Significant accomplishments under CIDG OPLAN “Mega Shoppers”:
1. SEIZURE OF COUNTERFEIT SPRINGMAID PRODUCTS
IN PASAY CITY
• On January 28, 2011, elements of AFCCD of this Group
together with representative from Placel Manufacturing Company, Incorporation
simultaneously implemented Search Warrant Nos. 10-17041 to 10-17068 issued
by Hon. Antonio M. Eugenio Jr., Judge of RTC Branch 24, Manila against John
and/or Jane Does, owners and/or occupants of stalls located at Baclaran
Terminal Plaza and Baclaran Supermall, Taft Avenue corner F.B. Harrison
Street, Pasay City.
• The operation resulted in the seizure/confiscation of 22,041
pieces of Comb and 648 pieces toothbrush of counterfeit Springmaid Products
with an estimated amount of Php 340,335.00. The confiscated items were
temporarily under custody of a custom bonded warehouse rented by IP owner
pending court litigation.
• A case for violation of Section 168 in relation to Section 170
(Unfair Competition) and Section 177 in relation to Section 217 (Copyright
Infringement) of RA 8293 (Intellectual Property Code of the Philippines) were
filed against the alleged owners and/or occupants of aforesaid establishment.
2. SEIZURE OF COUNTERFEIT MAGGI MAGIC SARAP
PRODUCTS IN QUEZON CITY AND SAN ANDRES, MANILA
• On January 27, 2011, elements of AFCCD of this Group
simultaneously implemented Search Warrant Nos. 11-17198 to 11-17203 issued
by Hon. Amor E. Reyes, Executive Judge of RTC Branch 21, Manila against the
following establishments:
- Cula Trading located at Commonwealth Market,
Quezon City;
- Norma’s Store located at Commonwealth Market,
Quezon City;
- Stalls D-073 and D-074 located at Dagonoy
Market, San Andres, Manila;
- Stall D-064 located at Dagonoy Public Market,
San Andres, Manila;
- Stall D-001 located at Dagonoy Public Market,
San Andres, Manila; and
- Stall D-005 located at Dagonoy Public Market,
San Andres, Manila;
• The operation was conducted in an orderly manner and
witnessed by the security guards, Brgy. Tanod and other
witnesses/representative of Nestle Philippines Incorporation represented by RVD
Law Firm that resulted to the seizures of 12,278 pieces of Maggi Magic Sarap
and 8,193 pieces of Nescafe (3 in 1) 16.5 grams with an estimated value of
Php 78,000.00. The seized items were brought to Carepark Moving and Storage
Warehouse, a third party bonded warehouse, located at No. 1234 Villongco
