Banks and financial institutions traditionally have favoured<br />

litigation over arbitration as the means <strong>of</strong> resolving<br />

international disputes. However, in recent years there has<br />

been a growing use <strong>of</strong> international arbitration—particularly<br />

in transactions with counterparties in emerging markets.<br />

What are the reasons behind this trend — and, moreover, what<br />

are the relative pros and cons <strong>of</strong> arbitration vs. litigation? Do<br />

Speaker biographies<br />

Sapfo Constantatos joined Standard <strong>Chartered</strong> Bank in 2007<br />

and is a Senior Group Legal Counsel in dispute resolution.<br />

She has responsibility for managing material disputes arising<br />

from businesses across the bank’s global network. Sapfo<br />

was seconded for a year to the Chairman’s Office as Sir<br />

John Peace’s Executive Assistant. Prior to joining the bank,<br />

Sapfo was a senior associate at Allen & Overy in London,<br />

specialising in international arbitration. She has also worked<br />

at the Privy Council Office <strong>of</strong> the Government <strong>of</strong> Canada<br />

in intergovernmental affairs and in the gender promotion<br />

programme at the International Labour Organization in<br />

Geneva. She has degrees in common and civil law from McGill<br />

University in Canada and an LLM from Cambridge. She is<br />

qualified in Quebec, England and Wales.<br />

James Freeman is a Senior Associate in the International<br />

Arbitration Group at Allen & Overy in London. He has broad<br />

experience <strong>of</strong> both arbitration and litigation <strong>of</strong> banking and<br />

finance disputes in Europe and Asia under the rules <strong>of</strong> various<br />

seats and institutions. James has also published a number<br />

<strong>of</strong> articles in this area. In addition, James has experience<br />

in other industry sectors including oil and gas, aerospace,<br />

telecoms and steel. He has a Diploma in International<br />

Arbitration with Distinction from Queen Mary College,<br />

University <strong>of</strong> London.<br />

Ali Malek QC is Head <strong>of</strong> Chambers at 3 Verulam Buildings with<br />

a practice specialising in all types <strong>of</strong> banking and financial<br />

disputes, aviation, international trade, financial services,<br />

insurance, civil fraud, energy law (oil and gas joint venture<br />

disputes),competition and consumer credit law, pr<strong>of</strong>essional<br />

negligence (accountants and solicitors), insolvency and sports<br />

law. He is active in international arbitration, particularly under<br />

ICC, LCIA and ICSID rules. He received his degree from Oxford<br />

University in 1978 and was called to the Bar in 1980. He was<br />

appointed a Queen’s Counsel in 1996. Ali has been a recorder<br />

since 2000 and also sits as a Deputy High Court Judge. He is a<br />

former Chairman <strong>of</strong> the Commercial Bar Association.<br />

Victoria Orlowski is the Managing Counsel at ICC<br />

International Court <strong>of</strong> Arbitration. Victoria supervises the<br />

court’s eight case management teams and works closely with<br />

the Secretary General, Deputy Secretary General and General<br />

Counsel to develop and maintain practices and ensure quality<br />

and consistency in the administration <strong>of</strong> ICC arbitrations.<br />

She formerly headed a case management team focusing on<br />

common law jurisdictions, particularly the United States and<br />

Canada. Victoria earned her law degree with a specialisation<br />

in international legal studies from Cornell Law School and<br />

graduated from Emory University with degree in English<br />

literature and Japanese language and culture. Before joining<br />

ICC, she was a Litigation Associate at White & Case in New<br />

York City. She is admitted to the New York State Bar.<br />

Richard Smith is a Partner at Allen & Overy. He is a Solicitor<br />

Advocate and specialises in insurance coverage arbitrations,<br />

particularly those conducted under the Bermuda Form<br />

insurance policy. Uniquely amongst his peers, Richard also has<br />

significant experience <strong>of</strong> arbitration-related litigation before<br />

the English Courts. He speaks regularly on arbitration issues<br />

and is frequently interviewed by the broad<strong>sheet</strong>, legal and<br />

insurance press on developments in arbitration. Richard has<br />

also acted for interested parties and witnesses (including the<br />

former UK Prime Minister) in high pr<strong>of</strong>ile and controversial<br />

public inquiries in the UK and overseas, including the Hong<br />

Kong Airport, BSE and Bloody Sunday Inquiries.<br />
