Sett<strong>in</strong>g a precedent The treaty is a milest<strong>one</strong> <strong>in</strong> the history of public health<br />

and corporate accountability. Its implementation will be a dramatic change<br />

from the voluntary standards or codes <strong>in</strong>dustry proposes, which are non-b<strong>in</strong>d<strong>in</strong>g,<br />

lack <strong>in</strong>dependent oversight and are often <strong>in</strong>effective. Here are some of the<br />

ways it breaks new ground:<br />

ban on advertis<strong>in</strong>g, promotion and sponsorship [Article 13] The<br />

treaty requires parties to implement a comprehensive ban or restrictions on<br />

tobacco advertis<strong>in</strong>g, promotion and sponsorship – the first time a treaty calls<br />

for such a ban on an otherwise legal product.<br />

exclusion of the tobacco <strong>in</strong>dustry [Articles 5.3, 12(e)] The treaty <strong>in</strong>cludes<br />

strong, b<strong>in</strong>d<strong>in</strong>g language which bars the tobacco <strong>in</strong>dustry from <strong>in</strong>volvement<br />

<strong>in</strong> public health policy-mak<strong>in</strong>g and calls on governments to be alert to<br />

attempts to underm<strong>in</strong>e such policies. These provisions represent an important<br />

evolution <strong>in</strong> the global community’s response to corporate <strong>in</strong>fluence on public<br />

policy-mak<strong>in</strong>g.<br />

public disclosure of <strong>in</strong>formation [Articles 4.1, 10, 20] The treaty establishes<br />

the pr<strong>in</strong>ciple that every person should be <strong>in</strong>formed about the dangers<br />

of tobacco. Earlier agreements required the disclosure of <strong>in</strong>formation but did<br />

not call for it to be shared with the public. This provision represents an excit<strong>in</strong>g<br />

expansion of <strong>in</strong>ternational right-to-know law. It establishes a precedent for<br />

other <strong>in</strong>dustries to make available relevant <strong>in</strong>formation such as <strong>in</strong>gredients<br />

and nutritional value of food products, dangers of oil development and extraction,<br />

and health effects of pharmaceutical products.<br />

participation of civil society [Preamble, Articles 4.7, 12(e)] The treaty<br />

strongly establishes the pr<strong>in</strong>ciple that civil society participation is essential <strong>in</strong><br />

achiev<strong>in</strong>g the objectives of the treaty and its protocols, while explicitly exclud<strong>in</strong>g<br />

NGOs affiliated with the tobacco <strong>in</strong>dustry from <strong>in</strong>volvement <strong>in</strong> tobacco<br />

control strategies. This is the first time the operative text of an <strong>in</strong>ternational<br />

agreement has affirmed the vital role of civil society.<br />

A story of hope The story of the treaty <strong>in</strong>spires hope: the develop<strong>in</strong>g world,<br />

led by a block of all 46 African nations and supported by dozens of civil<br />

society organizations, united to prevent the spread of tobacco addiction,<br />

disease and death. One key element is the <strong>in</strong>volvement of people at the<br />
