employee’s shift, or would change the employee’s classification; or<br />

b. If the bidding employee is in his/her current position as a direct<br />

result <strong>of</strong> a job change or lay<strong>of</strong>f.<br />

At St. Francis<br />

3. Restriction on Bidding. An employee who applies for and is<br />

awarded a posted position may not be awarded another posted vacancy within the<br />

next six (6) months. This rule shall not apply if:<br />

a. If a posted vacancy arises in the same department which would<br />

change the number <strong>of</strong> pre-scheduled hours <strong>of</strong> the bidding employee, or the<br />

scheduled start and end times, or the days <strong>of</strong> work and days <strong>of</strong>f, or the employee’s<br />

shift, or would change the employee’s classification; or<br />

b. If the bidding employee is in his/her current position as a direct<br />

result <strong>of</strong> a job change or lay<strong>of</strong>f.<br />

For All Hospitals<br />

4. Preference Order. Preference among those bidding shall be given in the<br />

following order among bidding employees from the same preference level.<br />

Among bidding employees from the same preference level, seniority shall govern.<br />

The prior sentence is subject to the provisos that (1) the bidding employee must<br />

meet all reasonable qualifications <strong>of</strong> the job established by the Employers (the<br />

Union has the burden <strong>of</strong> establishing that the Employers’ qualifications are<br />

unreasonable), and (2) ability and performance must meet minimum requirements<br />

in the Employers’ reasonable judgment, and if the Employers’ judgment is<br />

disputed, the Employers have the burden <strong>of</strong> establishing that their judgment was<br />

reasonable.<br />

a. Regular employees from the same department, including regular<br />

employees on lay<strong>of</strong>f, and regular employees who remain on the per diem<br />

list who have been laid <strong>of</strong>f.<br />

b. Regular employees from other departments and Limited Part-time<br />

employees from the same department, including such employees on<br />

lay<strong>of</strong>f, and regular employees who remain on the per diem list.<br />

c. Per Diem and Temporary employees, in that order, from the same<br />

department.<br />

d. Limited Part-time employees from other departments.<br />

e. Per Diem and Temporary employees, in that order, from other<br />

departments.<br />
