<strong>Dealer</strong> License” and the $40.00 fee.<br />
1.1.7 <strong>Dealer</strong>’s License<br />
The <strong>Dealer</strong>’s License issued by DMV/MVDB must be displayed in the place <strong>of</strong> business <strong>of</strong> a<br />
a. <strong>Motor</strong> Vehicle <strong>Dealer</strong> (Franchised, Independent, T&M, Trailer or <strong>Motor</strong>cycle)<br />
b. Distributor or Distributor Branch<br />
c. Manufacturer or Factory Branch<br />
Each dealer, manufacturer, and distributor must notify the DMV/MVDB in writing no later than the tenth<br />
day <strong>of</strong> each month, following the month <strong>of</strong> termination <strong>of</strong> employment <strong>of</strong> the licensed salesperson or<br />
representative. In lieu <strong>of</strong> written notification the salesperson or representative license may be returned to<br />
DMV/MVDB annotated “terminated” on the face <strong>of</strong> the license and signed by the dealer-operator, owner<br />
or <strong>of</strong>ficer.<br />
1.1.8 List <strong>of</strong> Salespersons<br />
Every dealer must post and maintain in a place conspicuous to the public a list <strong>of</strong> all licensed salespersons<br />
currently employed.<br />
1.1.9 Carrying Salesperson License<br />
Salespersons, distributor representatives and factory representatives must carry their licenses when<br />
conducting business.<br />
1.1.10 Advertising<br />
All advertisements in newspapers or other publications issued for the public must be clearly identified by<br />
the dealership name or the abbreviation, “VA DLR” in the advertisement.<br />
1.1.11 Regulated <strong>Dealer</strong> Advertising Practices<br />
Code <strong>of</strong> <strong>Virginia</strong>: §§ 46.2-1581 thru 46.2-1582 regulate dealer advertising practices and permit the <strong>Motor</strong><br />
Vehicle <strong>Dealer</strong> Board to assess a civil penalty up to $1,000 per day for each violation <strong>of</strong> these advertising<br />
statutes. Code <strong>of</strong> <strong>Virginia</strong>: §§ 46.2-1990, 46.2-1991, 46.2-1992.84, 46.2-1992.85, 46.2-1993.81 and 46.2-<br />
1993.82 also regulate dealer advertising practices by DMV licensed dealers and permit the Commissioner<br />
to assess a civil penalty up to $1,000 per day for each violation <strong>of</strong> these advertising statutes.<br />
