MEMORANDUM OF OBJECTS AND REASONS<br />

-----<br />

The object of this <str<strong>on</strong>g>bill</str<strong>on</strong>g> is to ensure that the due administrati<strong>on</strong> of justice in criminal and related proceedings is not<br />

prejudiced by <str<strong>on</strong>g>witness</str<strong>on</strong>g>es not being prepared to give evidence without <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> from violent or other criminal<br />

recriminati<strong>on</strong>.<br />

ATTORNEY-GENERAL<br />

An Act to provide for the safety and well-being of <str<strong>on</strong>g>witness</str<strong>on</strong>g>es in criminal proceedings who, unless protected, may not give<br />

evidence for fear of death, violence or serious injury by criminal interests likely to be affected by the proceedings, and for<br />

related purposes.<br />

ENACTED by the President and Parliament of [name of State]<br />

1. Short title, Extent and Commencement<br />

PART I<br />

PRELIMINARY<br />

(1) This Act may be called the "Witness Protecti<strong>on</strong> Act, <str<strong>on</strong>g>2000</str<strong>on</strong>g>."<br />

(2) It shall extend throughout [name of State].<br />

(3) It shall come into force at <strong>on</strong>ce.<br />

2. Definiti<strong>on</strong>s<br />

(a)<br />

“foreign State” means:<br />

(i) any country other than [name of State]; and

(ii)<br />

every c<strong>on</strong>stituent part of such country, including a territory, dependency or protectorate, which<br />

administers its own laws relating to internati<strong>on</strong>al cooperati<strong>on</strong>;<br />

(b)<br />

"serious offence" means an offence against a provisi<strong>on</strong> of:<br />

(i)<br />

(ii)<br />

any law in [name of State], for which the maximum penalty is death, or impris<strong>on</strong>ment or other<br />

deprivati<strong>on</strong> of liberty for a period of not less than [12 m<strong>on</strong>ths];<br />

a law of a foreign State, in relati<strong>on</strong> to acts or omissi<strong>on</strong>s, which had they occurred in [name of<br />

State], would have c<strong>on</strong>stituted an offence for which the maximum penalty is death, or<br />

impris<strong>on</strong>ment or other deprivati<strong>on</strong> of liberty for a period of not less than [12 m<strong>on</strong>ths];<br />

(c)<br />

"<str<strong>on</strong>g>witness</str<strong>on</strong>g>” means a pers<strong>on</strong> who;<br />

(i)<br />

(ii)<br />

(iii)<br />

has made a statement, or who has given or agreed to give evidence in relati<strong>on</strong> to the commissi<strong>on</strong><br />

or possible commissi<strong>on</strong> of a serious offence;<br />

because of his or her relati<strong>on</strong>ship to or associati<strong>on</strong> with a pers<strong>on</strong> referred to in subsecti<strong>on</strong> (i),<br />

may require <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> or other assistance under this Act; or<br />

for any other reas<strong>on</strong>, may require <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> or other assistance under this Act;<br />

(d)<br />

(e)<br />

“proceedings” means any procedure c<strong>on</strong>ducted by or under the supervisi<strong>on</strong> of a judge or judicial officer<br />

however described in relati<strong>on</strong> to any alleged or proven offence, or property derived from such offence,<br />

and includes an inquiry, investigati<strong>on</strong>, or preliminary or final determinati<strong>on</strong> of facts; and<br />

"property derived from an offence" means any property derived or realised directly or indirectly from a<br />

serious offence and includes, <strong>on</strong> a proporti<strong>on</strong>al basis, property into which any property derived or<br />

realised directly from the offence was later successively c<strong>on</strong>verted, transformed or intermingled, as well as<br />

income, capital or other ec<strong>on</strong>omic gains derived or realized from such property at any time since the<br />

offence.<br />

PART II<br />

WITNESS PROTECTION<br />

3. Witness <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme<br />

(1) The [Commissi<strong>on</strong>er of Police] shall, through the establishment and maintenance of a <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g><br />

programme, take such acti<strong>on</strong> as he or she thinks necessary and reas<strong>on</strong>able to protect the safety and welfare of a<br />

<str<strong>on</strong>g>witness</str<strong>on</strong>g> in any proceedings relating to this Act.<br />

(2) Subject to subsecti<strong>on</strong> (3), that acti<strong>on</strong> may include the following;<br />

(a)<br />

making arrangements necessary:<br />

(i)<br />

(ii)<br />

to allow the <str<strong>on</strong>g>witness</str<strong>on</strong>g> to establish a new identity; or<br />

otherwise to protect the <str<strong>on</strong>g>witness</str<strong>on</strong>g>;<br />

(b)<br />

(c)<br />

relocating the <str<strong>on</strong>g>witness</str<strong>on</strong>g>;<br />

providing accommodati<strong>on</strong> for the <str<strong>on</strong>g>witness</str<strong>on</strong>g>;

providing transport for the property of the <str<strong>on</strong>g>witness</str<strong>on</strong>g>;<br />

providing reas<strong>on</strong>able financial assistance to the <str<strong>on</strong>g>witness</str<strong>on</strong>g>;<br />

permitting any pers<strong>on</strong> involved in the administrati<strong>on</strong> of the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme to use an<br />

assumed name in carrying out his or her duties and to have documentati<strong>on</strong> supporting those assumed<br />

names;<br />

doing any other thing that the [Commissi<strong>on</strong>er of Police] c<strong>on</strong>siders necessary to ensure the safety of the<br />

<str<strong>on</strong>g>witness</str<strong>on</strong>g>;<br />

taking any of the steps listed in subsecti<strong>on</strong>s (a) to (g), in respect of a foreign <str<strong>on</strong>g>witness</str<strong>on</strong>g> present in [name of<br />

State] pursuant to an agreement or arrangement between [name of State] and a foreign State relating to<br />

<str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g>.<br />

(3) The [Commissi<strong>on</strong>er of Police] shall not obtain documentati<strong>on</strong> for a <str<strong>on</strong>g>witness</str<strong>on</strong>g> participating in the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g><br />

programme that represents that the participant has a qualificati<strong>on</strong> that he or she does not have, or is entitled to a<br />

benefit that he or she is not entitled to;<br />

4. Inclusi<strong>on</strong> of a <str<strong>on</strong>g>witness</str<strong>on</strong>g> in the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme<br />

(1) Subject to any directi<strong>on</strong> of the Minister pursuant to subsecti<strong>on</strong> 12 (3), the [Commissi<strong>on</strong>er of Police] shall be<br />

resp<strong>on</strong>sible for deciding whether to include a <str<strong>on</strong>g>witness</str<strong>on</strong>g> in a <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme.<br />

(2) In deciding whether to include a <str<strong>on</strong>g>witness</str<strong>on</strong>g> in the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme, the [Commissi<strong>on</strong>er of Police] shall<br />

have regard to:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

(e)<br />

(f)<br />

(g)<br />

the seriousness of the offence to which the statement or evidence of the <str<strong>on</strong>g>witness</str<strong>on</strong>g> relates;<br />

the nature and importance of that statement or evidence;<br />

the nature of the perceived danger to the <str<strong>on</strong>g>witness</str<strong>on</strong>g>;<br />

the nature of the <str<strong>on</strong>g>witness</str<strong>on</strong>g>’s relati<strong>on</strong>ship to any other <str<strong>on</strong>g>witness</str<strong>on</strong>g> being assessed for inclusi<strong>on</strong> in the<br />

programme;<br />

the results of any psychological or psychiatric examinati<strong>on</strong> or evaluati<strong>on</strong> of the <str<strong>on</strong>g>witness</str<strong>on</strong>g> c<strong>on</strong>ducted to<br />

determine his or her suitability for inclusi<strong>on</strong> in the programme;<br />

whether there are viable alternative methods of protecting the <str<strong>on</strong>g>witness</str<strong>on</strong>g>; and<br />

whether the <str<strong>on</strong>g>witness</str<strong>on</strong>g> has a criminal record, particularly in respect of violent crime, which indicates a risk to<br />

the public if he or she is included in the programme.<br />

(3) A <str<strong>on</strong>g>witness</str<strong>on</strong>g> shall not be included in a <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme unless the <str<strong>on</strong>g>witness</str<strong>on</strong>g>, or a pers<strong>on</strong> legally<br />

resp<strong>on</strong>sible for the pers<strong>on</strong>, agrees in writing to be included in the programme.<br />

5. Court orders protecting <str<strong>on</strong>g>witness</str<strong>on</strong>g>es from identificati<strong>on</strong><br />

(1) For the purposes of this Act, the [Commissi<strong>on</strong>er of Police] may apply to the [Court] for an order authorizing a<br />

specified pers<strong>on</strong> or a pers<strong>on</strong> of a specified class or descripti<strong>on</strong> of pers<strong>on</strong>s:

to make a new entry in the [register of births], [register of deaths] or [register of marriages] in respect<br />

of a <str<strong>on</strong>g>witness</str<strong>on</strong>g>;<br />

to issue in the <str<strong>on</strong>g>witness</str<strong>on</strong>g>’s new identity a document of a kind previously issued to the <str<strong>on</strong>g>witness</str<strong>on</strong>g>.<br />

(2) The [Court] may make a <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> order if it is satisfied that the life or safety of that pers<strong>on</strong> may be<br />

endangered by virtue of the pers<strong>on</strong> being a <str<strong>on</strong>g>witness</str<strong>on</strong>g>.<br />

(3) Any proceedings of the [Court] under this secti<strong>on</strong> shall be c<strong>on</strong>ducted in camera, and all records of the<br />

proceedings shall be sealed.<br />

(4) On the making of a <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> order under subsecti<strong>on</strong> (2), any pers<strong>on</strong> authorized to do so by the order may<br />

make such entries in the [register of births], [register of deaths] or [register of marriages] as are necessary to<br />

give effect to the order.<br />

(5) An entry made in the [register of births], [register of deaths] or [register of marriages] pursuant to a <str<strong>on</strong>g>witness</str<strong>on</strong>g><br />

<str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> order under subsecti<strong>on</strong> (2) has effect as if it were a valid entry made under the [Births, Deaths and<br />

Marriages Act].<br />

6. Terminati<strong>on</strong> of <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> and assistance<br />

(1) Protecti<strong>on</strong> and assistance provided under the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme:<br />

(a)<br />

(b)<br />

shall be terminated by [Commissi<strong>on</strong>er of Police] if the participant requests in writing that it be<br />

terminated; and<br />

may be terminated in writing by [Commissi<strong>on</strong>er of Police] if:<br />

(i)<br />

(ii)<br />

(iii)<br />

the <str<strong>on</strong>g>witness</str<strong>on</strong>g> deliberately breaches a requirement or undertaking relating to the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g><br />

programme;<br />

the <str<strong>on</strong>g>witness</str<strong>on</strong>g>’s c<strong>on</strong>duct or threatened c<strong>on</strong>duct is, in the opini<strong>on</strong> of the [Commissi<strong>on</strong>er of Police],<br />

likely to threaten the security or compromise the integrity of the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme;<br />

or<br />

the circumstances that gave rise to the need for <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> and assistance for the <str<strong>on</strong>g>witness</str<strong>on</strong>g> have<br />

ceased to exist,<br />

and the [Commissi<strong>on</strong>er of Police] is of the opini<strong>on</strong> that, in all the circumstances of the case, the<br />

<str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> and assistance should be terminated.<br />

(2) A decisi<strong>on</strong> of the [Commissi<strong>on</strong>er of Police] to terminate <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> and assistance under the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g><br />

programme takes effect:<br />

(a)<br />

(b)<br />

when the [Commissi<strong>on</strong>er of Police] notifies the <str<strong>on</strong>g>witness</str<strong>on</strong>g> of the decisi<strong>on</strong>;<br />

if the <str<strong>on</strong>g>witness</str<strong>on</strong>g>’s locati<strong>on</strong> is not known and the [Commissi<strong>on</strong>er of Police] has taken reas<strong>on</strong>able but<br />

unsuccessful steps to notify the <str<strong>on</strong>g>witness</str<strong>on</strong>g>, at the end of a period of [28] days after those steps were taken.<br />

7. N<strong>on</strong>-disclosure of former identity of a <str<strong>on</strong>g>witness</str<strong>on</strong>g><br />

A pers<strong>on</strong> whose <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> has not been terminated under secti<strong>on</strong> 6 shall not disclose his or her former identity for

any purpose, and it shall be lawful for that pers<strong>on</strong>, in any proceedings or for any purpose in [name of State], to<br />

claim that his or her new identity is his or her <strong>on</strong>ly identity.<br />

8. Restorati<strong>on</strong> of former identity<br />

The [Commissi<strong>on</strong>er of Police] may, if he or she c<strong>on</strong>siders it appropriate to do so, take such acti<strong>on</strong> as is necessary<br />

to restore the former identity of a pers<strong>on</strong> whose <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> and assistance under a <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme<br />

has been terminated.<br />

9. Certain pers<strong>on</strong>s not required to disclose informati<strong>on</strong><br />

Unless the [name of Court] makes an order in the interests of justice that provides to the c<strong>on</strong>trary, or the<br />

proceedings relate to an offence against this Act, a pers<strong>on</strong> who acquires informati<strong>on</strong> in the ordinary course of<br />

official duties relating to the administrati<strong>on</strong> of the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme cannot be required in any<br />

proceedings in any [court, tribunal or commissi<strong>on</strong> of inquiry however described] to:<br />

(a)<br />

(b)<br />

produce any document; or<br />

divulge or communicate any matter or thing,<br />

relating to the performance of his or her duties in c<strong>on</strong>nexi<strong>on</strong> with the programme.<br />

10. Provisi<strong>on</strong> of informati<strong>on</strong> to competent authorities<br />

If:<br />

(a)<br />

(b)<br />

a pers<strong>on</strong> has been provided with a new identity or relocated under this Act; and<br />

the [Commissi<strong>on</strong>er of Police] is notified by a competent authority that the pers<strong>on</strong> is under investigati<strong>on</strong><br />

for, or has been arrested for or is charged with a serious offence,<br />

the [Commissi<strong>on</strong>er of Police] may:<br />

(i)<br />

(ii)<br />

(iii)<br />

(iv)<br />

release to that authority the new identity or locati<strong>on</strong> of the pers<strong>on</strong>;<br />

provide that authority with the criminal record and fingerprints of the pers<strong>on</strong>;<br />

release to that authority such other informati<strong>on</strong> as [the Commissi<strong>on</strong>er of Police] c<strong>on</strong>siders<br />

appropriate in the circumstances; and<br />

otherwise cooperate with that authority.<br />

11. Offences relating to <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g><br />

(1) No pers<strong>on</strong> shall, except in accordance with this Act, disclose informati<strong>on</strong>:<br />

(a)<br />

(b)<br />

about the identity of a pers<strong>on</strong> who is or has been a <str<strong>on</strong>g>witness</str<strong>on</strong>g> included in the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g><br />

programme; or<br />

that compromises the security of such a pers<strong>on</strong>.


Penalty: [...] penalty units, or impris<strong>on</strong>ment for a period not exceeding [10] years, or both.<br />

(2) Subject to subsecti<strong>on</strong> (3), no pers<strong>on</strong> who has participated in the <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme shall, either directly<br />

or indirectly, disclose or communicate to another pers<strong>on</strong>:<br />

(a)<br />

(b)<br />

informati<strong>on</strong> relating to anything d<strong>on</strong>e by the [Commissi<strong>on</strong>er of Police] or any police officer<br />

under this Act; or<br />

informati<strong>on</strong> about any police officer gained by the pers<strong>on</strong> as a result of anything d<strong>on</strong>e under this<br />

Act.<br />

Penalty: [...] penalty units, or impris<strong>on</strong>ment for a period not exceeding [5] years, or both.<br />

(3) Subsecti<strong>on</strong> (2) does not apply to any disclosure or communicati<strong>on</strong>:<br />

(a)<br />

(b)<br />

that has been authorised by the [Commissi<strong>on</strong>er of Police]; or<br />

that is necessary to comply with an order of the [name of Court].<br />

(4) A pers<strong>on</strong> in respect of whom an entry is made under this Act in a [register of births], [register of deaths] or<br />

[register of marriages] shall not, while the entry remains in force, use or obtain any document that is based <strong>on</strong> the<br />

previous entry.<br />

Penalty: [....] penalty units<br />

(5) A <str<strong>on</strong>g>witness</str<strong>on</strong>g> who has been provided with a new identity under a <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme shall not marry using<br />

the new identity unless;<br />

(a)<br />

(b)<br />

(c)<br />

the <str<strong>on</strong>g>witness</str<strong>on</strong>g> is of marriageable age;<br />

if the <str<strong>on</strong>g>witness</str<strong>on</strong>g> has been married previously to another pers<strong>on</strong>, the <str<strong>on</strong>g>witness</str<strong>on</strong>g> is now divorced from that other<br />

pers<strong>on</strong>, or that other pers<strong>on</strong> has died; and<br />

there is no legal impediment to the marriage.<br />

Penalty: [...]penalty units or impris<strong>on</strong>ment for [...] [m<strong>on</strong>ths/years]<br />

12. Witness <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> arrangements<br />

(1) The [Minister] may make arrangements with any foreign State about any matter relating to cooperati<strong>on</strong> between<br />

[name of State] and that State relating to <str<strong>on</strong>g>witness</str<strong>on</strong>g> <str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g>.<br />

(2) The [Minister] may make such arrangements as are necessary or c<strong>on</strong>venient for the administrati<strong>on</strong> of a <str<strong>on</strong>g>witness</str<strong>on</strong>g><br />

<str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme with any other Minister or competent authority in [name of State].<br />

(3) The [Minister] may issue such directi<strong>on</strong>s as are necessary or c<strong>on</strong>venient for the administrati<strong>on</strong> of a <str<strong>on</strong>g>witness</str<strong>on</strong>g><br />

<str<strong>on</strong>g>protecti<strong>on</strong></str<strong>on</strong>g> programme.
