Bosnia-Herzegovina 1992 (Bijeljina and Zvornik)<br />

1841. With regard to the Prosecution’s allegation that the Accused organized, supplied,<br />

financed, and supported the involvement of the SDG in Bosnia- Herzegovina in 1992, the<br />

Trial Chamber has taken judicial notice of Adjudicated Facts and received evidence from<br />

Witness JF-057, Jovan Dimitrijević, Borislav Pelević, and Witness JF-026, as well as through<br />

documentary matierials. In its Final Trial Brief, the Prosecution argues that a relationship<br />

existed between the Accused and Kostić and Radmilo Bogdanović, through whom the<br />

Accused sent the SDG to Zvornik after the take-over of Bijeljina. 3683 The Stanišić Defence, in<br />

its Final Trial Brief, submits that the Prosecution has not shown that Stanišić provided<br />

instructions or orders to Kostić, or that Kostić’s actions were in furtherance of any Serbian<br />

DB policy. 3684 In this respect the Stanišić Defence contests the evidence of Witness JF-026,<br />

that Kostić played a role in sending the SDG to Zvornik, and with regard to his testimony that<br />

Bogdanović sent the witness to see Kostić about weapons. 3685 In its Final Trial Brief, the<br />

Simatović Defence submits that Biljana Plavšić requested that Arkan go to Bijeljina and that<br />

she then insisted that he go on to Zvornik and that Simatović was not involved with Arkan’s<br />

arrival or activities in the territory. 3686<br />

1842. According to the Adjudicated Facts, paramilitary forces operated in conjunction with<br />

the JNA and were used as infantry shock troops to make up for declining numbers in the<br />

regular army. They included Željko Ražnjatović’s Serbian Volunteer Guard (later known as<br />

“Arkan’s Tigers”) and Vojislav Šešelj’s Četniks, both of which came to be particularly feared<br />

by the Muslim population for their brutality and indiscipline. 3687 The Trial Chamber also<br />

recalls the Adjudicated Facts about the JNA arming paramilitaries in 1991 and 1992, as set<br />

out above in the SAO SBWS sub-chapter.<br />

1843. With regard to the involvement of the SDG in Bijeljina and Zvornik in 1992, according<br />

to the Adjudicated Facts, local SDS boards, crisis staffs, and regional (SAO) governments<br />

often invited and assisted paramilitary groups. 3688 This occurred, for example, with the<br />
