ICC INSIGHT SERIES
Resolving financial services disputes
Allen & Overy, One Bishops Square, London, E1 6AD
Banks and financial institutions traditionally have favoured
litigation over arbitration as the means of resolving
international disputes. However, in recent years there has
been a growing use of international arbitration—particularly
in transactions with counterparties in emerging markets.
What are the reasons behind this trend — and, moreover, what
are the relative pros and cons of arbitration vs. litigation? Do
international arbitrators have a sufficient knowledge of complex
financial instruments? Is arbitration more suited to some
disputes than others?
Join our panel on 5 November to discuss these issues — and
learn what works for your bank. The session will also review the
key features of ICC arbitration in a financial markets context.
