3. Pay Period. The payroll period shall consist of fourteen- (14) day period beginning at 12:01 AM Sunday. B. Schedules 1. Employer will post a four (4) week or longer work schedule which shall include shifts of work, holidays and scheduled days off, and such schedule will be posted at appropriate locations within each work area at least thirteen (13) calendar days or sooner preceding the effective date of the schedule. Once posted, any temporary changes in an employee’s posted schedule and shift assignment will be made by mutual agreement, unless emergency conditions dictate otherwise. An emergency is defined as an unplanned and or unpredictable event such as a disaster declared by federal or state authorities. 2. The Employer shall use every reasonable effort to grant employee schedule requests made at least two (2) weeks in advance of the effective date of the next work schedule. Late changes in the schedule requested by individual employees may be possible with the approval of the employee’s supervisor and will not be unreasonably denied if coverage is available. 3. The Employer shall continue its existing policy permitting employees to trade shifts with other employees where the employee substituted has the requisite competencies and where the trade does not result in increased overtime costs for the Employer. C. Overtime Premiums 1. Eight Hour Shift Employees who work an eight (8) hour schedule shall receive one and one half times (1½) their straight time rate of pay for all hours worked over eight hours in one standard workday, or over forty (40) in one standard workweek. Employees who work an eight hour schedule shall receive two times their straight time rate of pay for all hours worked in excess of twelve (12) in any one (1) standard workday. For purposes of calculating overtime, time flexed will count as time worked. 2. Ten Hour Shift Employees who work four scheduled workdays of ten (10) hours each, shall be paid one and one half (1½) times their straight time rate of pay for: a) all hours worked in excess of ten (10) but less than twelve (12) during one work day; and, b) the first eight (8) hours worked on days other than the four (4) regularly scheduled work days, if worked. Employees who complete a four (4) day workweek schedule of four (4) ten (10) hour shifts will be paid two (2) times their straight time rate of pay for: a) all hours worked in excess of eight (8) on days worked in addition to the four (4) ten (10) hour days; and b) all hours worked in excess of twelve (12) on any workday. 60

3. Twelve Hour Shift Employees who work twelve hour shifts shall be paid two (2) times their straight time rate of pay for all hours worked over twelve (12) hours in the workday and one and one half times (1 ½) times their straight time rate of pay for the fourth or more shift in the workweek and for hours over seventy-two (72) in the pay period. 4. For all categories above: A. All work in excess of twelve (12) hours within a twenty-four (24) hour period shall be paid at the rate of two times (2 X) the basic straight-time hourly rate. All work on the seventh (7 th ) consecutive day of the work week shall be paid at one and one half times (1 ½ X) the basic straight-time hourly rate. D. Overtime Calculation 1. Only hours actually worked will be considered as time worked for the purposes of computing overtime. Unless otherwise specified in this agreement. 2. Any overtime must be authorized by an employee’s supervisor, or designee, prior to the time such work is performed. Employees who repeatedly fail to comply with the provisions of this paragraph may be subject to disciplinary action. 3. Payment of overtime rates shall not be duplicated for the same hours worked. To the extent that hours worked are compensated at overtime rates under one provision of this Article, they shall not be compensated again as overtime under any other provision, unless specifically stated in this agreement. E. Meals and Rest Breaks Employees who work scheduled shifts of five (5) hours or more are entitled to a dutyfree, unpaid meal period of at least thirty (30) minutes. Employees who work in excess of five (5) hours but less than six (6) hours may voluntarily waive the meal period. Each employee shall be granted a paid rest period of fifteen (15) minute break periods per four (4) hours of work, or major fraction thereof. Unpaid meal periods shall not be counted as hours worked in calculating overtime to be paid under any provision of this Article. F. Report Pay 1. An employee who is instructed or scheduled to report to work, and who reports to work without prior notice that no work is available, shall perform any work assigned 61

times their straight time rate <strong>of</strong> pay for all hours worked over twelve (12) hours in<br />

the workday and one and one half times (1 ½) times their straight time rate <strong>of</strong> pay<br />

for the fourth or more shift in the workweek and for hours over seventy-two (72)<br />

in the pay period.<br />

4. For all categories above:<br />

A. All work in excess <strong>of</strong> twelve (12) hours within a twenty-four (24)<br />

hour period shall be paid at the rate <strong>of</strong> two times (2 X) the basic<br />

straight-time hourly rate. All work on the seventh (7 th ) consecutive<br />

day <strong>of</strong> the work week shall be paid at one and one half times (1 ½<br />

X) the basic straight-time hourly rate.<br />
