The Employers also support the right <strong>of</strong> workers to form and join an employee<br />

organization. They support their right to choose not to do so. It is important when<br />

employees are making such a choice that accurate information about the goals and vision<br />

<strong>of</strong> any organization that is seeking to represent them be available to the employees to<br />

assist them in making their decision.<br />

Section 2 – Notice <strong>of</strong> Intent to Organize<br />

When employees have begun signing union authorization cards in an appropriate unit, as<br />

defined herein, the Union shall promptly notify the Employer <strong>of</strong> the employees in that<br />

unit <strong>of</strong> its intent to organize a group <strong>of</strong> employees and identify an appropriate unit.<br />

Within seven days <strong>of</strong> the Union’s notification to the Employer <strong>of</strong> its intent to organize an<br />

appropriate unit, the Employer and the Union will distribute a jointly signed reproduction<br />

<strong>of</strong> the Recognition Procedure as described herein.<br />

Section 3 – Appropriate Unit Defined<br />

The parties agree that, except as provided herein, an appropriate unit is that which is<br />

defined by the National Labor Relations Board for healthcare providers. Appropriate<br />

bargaining units shall be as follows:<br />

1. All pr<strong>of</strong>essional employees, except physicians and registered nurses;<br />

2. All technical employees, except those already included in existing units;<br />

3. All home health non-pr<strong>of</strong>essional employees;<br />

4. All home health pr<strong>of</strong>essional employees;<br />

5. All residual service and maintenance employees; and<br />

6. All Business Office Clerical Employees.<br />

Bargaining units pursuant to this provision will be on a single facility basis, and shall be<br />

as set forth in the National Labor Relations Board Health Care Rules.<br />

Determination <strong>of</strong> Majority Status/Election. Upon presentation <strong>of</strong> the percentage <strong>of</strong><br />

union authorization cards required by the NLRB to the NLRB from the employees in an<br />

appropriate bargaining unit, as defined above, employees in any <strong>of</strong> the appropriate<br />

bargaining units are entitled to petition for an election to be held by the NLRB in an<br />

expedient and timely manner.<br />

The Employers and Union agree to the mutual goal <strong>of</strong> scheduling an election conducted<br />

by the NLRB within forty-five (45) days <strong>of</strong> the filing <strong>of</strong> the petition.<br />
