1813. Based on the foregoing, the Trial Chamber considers that it has received insufficient<br />

evidence to show that the Accused directed the SDG in the Banja Luka operations in 1995.<br />

The Trial Chamber finds that without further evidence, the mere fact that the Accused were<br />

involved with the SDG in other ways does not affect this finding.<br />

6.4.4 The Accused organized, supplied, financed, and supported the involvement of the<br />

Serbian Volunteer Guard in particular operations in Croatia and Bosnia-Herzegovina<br />

1814. According to the Indictment, the Accused organized, supplied, financed, and supported<br />

the SDG’s involvement in particular operations in Croatia and Bosnia-Herzegovina. 3636 The<br />

Trial Chamber has received evidence about the alleged involvement of the SDG in six<br />

operations: the SAO SBWS operation in 1991, the operations in Bosnia-Herzegovina in 1992<br />

(Bijeljina and Zvornik), Operation Pauk, operations in Treskavica/Trnovo in June-July 1995,<br />

the Banja Luka operations in 1995, and operations in the SAO SBWS in 1995. In this subchapter,<br />

the Trial Chamber will address the Prosecution’s allegations in relation to (a) the<br />

SAO SBWS operation in 1991, (b) operations in Bosnia-Herzegovina in April 1992, and (c)<br />

operations in Banja Luka in 1995. The Trial Chamber will address the role of the Accused in<br />

organizing the involvement of, and financing, supporting and supplying the SDG in Operation<br />

Pauk, and the 1995 operations in Trnovo/Treskavica and the SBWS in chapters 6.5.3 and<br />

6.5.4.<br />

SAO SBWS 1991<br />

1815. The Trial Chamber has received evidence with regard to the Prosecution’s allegation<br />

that the Accused organized, supplied, financed, and supported the involvement of the SDG in<br />

the SAO SBWS in 1991, through documentary evidence and through the testimony of<br />

Nebojša Bogunović, Witness DST-035, Witness JF-0<strong>30</strong>, Witness JF-015, Borislav Pelević,<br />

Reynaud Theunens, and Jovan Dimitrijević. It has also taken judicial notice of Adjudicated<br />

Facts.<br />

1816. According to the Adjudicated Facts, the JNA and in particular its Air Force arm<br />

actively cooperated with and assisted paramilitary units during 1991 and 1992 in operations in<br />

Croatia and Bosnia-Herzegovina and liberally supplied them with arms and equipment. 3637<br />
