CHAPTER 4<br />

Department of Health<br />

Introduction<br />

The Department of Health (DoH) is primarily responsible <strong>for</strong> the realisation of the right<br />

of children <strong>and</strong> their families to health <strong>and</strong> related care, which rights enjoy extensive<br />

protection under the UNCRC (Article 24) <strong>and</strong> the ACRWC (Article 14).<br />

Both instruments guarantee the right to healthcare <strong>and</strong> <strong>services</strong> <strong>for</strong> infants, children,<br />

expectant <strong>and</strong> nursing mothers <strong>and</strong> the mothers, families <strong>and</strong> caregivers of infants <strong>and</strong><br />

children. They require State Parties to take steps to realise children’s rights to physical,<br />

mental <strong>and</strong> spiritual health 48 <strong>and</strong> the right to enjoy the highest attainable st<strong>and</strong>ard of<br />

health <strong>and</strong> facilities <strong>for</strong> the treatment of illness <strong>and</strong> rehabilitation of health. 49<br />

State Parties are required to take key steps to ensure the full implementation of these<br />

rights, with a specific focus on ensuring:<br />

● a reduction of infant <strong>and</strong> child mortality rates; 50<br />

● the provision of necessary medical assistance <strong>and</strong> healthcare to all children, with an<br />

emphasis on the development of primary healthcare; 51<br />

● the prevention of disease <strong>and</strong> malnutrition through the provision of adequate<br />

nutrition, safe drinking water <strong>and</strong> the application of readily available technology; 52<br />

● the provision of appropriate pre- <strong>and</strong> post-natal healthcare <strong>for</strong> expectant <strong>and</strong> nursing<br />

mothers <strong>and</strong> mothers of infants <strong>and</strong> small children; 53<br />

● the development of preventive healthcare <strong>and</strong> family life education, family planning<br />

education <strong>and</strong> <strong>services</strong>; 54<br />

● that all sectors in society, especially parents, children, community leaders <strong>and</strong><br />

community workers, are in<strong>for</strong>med <strong>and</strong> supported in the use of basic knowledge<br />

of child health <strong>and</strong> nutrition, the advantages of breastfeeding, hygiene <strong>and</strong><br />

environmental sanitation <strong>and</strong> the prevention of domestic <strong>and</strong> other accidents; 55<br />

● the abolition of traditional practices prejudicial to the health of children; 56<br />

● the integration of basic health service <strong>programmes</strong> in national development plans; 57<br />

● the meaningful participation of NGOs, local communities <strong>and</strong> the beneficiary<br />

population in the planning <strong>and</strong> management of basic health service <strong>programmes</strong> <strong>for</strong><br />

children; 58<br />

● the mobilisation of local community resources in the development of primary<br />

healthcare <strong>for</strong> children. 59<br />

The Constitution of the Republic of South Africa (Act No. 108 of 1996) has provided<br />

national protection of the right to healthcare through the recognition of the following<br />
