Because of the fact that timely receipt of information from the l<strong>and</strong> registry<br />

by conveyancers <strong>and</strong> of conveyance documents by registrars is essential for crossborder<br />

conveyancing the framework will be based on electronic communication.<br />

The deed will be also an electronic document signed by the conveyancer with<br />

advanced electronic signature.<br />

<strong>European</strong> L<strong>and</strong> Registry Network<br />

ELRA has coordinated action amongst its members for the creation of a cooperation<br />

instrument, “the <strong>European</strong> L<strong>and</strong> Registry Network” (ELRN). The ELRN is<br />

made up of contact points who are l<strong>and</strong> registrars, legal experts on real rights.<br />

The ELRA Network will support the CROBECO project, at two different stages of<br />

the envisaged process:<br />

At the pre contractual stage, the network will explain the LR information.<br />

The widespread introduction of ICTs in registration organisations throughout<br />

the Union enables a significant number of registries to have on-line inquiry services.<br />

The <strong>European</strong> e-Justice portal 45 will create a single point of access to the<br />

LR information through the LINE project in 2013. But to be effective, this information<br />

needs to be understood. Basic reference information is collected by the<br />

Network in simple, easy-to-underst<strong>and</strong> language, explaining the contents <strong>and</strong><br />

the value of registry publicity, the different systems <strong>and</strong> their main procedures.<br />

This information will be posted on the Internet. At the second level, individualized<br />

assistance could be provided.<br />

After the contract is signed <strong>and</strong> sent to the LR, additional requirements must<br />

be fulfilled in the Member State where the plot is located before final registration is<br />

performed, such as the payment of property transfer taxes. The Network will have<br />

to cooperate at this stage, providing advice about the registration procedure <strong>and</strong> facilitating<br />

compliance with collateral procedures involving national administrations.<br />

Public restrictions<br />

Ownership is no longer an absolute power, but a set of powers that can be enjoyed<br />

only in accordance with the general interest. The public interest sets limitations on<br />

the exercise of an owner’s right, in the form of restrictions <strong>and</strong> public rights. A bal-<br />
