<strong>POST</strong> <strong>2011</strong> <strong>EXHIBITION</strong> <strong>CHANGES</strong>:<br />

<strong>Draft</strong> <strong>Shoalhaven</strong> <strong>LEP</strong> 2013<br />

Introduction<br />

Following the initial 13 week exhibition of the draft <strong>Shoalhaven</strong> <strong>LEP</strong> from 18 July to 14 October<br />

<strong>2011</strong> and the detailed consideration of the 3000+ submissions received, Council resolved to make<br />

a number of changes to the draft <strong>LEP</strong>. The majority of these changes were supported by the<br />

Department of Planning and Infrastructure (DP&I) and have been included in the amended draft<br />

<strong>Shoalhaven</strong> <strong>LEP</strong> 2013 that is being exhibited. Those changes that were not supported by the<br />

DP&I are listed in the Section 65 Certificate which also forms part of the exhibition materials.<br />

More information on each of these changes can been found in the relevant Council reports to the<br />

Special Development Committee during 2012.<br />

GENERAL <strong>CHANGES</strong><br />

Change 1 – Change of Aims of the Plan<br />

Council Minute number: MIN12.378<br />

Council Resolution (or part of): that Council adopt a new set of aims that reflect and maintain<br />

the intention of the exhibited ‘Aims of Plan’, as follows:<br />

a) The particular aims of this Plan are as follows:<br />

i. to encourage the proper management, development and conservation of natural and manmade<br />

resources;<br />

ii. the facilitation of the social and economic wellbeing of the community is a substantive<br />

objective;<br />

iii. to ensure that suitable land for beneficial and appropriate uses is made available as required;<br />

iv. to manage appropriate and essential public services, infrastructure and amenities for<br />

<strong>Shoalhaven</strong>;<br />

b) to minimise the risk of harm to the community through the appropriate management of<br />

development and land use.<br />

This means that the exhibited overall aims of the plan contained in Clause 1.2 Aims of Plan have<br />

been replaced with the new aims. The revised Clause 1.2 Aims of Plan is shown below.<br />

1.2 Aims of Plan [compulsory]<br />

(1) This Plan aims to make local environmental planning provisions for land in the<br />

<strong>Shoalhaven</strong> local government area in accordance with the relevant standard environmental<br />

planning instrument under section 33A of the Act.<br />

(2) The particular aims of this Plan are as follows:<br />

a) to encourage the proper management, development and conservation of natural and<br />

man-made resources;<br />

b) the facilitation of the social and economic wellbeing of the community is a substantive<br />

objective;<br />

c) to ensure that suitable land for beneficial and appropriate uses is made available as<br />

required;<br />

d) to manage appropriate and essential public services, infrastructure and amenities for<br />

development and land use.<br />

Note: red text in an <strong>LEP</strong> Clause indicates text that Council has added. The black text forms part of<br />

the mandated Standard Instrument and cannot be changed.<br />

Change 2 – Removal of aquaculture land uses from the Land Use Tables<br />

Council Minute Number: MIN12.385<br />

Council Resolution (or part of): that ‘pond-based aquaculture’ and ‘tank-based aquaculture’ be<br />

removed from the land use tables as the permissibility of these land use terms is already regulated<br />

by SEPP 62.<br />

‘Pond-based aquaculture’ and ‘tank-based aquaculture’ have been removed from the Land Use<br />

Tables in the draft <strong>LEP</strong> as these uses are already permissible under a State Government Policy<br />

(State Environmental Planning Policy (SEPP) 62 Sustainable Aquaculture) which has legal<br />

precedence over the <strong>LEP</strong>.<br />

Change 3 –RU1 Primary Production zone changes<br />

Council Minute Number: MIN12.238 & MIN12.385<br />

Council Resolution (or part of): that objective v. be amended to read as follows:<br />

a) The reference to the conservation and maintenance of productive “prime crop and pasture<br />

land” be made clearer; and<br />

b) Modify the wording of the objective to read as follows: To conserve and maintain the<br />

economic potential of the land for extractive industries.<br />

Council Resolution (or part of):include rural workers dwellings’ in the RU1 zone.<br />

Council Resolution (or part of): that ‘Forestry’ becomes permissible without consent in the RU1<br />

zone.<br />

Council Resolution (or part of): that:<br />

a) ‘Beekeeping’ become permissible without consent in the RU1 zone.<br />

b) The following uses become permissible with consent in the RU1 zone:<br />

• Camping ground<br />

• Eco-tourist facility (and associated clause)<br />

• Plant nursery<br />

c) Council remove ‘mining’ from the RU1 zone.<br />

Council Resolution (or part of): amend the land use table for RUI and RU2 zones to permit<br />

‘helipads’.<br />

Council Resolution (or part of): insert ‘airstrip’ as a permissible use (with consent) in the RU1<br />

and RU2 zones.<br />

These changes have been made to the Land Use Table for the RU1 Primary Production zone.<br />

Some of these changes are the result of submissions from the community and some are due to<br />

changes made to the Standard Instrument which introduced some new definitions.<br />

Change 4 –RU2 Rural Landscape zone changes<br />

Council Minute Number: MIN12.238, MIN12.385 & MIN12.609<br />

Council Resolution (or part of): add ‘eco-tourist facilities’ and ‘camping grounds’ as permissible<br />

with consent in the RU2 zone.<br />

Council Resolution (or part of):<br />

a) That ‘beekeeping’ and ‘forestry’ become permissible without consent in the RU2 zone;<br />

b) That ‘plant nurseries’ become permissible with consent in the RU2 zone.<br />

Council Resolution (or part of): amend the land use table for RUI and RU2 zones to permit<br />

‘helipads’.<br />

Council Resolution (or part of): insert ‘airstrip’ as a permissible use (with consent) in the RU1<br />

and RU2 zones.<br />

These changes have been made to the Land Use Table for the RU2 Rural Landscape zone.<br />

Some of these changes are the result of submissions from the community and some are due to<br />

Council Resolution (or part of): that the following land uses become permissible with consent in<br />

the RU5 zone:<br />

Garden centre<br />

Landscaping material supplies<br />

Plant nursery<br />

Hardware and building supplies (‘timber and building supplies’ definition has been removed)<br />

These changes have been made to the Land Use Table for the RU5 Rural Village zone. Some of<br />

these changes are the result of submissions from the community and some are due to changes<br />

made to the Standard Instrument which introduced some new definitions.<br />

Change 6 –RE1 Public Recreation zone changes<br />

Council Minute Number: MIN12.385<br />

Council Resolution (or part of): that the following land uses become permissible with consent in<br />

the RE1 zone:<br />

• Camping grounds<br />

• Eco-tourist facility (and associated clause)<br />

These changes have been made to the Land Use Table for the RE1 Public Recreation zone.<br />

These changes are due to changes made to the Standard Instrument which introduced some new<br />

definitions.<br />

Change 7 –RE2 Private Recreation zone changes<br />

Council Minute Number: MIN12.385<br />

Council Resolution (or part of): that the following land uses become permissible with consent in<br />

the RE2 zone:<br />

• Camping grounds<br />

• Eco-tourist facility (and associated clause)<br />

These all have been changes made to the Land Use Table for the RE2 Private Recreation zone.<br />

These changes are due to changes made to the Standard Instrument which introduced some new<br />

definitions.<br />

Change 8 –SP3 Tourist zone changes<br />

Council Minute Number: MIN12.385<br />

Council Resolution (or part of): that<br />

a) ‘Boat repair facilities’ be prohibited in the SP3 zone.<br />

b) ‘Recreation areas’ be permissible with consent in the SP3 zone.<br />

c) An additional objective is included in the SP3 zone as follows: To provide for dwelling<br />

houses that form an integral part of a tourist-oriented development.<br />

The additional objective makes it clear that while dwelling houses are permitted in the SP3 Tourist<br />

zone, they should be an integral part of a tourist-oriented development, not a stand alone use.<br />

Council will need to have regard to this objective when determining development applications in<br />

this zone. ‘Boat repair facilities’ have become a prohibited use and ‘recreation areas’ have become<br />

a permissible use in the SP3 Tourist zone.<br />

Change 9 –R1 General Residential zone changes<br />

Council Minute Number: MIN12.377 & MIN12.385<br />

Council Resolution (or part of): that the following land uses become prohibited in the R1 zone:<br />

• Boat repair facilities<br />

Council Resolution (or part of): include “office premises” as a permissible use with consent to<br />

the R1 Residential zone Citywide.<br />

This change means that ‘boat repair facilities’ are not permitted in the R1 General Residential zone<br />

and that ‘office premises’ have been included as a land use that is permissible with consent in the<br />

zone.<br />

Change 10 – R3 Medium Density Residential zone changes<br />

Council Minute Number: MIN12.385<br />

Council Resolution (or part of): that the previously exhibited 5th objective in R3 zone, be<br />

replaced with the following:<br />

To provide for single dwelling houses as an ancillary, integral part of a medium density<br />

development that help maintain and enhance the residential amenity of the street.<br />

Council Resolution (or part of): that the following land use become permitted with consent in the<br />

R3 zone:<br />

• Backpackers accommodation.<br />

The change to the objective makes it clear that while dwelling houses are permitted in the R3<br />

Medium Density Residential zone, they should be an integral part of a medium density<br />

development, not a stand alone use. Council will need to have regard to this objective when<br />

determining development applications in this zone. ‘Backpackers accommodation’ has also<br />

become a permissible use in the R3 Medium Density Residential zone.<br />

Change 11 –R5 Large Lot Residential zone changes<br />

Council Minute Number: MIN12.392 & MIN12.819<br />

Council Resolution (or part of): that as Council wishes to protect and preserve the nature of<br />

rural living and that the objectives of the zones R5, RU4 and E4 be strengthened to reflect this<br />

desire. It was also resolved that:<br />

a) Council retain the R5 zone as exhibited subject to the LUT being amended to permit Extensive<br />

Agriculture and Horticulture and acknowledge that there is appropriate uses for the RU4, R5<br />

and E4 zones.<br />

b) That the R2 Low Density Residential zone be applied to land currently zoned 2(a2) and 2(a3)<br />

under S<strong>LEP</strong> 1985 and lot size maps be amended to show minimum lot sizes of 2,000m2<br />

applying to 2(a2) land and 4,000m2 applying to 2(a3) land.<br />

c) That the Rural 1(c) zoned land at Kangaroo Valley be zoned R5 Large Lot Residential as shown<br />

on Map 1 in Attachment ‘A’.<br />

d) That the Rural 1(c) zoned land at Bundewallah be zoned part R5 Large Lot Residential and part<br />

E4 Environmental Living as shown on Map 2 in Attachment ‘A’.<br />

e) That the Rural 1(c) zoned land at Berry be zoned part RU4 Primary Production Small Lots zone<br />

and part R5 Large Lot Residential as shown on Map 3 in Attachment ‘A’.<br />

f) That the Rural 1(c) zoned land at Tapitallee be zoned part RU4 Primary Production Small Lots<br />

and part E4 Environmental Living as shown on Map 4 in Attachment ‘A’.<br />

g) That the Rural 1(c) zoned land at Bomaderry be zoned R5 Large lot Residential as shown on<br />

Map 5 in Attachment ‘A’.<br />

h) That the Rural 1(c) zoned land at Worrigee be zoned R5 Large Lot Residential as shown on<br />

Map 6 in Attachment ‘A’.<br />

i) That the Rural 1(c) zoned land at South Nowra be zoned IN1 General Industrial as shown on<br />

These changes mean that:<br />

‘extensive agriculture’ and ‘horticulture’ become permissible uses in the R5 zone;<br />

Any land that is currently zoned Residential 2(a2) under S<strong>LEP</strong> 1985 will be changed from<br />

the exhibited R5 Large Lot Residential to R2 Low Density Residential with a 2000m 2<br />

minimum lot size.<br />

Any land that is currently zoned Residential 2(a3) under S<strong>LEP</strong> 1985 will be changed from<br />

the exhibited R5 Large Lot Residential to R2 Low Density Residential a 4000m 2 minimum<br />

lot size.<br />

As a result of submissions, a further review of the zoning of the existing Rural 1(c) zoned<br />

areas was undertaken by an external consultant and changes to the proposed R5 zoned<br />

areas resulted. This may mean that the proposed zone and/or permitted and prohibited<br />

uses for these areas have changed. These changes are reflected in the table below.<br />

Council Resolution (or part of): the word ‘vehicle’ be removed from the B2 Local Centre zone<br />

and replaced with ‘vehicle repair station’ and ‘vehicle sale or hire premises’.<br />

These changes mean that ‘exhibition homes’ and ‘highway service centres’ are not permissible in<br />

the B2 Local Centre zone. The resolution also fixed an error by replacing ‘vehicle’ in the land use<br />

table with ‘vehicle repair station’ and ‘vehicle sale or hire premises’.<br />

Change 13 –B3 Commercial Core zone changes<br />

Council Minute Number: MIN12.385<br />

Council Resolution (or part of): That objective iv. To allow opportunities for shop top housing be<br />

removed from the B3 zone.<br />

Note: while the objective relating to ‘shop top housing’ has been removed, ‘shop top housing’<br />

remains a permissible use in the B3 Commercial Core zone.<br />

Change 14 –B4 Mixed Use zone changes<br />

Council Minute Number: MIN12.385<br />

Council Resolution (or part of): That Objective iii. To ensure that retail uses do not compete<br />

with the local centre be removed from the B4 zone.<br />

Council Resolution (or part of): That the following land use becomes prohibited in the B4 zone:<br />

• Crematorium<br />

Council Resolution (or part of):<br />

a) The following additional uses be listed as permitted with consent in the B3 zone:<br />

• Tourist and visitor accommodation; and<br />

• Shop top housing.<br />

b) The following additional uses be listed as prohibited in the B3 zone:<br />

• Bed and breakfast accommodation;<br />

• Crematorium;<br />

• Farm stay accommodation;<br />

• Group homes;<br />

• Home industries; and<br />

• Residential care facilities.<br />

The removal of the objective means that there is no longer a requirement to consider whether<br />

development proposed in the B4 Mixed Use Zone competes with the local centre. The changes to<br />

the land use terms mean that the permitted and prohibited land uses have changed in the B4 Mix<br />

Use zone.<br />

Change 15 –B5 Business Development zone changes<br />

Council Minute Number: MIN12.385<br />

Council Resolution (or part of):<br />

a) Remove objective ii. To ensure that retail uses do not compete with the local centre from the<br />

B5 zone.<br />

b) Amend objective iii. to read To allow diversity of activities to the extent that new activities<br />

will not significantly detract from the operation of existing or proposed development.<br />

Council Resolution (or part of): That the following land uses become permitted in the B5 zone:<br />

Boat repair facilities<br />

The removal of objective ii. means that there is no longer a requirement to consider whether<br />

development proposed in the B5 Business Development zone competes with the commercial core.<br />

The amended objective ii. has been simplified with removal of additional considerations. Council<br />

will need to have regard to this objective when determining development applications in this zone.<br />

‘Boat repair facilities’ have also become permissible in the B5 Business Development zone.<br />

Change 16 –B7 Business Park zone changes<br />

The additional objectives make it clear that a diversity of industrial uses is allowable in the IN1<br />

development and to make it clear that non industrial land uses that meet the day to day needs of<br />

people who work in the area are also appropriate. Council will need to have regard to this<br />

objective when determining development applications in this zone.<br />

Certain uses have also become permissible and others have become prohibited as per the<br />

Council Resolution (or part of): That the 3rd objective in the E2 zone be reworded to read as<br />

follows: “To protect water quality and the ecological integrity of water supply catchments and other<br />

catchments and natural waterways”.<br />

This change widens the scope of the objective in the E2 Environmental Conservation zone to<br />

encompass all catchments and natural waterways other than just water supply catchments.<br />

Council will need to have regard to this objective when determining development applications in<br />

this zone.<br />

Change 21 –W2 Recreational Waterways zone change<br />

Council Resolution (or part of): remove ‘Research Stations’ from the land use table for the W2<br />

Recreational Waterways zone, noting that ‘Research Stations’ are still permissible in the W2 zone<br />

under SEPP Infrastructure.<br />

This change recognises that ‘research stations’ are permissible under the higher order SEPP<br />

Infrastructure. Therefore it is not necessary to separately list ‘research stations’ as a permissible<br />

use in the W2 Recreational Waterway zone.<br />

Change 22 – W3 Working Waterways zone change<br />

Council Resolution (or part of): remove ‘Research Stations’ from the land use table for the W3<br />

Working Waterways zone, noting that ‘Research Stations’ are permissible in the W3 zone under<br />

Change 23 – W2 Recreational Waterway excluded from Clause 5.3<br />

Council Resolution (or part of): add W2 as a zone to which Clause 5.3(3) does not apply.<br />

Clause 5.3 Development near zone boundaries allows for some flexibility in considering<br />

development near zone boundaries. It allows Council to consent to development for a prohibited<br />

use in a zone provided that the development is within 20m of an adjoining zone that permits the<br />

use. There are some exclusions to this clause e.g. certain zones, areas or types of development.<br />

This change adds the W2 zone to the exclusions meaning that Clause 5.3 cannot be used this<br />

zone.<br />

Change 24 – Exclusion of dwellings from the existing 7(d2) zone<br />

Council Resolution (or part of): prohibit ‘dwelling houses’ on the existing 7(d2) zoned land via<br />

either an additional local clause or the minimum lot size overlay map.<br />

‘Dwellings houses’ are currently prohibited in the Environment Protection 7(d2) zone under<br />

<strong>Shoalhaven</strong> <strong>LEP</strong> 1985. There are currently 8 environmental protection zones under <strong>Shoalhaven</strong><br />

<strong>LEP</strong> 1985 which have had to be amalgamated into two environmental protection zones under the<br />

draft <strong>Shoalhaven</strong> <strong>LEP</strong> 2013. The majority of the existing environmental protection zones currently<br />

allow ‘dwelling houses’ in certain circumstances so both the E2 Environmental Conservation and<br />

E3 Environmental Management zones allow ‘dwelling houses’. This meant that dwellings<br />

inadvertently became a permissible use in the 7(d2) zoned areas. This change aims to rectify this<br />

and to maintain the status quo. The Lot Size Map has been used to ensure that dwellings would<br />

not be permitted on the existing 7(d2) land. This is done by making the lot size shown on the Lot<br />

Size Map larger that the physical size of the property meaning that the property would not meet the<br />

criteria under Clause 4.2D Erection of dwelling houses on land in certain zones and a dwelling<br />

would therefore not be permitted.<br />

Change 25 – Zoning of telecommunication facilities<br />

1. Change the zoning of part of Lot 2 DP 849185 Cambewarra Mountain (approx 200sqm in area)<br />

to SP2 Infrastructure-Telecommunications to cover the area where the new telecommunication<br />

tower and associated infrastructure are located.<br />

2. Change the zoning of the Leebold Hill Telecommunications facility at Lot 7308 DP 1165278<br />

(formerly Lot 2 DP 865146) from E2 Environment Conservation to SP2 Infrastructure<br />

Telecommunication to reflect the ongoing use of the site.<br />

This means the area of the lots in which the existing telecommunication facilities are located have<br />

changed to SP2 Infrastructure.<br />

Council Resolution (or part of): retain the status quo and include lot averaging provisions in draft<br />

S<strong>LEP</strong> 2009 based on existing provisions in <strong>Shoalhaven</strong> <strong>LEP</strong> 1985.<br />

This means that the lot averaging provisions from the current <strong>LEP</strong> are now included in the draft<br />

<strong>LEP</strong>. They were not in the original exhibited version as the DP&I did not initially support this<br />

approach at that stage, however, the DP&I are now supportive of their inclusion. The relevant<br />

additional clause is below. Refer to the associated Lot Size Map for the specific areas to which<br />

this clause applies.<br />

4.2B Subdivision of certain land zoned RU4, R5 or E4<br />

(1) This clause applies to land within zones RU4, R5 and E4.<br />

(2) Despite clause 4.1, land identified on the Local Clauses Map as ‘Prime Crop and Pasture; may<br />

only be subdivided if the consent authority is satisfied that each newly created lot contains at<br />

least 10 hectares of ‘Prime Crop and Pasture Land’.<br />

(3) Despite clause 4.1, the following restrictions apply to certain land within zones RU4, R5 or E4:<br />

(a) land identified on the Lot Size Map as ‘Area 1’ in the vicinity of Bundewallah Road, Berry<br />

may be subdivided to a minimum lot size of 1 hectare to a maximum of 4 lots per 10<br />

hectares;<br />

(b) land identified on the Lot Size Map as ‘Area 2’ in the vicinity of Little Forest Road, Little<br />

Forest may be subdivided to a minimum lot size of 1 hectare to a maximum of 1 lot per 10<br />

(c) land identified on the Lot Size Map as ‘Area ’ in the vicinity of Wandean Road, Wandandian<br />

into lots having an overall maximum density of one lot per 10 hectares provided that the<br />

vehicular access to any lot is via a road other than the Princes Highway; and<br />

(g) land in identified on the Lot Size Map as ‘Area 7’ the vicinity of Conjola Park may be<br />

subdivided into a maximum of fourteen lots with a minimum lot size of 1 hectare provided<br />

that dwellings are constructed at least 100m from any land zoned as E2 Environmental<br />

Conservation.<br />

(h) land identified on the Lot Size Map as ‘Area 8’ at Windward Way, Milton being Lot 1 DP<br />

780801 may be subdivided into a maximum of 3 lots with a minimum lot size of 2 hectares.<br />

(4) For the purposes of this clause ‘Prime Crop and Pasture Land’ is defined as land identified as<br />

Class 1, 2 or 3 on the NSW Department of Primary Industries’ agricultural land classification<br />

maps.<br />

Change 31 – Changes to Clauses 5.1 & 5.1A relating to land acquisition<br />

Council Resolution (or part of): That the tables in Clauses 5.1 and 5.1A be amended to include<br />

local roads with Council as the acquisition authority.<br />

This change to Clause 5.1 Relevant acquisition authority and Clause 5.1A Development on land<br />

Change 33 – Inclusion of paper subdivisions - Clause 5.9 Preservation of trees and<br />

vegetation<br />

Council Minute Number: MIN12.379<br />

Council Resolution (or part of): request the support of DP&I for the inclusion of a local provision<br />

in S<strong>LEP</strong> 2009 to ensure that clause 5.9 applies to the paper subdivisions.<br />

This means that Clause 5.9 Preservation of trees and vegetation applies to any existing paper<br />

subdivision. Generally, approval from Council will be required to ringbark, cut down, top, lop,<br />

remove, injure or wilfully destroy any tree or vegetation to which the associated DCP applies in any<br />

of the paper subdivisions e.g. the Heritage, Jerberra, Nebraska and Verons Estates, and the<br />

Woollamia Falls Creek deferred areas. This has been done by adding a subclause to Clause 5.9<br />

Preservation of trees and vegetation and mapping the areas to which it applies on the Local<br />

Clauses Map.<br />

Change 34 – Inclusion of Clause 7.19 Erection of Rural worker’s dwellings<br />

Council Resolution (or part of): include rural workers dwellings’ in the RU1 zone with an<br />

additional local Clause:<br />

Council resolved to include a specific clause for ‘rural worker’s dwelling. The DP&I replaced the<br />

proposed clause with the most recent ‘settled model clause’. This clause will apply to any<br />

proposed ‘rural worker’s dwelling’. The wording of this clause is set out below.<br />

7.19 Erection of Rural worker’s dwellings<br />

(1) The objective of this clause is to ensure the provision of adequate accommodation for<br />

employees of existing agricultural or rural industries.<br />

(2) This clause applies to land in the RU1 Primary Production Zone.<br />

(3) Development consent must not be granted for the erection of a rural worker’s dwelling on<br />

land to which this clause applies unless the consent authority is satisfied that:<br />

All the URAs in the draft S<strong>LEP</strong> were zoned R1 General Residential and given a 500m 2 minimum<br />

Council Resolution (or part of): In relation to the Report on Scoping Study and Stability<br />

Assessment for Surfers Ave, Tallwood Ave & Bannister Head Rd Narrawallee adopt the following<br />

policy position:<br />

The properties identified at risk be included on the relevant overlay mapping in <strong>Draft</strong> S<strong>LEP</strong> 2009,<br />

thus applying clauses 7.9 (Land) & 7.11 (Coastal Hazard Planning) to those properties. These<br />

changes are to be included in any re-exhibition of the draft S<strong>LEP</strong> 2009.<br />

As can be seen from the maps below, coastal hazard mapping has been applied to a number of<br />

additional properties at Narrawallee due to additional work undertaken to identify properties at risk<br />

from coastal hazards.<br />

Mollymook Beach, that contains an existing car park to SP2 Infrastructure (Car park).<br />

The zoning part of this parcel has been changed from RE1 Public Recreation to SP2 Infrastructure<br />

to enable Council to legalise the existing car park . This means that the permitted and prohibited<br />

This change is a minor realignment of the boundary between the E2 Environmental Conservation<br />

zone and the R1 General Residential zone so that all of Lot 11 DP 1149684 Settlers Way,<br />

Mollymook is zoned E2 Environmental Conservation. This change can be seen on the maps<br />

Council Resolution (or part of): That in regard to Lot 1 DP 1137716 188 Camden St, Ulladulla,<br />

Council support the request to zone the site RE1 Public Recreation & E2 Environmental<br />

Conservation given the commitment Council has given the proponent to enable them to use this<br />

site.<br />

This is the site of the proposed Ulladulla Future Park which is intended to include some form of<br />

aquaculture. The site was exhibited with an IN2 Light Industrial zone, however, SEPP 62<br />

Sustainable Aquaculture does not allow all forms of aquaculture in this zone. To overcome this<br />

problem, the zone was proposed to be changed to RE1 Public Recreation with the E2<br />

Environmental Conservation zoned area remaining the same. However, the DP&I has advised<br />

that Council should retain the IN2 Light Industrial zone over the site and add a Schedule 1<br />

Additional permitted uses clause to enable the use of the site for all forms of aquaculture. As a<br />

result, the zone change resolved above was not required and the site has retained its originally<br />

exhibited zone. Schedule 1.14 now applies to this site and allows ‘development for the purpose of<br />

aquaculture’ The zone of this site can be seen on the map below.<br />

minimum lot size of 4000m 2 .<br />

This means that a small area of Lot 4 has changed from RU2 Rural Landscape to R5 Large Lot<br />

Residential. This is consistent with the current zoning under S<strong>LEP</strong> 1985. The lot size also<br />

changes from 40ha to 4000m 2 . The zone change can be seen on the map below.<br />
