ARTICLE 16: FLOATING For O’Connor, Saint Louise and Seton only: A. Orientation for Floating. When employees are floated between units or departments, they will not be required to perform duties for which they are not competent, and will be given orientation, as appropriate. Employees may be floated to other units or departments in order to receive training that will enable the employee to competently perform duties in the unit. B. Floating Order Employees who float to another unit or department will do so on a rotational basis within the classification being floated, provided said employee is competent to perform the assignment in the unit to which he/she is floated. A unit/department may float on a straight seniority basis within a classification, if in a vote conducted by the Union, a majority of employees in that unit or department chooses to implement a seniority system. Before floating regular employees, the Employers shall float employees in the following order: 1. Volunteers 2. Registry/Travelers (provided competencies exist) 3. Temporary employees 4. Per Diem employees 5. Limited Part-time C. Floating to More than One Unit/Department No employee will float to more than one (1) department or unit during a single shift, unless floating to multiple departments/units is a regular part of an employee’s assignment. D. Float Differential At O'Connor and Saint Louise only: Employees who float will receive a float differential of one dollar ($1) per hour. At St. Francis Only: A. Definitions 38

l. Floating is defined as the temporary reassignment of an employee to a work area outside of their assigned unit. 2. Employees may be assigned to float to a unit other than their own, subject to the limitation assigned in this article. B. Floating Order l. Volunteers 2. Registry/ Travelers 3. Temporary Employees 4. Per Diem 5. Limited or Non-Benefited Part-Time 6. Regular Part-Time 7. Regular Full-Time C. Floating Rotation The order of the float for employees within a unit will be on a rotational basis within each of the categories of employees described above. Floating decisions shall be based on patient needs. D. Floating of employees shall be in compliance with all federal and state laws and regulations, including Title XXII of the California Administrative Code. E. Competency All personnel shall be subject to the following restrictions: 1. Limited Assignments. Assignments shall include only those duties and responsibilities for which competency has been demonstrated. 2. Competent Designated Resource Staff Person. Employees assigned to a unit for which their competency has not been demonstrated will be assigned to a qualified designated resource staff person to assist them, who has demonstrated competency for the patient care unit involved. 3. Patient Responsibility. An employee shall not be assigned responsibility that is inconsistent with the employee's certification or license, as provided by state and federal law. 4. Floating Orientation. Employees who are floated to another patient care unit will be oriented in accordance to Title XXII, as applicable. Such orientation will include, but not be limited to, reviewing the unit checklist, appropriate to such employee, with an employee that is familiar with that unit. 5. Skill Level and Experience. Employees floated may only be assigned to a patient care assignment consistent with the employee's current (within the last 12 months) skill level and competency, with the appropriate scope of practice. 39
