Based on the foregoing, the Trial Chamber finds that during the Indictment period Franko Simatović was employed in the Second Administration of the Serbian DB and from 1 May 1992 he was its Deputy Chief. On 1 May 1993, Simatović was appointed Special Adviser in the DB. Considering these findings, the Trial Chamber is unable to infer from Simatovic's positions alone that he was responsible for certain acts attributed generally to the Serbian DB.
