ance needs to be struck between protecting the general interest <strong>and</strong> protecting<br />

ownership <strong>and</strong> real estate trade. The following measures are suggested:<br />

a) Greater publicity for public restrictions. Each State must make an effort to<br />

create lists of public restrictions pertaining to l<strong>and</strong>. ELRA is working on a<br />

research project in which its members are attempting to identify at least the<br />

major public restrictions <strong>and</strong> limitations in the different Member States.<br />

b) Concentration of all the information concerning public restrictions at a single<br />

point. Citizens should not be burdened with having to check with each<br />

administration about potential restrictions on the property they want to buy.<br />

With the right technology, it is possible to set up concentration points in each<br />

State to coordinate all information about public restrictions set by the different<br />

administrations.<br />

c) A third level of much more technically complex protection would be to integrate<br />

<strong>and</strong> coordinate public limitations within the systems of l<strong>and</strong> registry<br />

publicity. This would enable in the mid-term the interaction of public restrictions<br />

with property rights, thus reinforcing legal certainty inside the registry,<br />

which is where ownership is publicly disclosed by the State. ELRA 2011<br />

The CROBECO project is generating considerable interest in both professional<br />

<strong>and</strong> political circles <strong>and</strong> pilots may be extended to other member organisations. l<br />
