person to produce any document, a certified copy there<strong>of</strong> or any other material in his<br />

possession and to require any person to provide to the <strong>Commission</strong>, any information<br />

in writing which he is likely to possess. 418 The assistance <strong>of</strong> a public <strong>of</strong>ficer selected<br />

by the <strong>Commission</strong>, with the concurrence <strong>of</strong> the relevant appointing authority, to<br />

conduct investigations into the relevant matter or subject that is being inquired<br />

into/investigated by the <strong>Commission</strong> is also secured by the 2008 amendment. 419<br />

Although, as noted above, the COI Act <strong>of</strong> 1948 vests considerable powers in the<br />

commissions to summon witnesses, one perennial complaint by the commissioners<br />

related to the failure <strong>of</strong> law enforcement <strong>of</strong>ficers to adhere to their summons. As<br />

stated by the 1994 Northern and Eastern Disappearances <strong>Commission</strong>, this was a<br />

frustrating experience:<br />

The Second Stage <strong>of</strong> the inquiry was to find out the persons responsible for<br />

these arrests and subsequent disappearances. This was a more complex<br />

problem. Most people who suffered in the North and East were illiterate and<br />

from rural milieu and could not distinguish the Special Task Force persons<br />

from the Army personnel. It was virtually impossible for them to identify any<br />

<strong>of</strong>ficers who were responsible for these arrests by name or by rank. The Sri<br />

Lankan Army does not display the name badge on the uniform like the<br />

American G.I. Except for some notorious cases <strong>of</strong> Army Personnel who were<br />

known far and wide for their terror tactics, most <strong>of</strong> the <strong>of</strong>ficers and soldiers<br />

who participated in the arrests could not be identified. We had to write to the<br />

Army and the Police to find out which <strong>of</strong>ficer was in-charge <strong>of</strong> a particular<br />

camp at a particular time. This operation was time consuming. There were<br />

delays in replies and <strong>of</strong>ten there were no replies at all. We were able to<br />

investigate into some complaints but the bulk <strong>of</strong> the exercise is left for the<br />

successor commission to look into. 420<br />

In many instances, the commissioners made on-site visits. Ins<strong>of</strong>ar as resources are<br />

concerned, the following observation made by one <strong>of</strong> the 1994 Disappearances<br />

<strong>Commission</strong>s is pertinent:<br />

In addition we have to face administrative bottlenecks. The Secretary had to<br />

make several trips to various <strong>of</strong>fices to get even small matters attended to. A<br />

photocopier which is a must is yet to come. Typewriters were made available<br />

only a few days ago. Our application for a telephone was approved on a<br />

priority basis on 23 rd January 1995; the connection has still not been given. 421<br />

The <strong>Commission</strong> cannot arrive at any conclusion consequent to such investigations until it has<br />

examined the material collected in the course <strong>of</strong> such investigation and inquired into such matter or<br />

incident, observing the rules <strong>of</strong> natural justice.<br />
