5. Declaration of Priority<br />

Where <strong>the</strong> design application relies upon an International Application from <strong>the</strong><br />

International Bureau of <strong>the</strong> World <strong>Intellectual</strong> <strong>Property</strong> <strong>Office</strong>, one of <strong>the</strong> countries<br />

designated in <strong>the</strong> International Application should be identified and <strong>the</strong> name of that<br />

country should be entered into <strong>the</strong> space provided in Part 9 of Form D3.<br />

Please note that <strong>the</strong> country designated in Part 9 must be a "Convention country",<br />

that is, a country or territory, o<strong>the</strong>r than Singapore, which is a party to <strong>the</strong> Paris<br />

Convention or a member of <strong>the</strong> World Trade Organisation.<br />

6. Streamlining of procedures: Priority Documents<br />

With effect from <strong>the</strong> 1 st January 2005, it will no longer be necessary for applicants to<br />

lodge <strong>the</strong> supporting priority documents where priority is claimed in an application<br />

for registration. The Registrar may however exercise her discretion and request for<br />

priority documents to be lodged to verify <strong>the</strong> priority claim, where <strong>the</strong> need arises.<br />

7. Date of Registration of Design<br />

Section 20 of <strong>the</strong> Registered Designs Act relating to <strong>the</strong> date of registration has<br />

been amended. The amended Section 20 reads:<br />

“Date of registration<br />

20. —(1) A design when registered shall be registered as of <strong>the</strong> date on which <strong>the</strong><br />

application for registration is filed, and that date shall be deemed for <strong>the</strong> purposes<br />

of this Act to be <strong>the</strong> date of its registration.”<br />

The amendment will be effective only in relation to applications lodged on and from<br />

<strong>the</strong> 1 st January 2005. With effect from <strong>the</strong> 1 st January 2005 <strong>the</strong>refore, <strong>the</strong> date of<br />

registration of a design which has a priority claim, is <strong>the</strong> date of its application at <strong>the</strong><br />

Registry.<br />
