Neither the Employers nor the Union will engage in conduct that would constitute<br />

unlawful discrimination under the National Labor Relations Act. Union activities shall<br />

not interfere with the normal operations <strong>of</strong> the Employers.<br />

Neither the Employers nor the Union shall discriminate for or against any employee<br />

because <strong>of</strong> race, creed, color, religion, age, sex, sexual orientation, national origin,<br />

ancestry, disability, medical condition, veteran status (including Vietnam-era or disabled<br />

veteran status), political affiliation, marital status or in violation <strong>of</strong> any City, State or<br />

Federal laws.<br />

Each party retains its right to challenge any administrative, judicial or other ruling or<br />

interpretation <strong>of</strong> any applicable laws relating to any form <strong>of</strong> discrimination if it disagrees<br />

with such ruling or interpretation.<br />

Any grievance alleging in whole or in part, discrimination as set forth above may either<br />

be pursued through the provisions <strong>of</strong> Article 30, Grievance and Arbitration, and/or<br />

through statutory remedies.<br />

At St. Francis Only:<br />

The Employer and the Union agree that no employee or applicant for employment shall<br />

be discriminated against on the basis <strong>of</strong> race, color, religion, creed, sex, sexual<br />

orientation, age, citizenship, marital status, physical handicap, medical condition,<br />

national origin, ancestry, or veteran status (including Vietnam-era or disabled veteran<br />

B. Equal Pay<br />

There shall be no distinction between the wages paid to men and the wages paid to<br />

women for the performance <strong>of</strong> comparable quality and quantity <strong>of</strong> work on the same or<br />

similar operations.<br />
