noted that Milošević was also in direct contact with both Martić and Babić. 5067 I note,<br />

however, the testimony of Witness JF-039 based on his direct observation of Martić’s<br />

activities, that “it was becoming clear” that all contacts from the Krajina to Belgrade had to<br />

go through Stanišić. 5068 The witness testified that on at least two or three occasions Martić<br />

was brought to Stanišić’s office and was picked up later from Milošević’s office at the<br />

Presidency. 5069 In my view, it was only when Martić became the head of the RSK, that these<br />

instances of direct contact between him and Milošević could be observed. In any event, I<br />

believe that the instances of direct contact between Milošević, on the one hand, and Martić<br />

and Babić, on the other, do not detract from my conclusion that Stanišić provided channels of<br />

communication between these individuals and that he enabled or facilitated such contacts.<br />

Such a role does not require that Stanišić served as the exclusive avenue for such<br />

communications.<br />

2380. Both Accused were present in the area of Knin on several occasions between late 1990<br />

and early 1991, and, as Milan Babić stated, following Slobodan Milošević’s intervention,<br />

Simatović returned to the area in the fall of 1991 and remained present until the end of<br />

1991. 5070<br />

2381. I recall the Trial Chamber’s finding that “[g]iven the scale of the deportation<br />

committed by the SAO Krajina Police in 1991, it is satisfied that the Accused must have<br />

known about the crimes committed by the SAO Krajina Police between April 1991 and April<br />

1992”. 5071 Yet the Accused continued to support Martić and the SAO Krajina Police in their<br />

criminal efforts. In view of the close cooperation between both Accused and Milan Martić,<br />

which started as early as August 1990, (Martic at one point even considered Stanišić as his<br />

“brother” and trusted him “100 per cent”. 5072 ) I consider it clear that both Accused were not<br />

only fully aware of Martić’s actions and his intentions with regard to the SAO Krajina, (DB<br />

agent Orlović, head of the SAO Krajina DB reported to the Serbian DB), but also that each of<br />

them could not but share his intent to forcibly and permanently remove the non-Serb<br />

population from the SAO Krajina through the commission of crimes.<br />
