Before Construction of your Facility<br />

Open<strong>in</strong>g a body art bus<strong>in</strong>ess takes time and plann<strong>in</strong>g. Contact<strong>in</strong>g various offices may<br />

seem like <strong>to</strong>o much trouble but it is important <strong>to</strong> ensure you know what is required of<br />

you. It will save you time and money <strong>in</strong> the future.<br />

Environmental <strong>Health</strong> Plan Review<br />

Any new construction or remodel<strong>in</strong>g will require that plans be submitted <strong>to</strong> and<br />

approved by Plan Review prior <strong>to</strong> construction, open<strong>in</strong>g your facility, obta<strong>in</strong><strong>in</strong>g build<strong>in</strong>g,<br />

plumb<strong>in</strong>g or electrical permits.<br />

Build<strong>in</strong>g Department<br />

Any construction that <strong>in</strong>volves structure, electricity, plumb<strong>in</strong>g or construction of separate<br />

rooms will require a build<strong>in</strong>g permit.<br />

Sign Restrictions<br />

Cities may also regulate the type of sign you use on your bus<strong>in</strong>esses. Contact your local<br />

Code Enforcement Agency <strong>to</strong> determ<strong>in</strong>e if the jurisdiction has any requirements or<br />

restrictions for signage.<br />

Bus<strong>in</strong>ess License<br />

Cities also require that you obta<strong>in</strong> a bus<strong>in</strong>ess license. Contact the local jurisdiction <strong>in</strong><br />

which your bus<strong>in</strong>ess is located <strong>to</strong> f<strong>in</strong>d out what the procedures are for obta<strong>in</strong><strong>in</strong>g a<br />

bus<strong>in</strong>ess license.<br />

Liability Insurance<br />

All body art bus<strong>in</strong>esses should obta<strong>in</strong> liability <strong>in</strong>surance <strong>to</strong> protect the assets of your<br />

bus<strong>in</strong>ess. Most landlords will require it and some cities will require it <strong>in</strong> order <strong>to</strong> obta<strong>in</strong> a<br />

bus<strong>in</strong>ess license.<br />

Fictitious Bus<strong>in</strong>ess Name (DBA)<br />

If your bus<strong>in</strong>ess name is anyth<strong>in</strong>g other than your legal name, a fictitious bus<strong>in</strong>ess<br />

license is required. You will need a fictitious bus<strong>in</strong>ess name <strong>to</strong> open a bus<strong>in</strong>ess bank<br />

account, and <strong>to</strong> establish any merchant accounts. A fictitious bus<strong>in</strong>ess name statement<br />

must be filed with the <strong>County</strong> Assessor/Recorder/Clerk. Contact your local<br />

jurisdiction that your facility is located <strong>in</strong> <strong>to</strong> obta<strong>in</strong> your fictitious bus<strong>in</strong>ess license.<br />

Tax ID Number<br />

If your bus<strong>in</strong>ess will have any employee other than yourself, you are required <strong>to</strong> have<br />

federal and state Employer tax ID numbers. Contact your local jurisdiction <strong>to</strong> obta<strong>in</strong><br />

your tax ID number.<br />

Seller’s <strong>Permit</strong><br />

You must have a seller’s permit or resale permit if your bus<strong>in</strong>ess purchases wholesale<br />

items for later resale <strong>in</strong> your body art bus<strong>in</strong>ess. You can obta<strong>in</strong> your seller’s permit from<br />

the California State Board of Equalization.<br />

Shop Layout<br />

In general, a body art bus<strong>in</strong>ess will need space for at least five areas: wait<strong>in</strong>g area, front<br />

counter, procedure room, clean<strong>in</strong>g room, restroom, and s<strong>to</strong>rage. If pre-packaged, presterilized<br />

and disposable equipment is used, then the clean<strong>in</strong>g room can be reduced <strong>to</strong><br />

the size of a mop closet.<br />

Wait<strong>in</strong>g Area and Front Counter<br />

This area should provide seat<strong>in</strong>g and must be away from the procedure area. It may<br />

have an area used for consultation with clients about available procedures.<br />

Required signage should be posted near this area, such as AGE requirement and any<br />

other required signage.<br />

Procedure Room (Area)<br />

The procedure area must be separated from wait<strong>in</strong>g area and the clean<strong>in</strong>g room. This<br />

area must meet the follow<strong>in</strong>g requirements: have adequate light<strong>in</strong>g, be separate from<br />

hair/nail activities, have a l<strong>in</strong>ed waste conta<strong>in</strong>er, have a sharps conta<strong>in</strong>er labeled<br />

“BIOHAZARD”, and a hand s<strong>in</strong>k with liquid soap and a <strong>to</strong>uch-less wall-mounted s<strong>in</strong>gle<br />

dispens<strong>in</strong>g paper <strong>to</strong>wel dispenser. The hand s<strong>in</strong>k must be plumbed with hot and cold<br />

water. Ultrasonic cleaners must not be used at work stations.<br />

Clean<strong>in</strong>g Room (Decontam<strong>in</strong>ation and Sanitization)<br />

The clean<strong>in</strong>g room must be separate from procedure areas by at least 5 feet or by a<br />

cleanable barrier, have a s<strong>in</strong>k with liquid soap and a <strong>to</strong>uch-less wall-mounted s<strong>in</strong>gle<br />

dispens<strong>in</strong>g paper <strong>to</strong>wel dispenser. The s<strong>in</strong>k must be plumbed with hot and cold water.<br />

The room must also have a l<strong>in</strong>ed waste conta<strong>in</strong>er and sharps conta<strong>in</strong>er labeled<br />

“BIOHAZARD”.<br />

The sterilization units must have mechanical <strong>in</strong>dica<strong>to</strong>rs for time, temperature, and<br />

pressure. Each sterilization load must have a Class V <strong>in</strong>tegra<strong>to</strong>r and each <strong>in</strong>dividual<br />

sterilization pack must have its own <strong>in</strong>dica<strong>to</strong>r.<br />

A monthly biological spore <strong>in</strong>dica<strong>to</strong>r moni<strong>to</strong>r<strong>in</strong>g test must be performed, recorded and<br />

the records ma<strong>in</strong>ta<strong>in</strong>ed for two years. A written log must also be ma<strong>in</strong>ta<strong>in</strong>ed on site for<br />

two years that conta<strong>in</strong>s the follow<strong>in</strong>g <strong>in</strong>formation: date of load, list of contents <strong>in</strong> load,<br />

exposure time and temperature, and results of the Class V <strong>in</strong>tegra<strong>to</strong>r. For cycles where<br />

the results are positive, it must be logged how the items were cleaned and proof of a<br />

negative test before reuse.<br />

Clean <strong>in</strong>struments must be s<strong>to</strong>red <strong>in</strong> a clean, dry, dust/moisture proof s<strong>to</strong>rage cab<strong>in</strong>et.<br />

Sterilized <strong>in</strong>struments must be s<strong>to</strong>red <strong>in</strong> <strong>in</strong>tact peel packs. If the <strong>in</strong>tegrity of the pack is<br />

compromised, the pack must be discarded or reprocessed before use.<br />

If no sterilization area is available, the bus<strong>in</strong>ess must use only disposable, s<strong>in</strong>gle-use,<br />

pre-sterilized <strong>in</strong>struments. Records must be ma<strong>in</strong>ta<strong>in</strong>ed on site for 90 days and must<br />

<strong>in</strong>clude: record of purchase and use of all s<strong>in</strong>gle-use <strong>in</strong>struments and a log of all<br />

procedures. The log of procedures must <strong>in</strong>clude the practitioner’s name, client’s name,<br />

and the date of the procedure.<br />

Restroom<br />

Restrooms may not be accessible by walk<strong>in</strong>g through the clean<strong>in</strong>g rooms. Restrooms<br />

must have a s<strong>in</strong>k with hot and cold runn<strong>in</strong>g water, a l<strong>in</strong>ed waste conta<strong>in</strong>er, and a wall<br />

mounted liquid soap and <strong>to</strong>uch-less s<strong>in</strong>gle-use paper <strong>to</strong>wel dispenser.<br />

S<strong>to</strong>rage<br />

S<strong>to</strong>rage must be separate from wait<strong>in</strong>g, procedure area, or clean<strong>in</strong>g area. It should be<br />

used for records, chemicals, and other supplies for the bus<strong>in</strong>ess.<br />

Bloodborne Pathogen/Infection Control Tra<strong>in</strong><strong>in</strong>g<br />

All employees will be required <strong>to</strong> complete a bloodborne pathogen/<strong>in</strong>fection control<br />

class that meets OSHA requirements and is specifically geared <strong>to</strong>ward prevent<strong>in</strong>g cross<br />

contam<strong>in</strong>ation and disease transmission <strong>in</strong> body art and permanent cosmetics<br />

bus<strong>in</strong>esses. Some onl<strong>in</strong>e courses may be approved, contact EMD for verification. The<br />

class must be specific <strong>to</strong> body art, two hours long and taken annually. The course must<br />

conta<strong>in</strong> the follow<strong>in</strong>g <strong>in</strong>formation: OSHA, local ord<strong>in</strong>ance requirements, transmission<br />

control of diseases, tasks performed, personal protective equipment, types of tasks,<br />

handwash<strong>in</strong>g, dis<strong>in</strong>fectants, chemical labels, Hep B vacc<strong>in</strong>e, and Bloodborne pathogen<br />

exposure.<br />

Records of this tra<strong>in</strong><strong>in</strong>g for all current and past employees must be ma<strong>in</strong>ta<strong>in</strong>ed on site<br />

for three years.<br />

Infection Prevention and Control Plan<br />

The owner and/or practitioners must have and follow a written Infection Prevention and<br />

Control Plan. This plan must <strong>in</strong>clude:<br />

Registrations<br />

<strong>Body</strong> <strong>Art</strong>ist (Practitioner) Registration<br />

Anyone engaged <strong>in</strong> the bus<strong>in</strong>ess of tat<strong>to</strong>o<strong>in</strong>g, body pierc<strong>in</strong>g, brand<strong>in</strong>g and the<br />

application of permanent cosmetics must register with the Environmental <strong>Health</strong><br />

Division <strong>in</strong> Sacramen<strong>to</strong> <strong>County</strong> prior <strong>to</strong> conduct<strong>in</strong>g bus<strong>in</strong>ess. The artist must have proof<br />

of current Hepatitis B vacc<strong>in</strong>e, evidence of completion of the OSHA Bloodborne<br />

Pathogen Tra<strong>in</strong><strong>in</strong>g, pho<strong>to</strong> I.D. ( must be 18 years or older), two passport pho<strong>to</strong>graphs,<br />

documentation of six months m<strong>in</strong>imum of related experience ( first time registrants<br />

only), bus<strong>in</strong>ess address, and payment. Practitioner registration must be renewed<br />

annually. Registrations must be ma<strong>in</strong>ta<strong>in</strong>ed on site at the bus<strong>in</strong>ess at all times.<br />

* All other permits and licenses <strong>to</strong> conduct bus<strong>in</strong>ess must be obta<strong>in</strong>ed.<br />

<strong>Body</strong> <strong>Art</strong>ist (Apprentice) Registration<br />

Anyone ga<strong>in</strong><strong>in</strong>g experience at a tat<strong>to</strong>o<strong>in</strong>g, body pierc<strong>in</strong>g, or permanent cosmetics facility<br />

under the direct supervision of a Practitioner must register with the Environmental<br />

<strong>Health</strong> Division <strong>in</strong> Sacramen<strong>to</strong> <strong>County</strong>. Apprentice registration must be ma<strong>in</strong>ta<strong>in</strong>ed on<br />

site at the bus<strong>in</strong>ess at all times. Once the six month apprenticeship is complete, the<br />

lower portion of the Apprenticeship Notification form must be completed and returned <strong>to</strong><br />

EMD.<br />

<strong>Health</strong> <strong>Permit</strong>s<br />

<strong>Body</strong> <strong>Art</strong> Facility <strong>Health</strong> <strong>Permit</strong>s<br />

An owner of a body art bus<strong>in</strong>ess (whether perform<strong>in</strong>g body art or not) is required <strong>to</strong><br />

obta<strong>in</strong> an annual health permit from the Environmental <strong>Health</strong> Division (EH) <strong>in</strong><br />

Sacramen<strong>to</strong> <strong>County</strong>. Each location is required <strong>to</strong> have its own health permit. <strong>Permit</strong>s<br />

are not transferrable. The holder of the facility health permit is responsible for ensur<strong>in</strong>g<br />

that only registered practitioners with valid health permits and/or registered apprentices<br />

are work<strong>in</strong>g <strong>in</strong> the bus<strong>in</strong>ess, for keep<strong>in</strong>g all clean<strong>in</strong>g and sterilization equipment <strong>in</strong> good<br />

operat<strong>in</strong>g condition, and for ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g a master <strong>in</strong>fection prevention and control plan<br />

that covers all people <strong>in</strong> the bus<strong>in</strong>ess.<br />

Any owner who violates this requirement will be subject <strong>to</strong> closure of the facility by EH<br />

and a penalty not <strong>to</strong> exceed three times the permit fee will be applied.<br />

<strong>Health</strong> <strong>Permit</strong>s Cont’d<br />

Mechanical Stud and Clasp Ear Pierc<strong>in</strong>g<br />

Mechanical stud and clasp ear pierc<strong>in</strong>g is not considered body art. A health permit is not<br />

required. A one-time facility notification fee will apply and must be submitted <strong>to</strong> EMD.<br />

<strong>How</strong>ever, any bus<strong>in</strong>ess <strong>in</strong>volved <strong>in</strong> ear pierc<strong>in</strong>g must meet the follow<strong>in</strong>g requirements:<br />

Ma<strong>in</strong>ta<strong>in</strong> a safe and sanitary facility<br />

Equipment must be s<strong>in</strong>gle-use, pre-sterilized, stud and clasp only<br />

Jewelry must meet code requirements of section 119310<br />

Piercers must meet the follow<strong>in</strong>g:<br />

• Be18 years or older<br />

• Have received a one hour tra<strong>in</strong><strong>in</strong>g that covers use of devices,<br />

types of bloodborne pathogens, proper hand hygiene, safe and<br />

sanitary use of s<strong>in</strong>gle-use equipment, cartilage ear pierc<strong>in</strong>g tra<strong>in</strong><strong>in</strong>g<br />

(if performed),<br />

Vehicle Bus<strong>in</strong>ess<br />

A practitioner that performs body art <strong>in</strong> their vehicle for more than seven days <strong>in</strong> a 90-<br />

day period <strong>in</strong> Sacramen<strong>to</strong> <strong>County</strong> is required <strong>to</strong> obta<strong>in</strong> a health permit. The practitioner<br />

must also comply with all requirements of temporary body are facilities. If the<br />

practitioner is perform<strong>in</strong>g body art <strong>in</strong> their vehicle for less than 7 days <strong>in</strong> a 90-day<br />

period, the vehicle will be treated as a temporary booth.<br />

Temporary <strong>Body</strong> <strong>Art</strong> Facilities<br />

A temporary booth operat<strong>in</strong>g <strong>in</strong> Sacramen<strong>to</strong> <strong>County</strong> for no more than 7 days <strong>in</strong> a 90-day<br />

period must meet the follow<strong>in</strong>g requirements:<br />

Operate <strong>in</strong> a build<strong>in</strong>g that has an easily accessible hand wash facilities that have<br />

hot and cold runn<strong>in</strong>g water, soap, and s<strong>in</strong>gle-use paper <strong>to</strong>wels<br />

Has a partition that is at least 3 feet high and separates the procedure area from<br />

the public<br />

Be free of <strong>in</strong>sects, rodents or any other animals<br />

Used only for perform<strong>in</strong>g body art<br />

Has adequate light<strong>in</strong>g<br />

Temporary <strong>Body</strong> <strong>Art</strong> Events<br />

A temporary body art event requires a sponsor. The sponsor must obta<strong>in</strong> all required<br />

permits Failure <strong>to</strong> obta<strong>in</strong> all necessary permits will result <strong>in</strong> the event be<strong>in</strong>g subject <strong>to</strong><br />

closure by EH and a penalty not <strong>to</strong> exceed three times the permit fee will be applied.<br />

The sponsor is responsible for ensur<strong>in</strong>g all of the follow<strong>in</strong>g are available for the event:<br />

Potable (dr<strong>in</strong>kable) water<br />

Restrooms that are supplied with <strong>to</strong>ilet paper, hand s<strong>in</strong>k(s) with hot and cold<br />

water, soap and s<strong>in</strong>gle use paper <strong>to</strong>wels<br />

A sharps conta<strong>in</strong>er labeled “BIOHAZARD” at each booth<br />

Licensed medical waste disposal company for removal of sharps<br />

Frequent trash pick up<br />

Eye wash station<br />

Decontam<strong>in</strong>ation and sterilization area that is separated from public access<br />

Adequate back-up supplies<br />

Pre-sterilized tat<strong>to</strong>o needles<br />

Pre-sterilized needle tubes<br />

Pre-sterilized pierc<strong>in</strong>g <strong>in</strong>struments<br />

Plastic nitrile and latex gloves<br />

S<strong>in</strong>gle-use tubs of water and petroleum-based lubricants<br />

Absorbent dress<strong>in</strong>g materials<br />

Posted emergency room <strong>in</strong>formation that <strong>in</strong>cludes name, address and directions<br />

Each artist must have their certificate of registration displayed or readily available<br />

at their booth upon request by EH<br />
