Council would need to pass Resolution No. 17-2011 with adjustments to the map reflecting properties at 1301 Armstrong, opted out. Mayor Tulley opened the public hearing. As no one wished to speak, the public hearing was closed. Motion: Vice-Mayor Johnson moved to approve Resolution No. 17-2011 with Sculptor Charter School at 1301 Armstrong Drive removed from Resolution No. 17-2011 as recommended by staff. Member Burson seconded the motion. The roll call was: Member Pritchett Yes Vice-Mayor Johnson Yes Mayor Tulley Yes Member Long Yes Member Burson Yes The motion carried unanimously. xxx Resolution No. 18-2011 designating real property known as Bobbi Lane Commercial/Industrial area, as a Florida Brownfield area for the purpose of rehabilitation, economic redevelopment, and environmental remediation; and directing the City Manager to notify the Department of Environmental Protection of said designation. City Manager Ryan advised there was a known contamination on this property, which designated that property as a Brownfield Area. Mayor Tulley opened the public hearing. The motion carried unanimously. xxx Resolution No. 19-2011 designating real properties owned by RW Kirk Family LTD Partnership located at 4710 South Washington Avenue, as a Florida Brownfield Area for the purpose of rehabilitation, economic redevelopment, and environmental remediation; directing the City Manager to notify the Department of Environmental Protection of said designation. City Manager Ryan advised the utilization of arsenic for weed control used along the railroad right-of-way on this property created the ability to designate that area as a Brownfield Area. Mayor Tulley opened the public hearing. Robert Kirk advised he was there to answer any questions Member Burson asked what Mr. Kirk’s plan for the property. Mr. Kirk advised that previously the property was used for retail and housing, but with the economy as it was, it would not support that and he would wait to see what the market would support at a future time. The property was an underdeveloped property with the potential to have problems with contamination. The Brownfield designation would give him the same advantage as Brownfields that were designated in the south part of the County. Mr. Kirk expressed new people to the area look for those benefits and he felt this would help in attracting them to the Titusville area. Mayor Tulley closed the public hearing. Motion: Member Pritchett moved to approve Resolution 19-2011 as recommended. Vice-Mayor Johnson seconded the motion.
