policy on Māori to be properly measured, <strong>the</strong>re would also be a need for<br />

specialist expertise in <strong>the</strong> Ministry of <strong>Justice</strong> (<strong>and</strong> perhaps o<strong>the</strong>r ministries).<br />

Individuals with a background in empirical research might prove valuable, as well<br />

as those with a underst<strong>and</strong>ing of tikanga Māori (who might be able to evaluate<br />

<strong>the</strong> impact of policy on Māori cultural values). Increasing <strong>the</strong> te reo <strong>and</strong> tikanga<br />

Māori proficiency of our public servants is obviously a necessary step, <strong>and</strong> would<br />

bring us into line with o<strong>the</strong>r bicultural <strong>and</strong> bilingual nations such as Canada. If<br />

that expertise were carefully managed, this proposal might have <strong>the</strong> added<br />

benefit of giving effect to one of Moana Jackson’s recommendations in He<br />

Whaipaanga Hou, which was to infuse Ministry of <strong>Justice</strong> (or <strong>the</strong> Department of<br />

<strong>Justice</strong>, as it was in 1988) processes with tikanga Māori.<br />

We also think o<strong>the</strong>r mechanisms should be investigated. We strongly endorse<br />

Moana Jackson’s call for a Māori Law Commission. We recommend that a pilot<br />

be run in partnership with <strong>the</strong> existing Law Commission. We also suggest that in<br />

<strong>the</strong> upcoming consideration of constitutional issues, thought be given to <strong>the</strong><br />

possibility of a mechanism (akin to s 7 of <strong>the</strong> New Zeal<strong>and</strong> Bill of Rights Act<br />

1990) requiring <strong>the</strong> tabling of legislative <strong>and</strong> policy impact statements that<br />

consider whe<strong>the</strong>r Māori are disproportionately affected (<strong>and</strong> <strong>the</strong>reby Treaty<br />

obligations breached) by proposed legislation.<br />
