The child justice court<br />

child’s trial takes place.<br />

Section 65 of the<br />

Child Justice Act<br />

requires that the<br />

child’s parent, guardian<br />

or an appropriate<br />

adult attend the trial<br />

proceedings.<br />

The duties of the<br />

presiding officer are<br />

(Gallinetti 2009):<br />

of the nature of the<br />

allegations against<br />

him or her;<br />

of his or her rights;<br />

<br />

interests of the<br />

child are upheld,<br />

including ensuring<br />

the proceedings<br />

are fair, not unduly<br />

hostile towards<br />

the child <strong>and</strong><br />

are appropriate<br />

to the age <strong>and</strong><br />

underst<strong>and</strong>ing of the<br />

child;<br />

in need of care <strong>and</strong><br />

protection in terms<br />

of the Children’s<br />

Act 38/2005, the<br />

presiding officer may<br />

refer the matter to<br />

the children’s court.<br />

Child justice court<br />

While the child justice<br />

court is the <strong>for</strong>um<br />

where the trial takes<br />

place, the National<br />

Policy Framework<br />

<strong>for</strong> Child Justice<br />

requires <strong>and</strong> regulates<br />

a coordinated <strong>and</strong><br />

cooperative approach<br />

by all government<br />

departments, organs of<br />

state <strong>and</strong> institutions in<br />

matters related to child<br />

justice. The Framework<br />

provides guidance on<br />

the implementation<br />

<strong>and</strong> administration of<br />

the Act, <strong>and</strong> promotes<br />

cooperation <strong>and</strong><br />

communication with<br />

the NGO sector <strong>and</strong><br />

civil society.<br />

The Framework<br />

details the roles <strong>and</strong><br />

responsibilities of the<br />

South African Police,<br />

the Department of<br />

Social Development,<br />

the National<br />

Prosecuting Authority,<br />

the Department of<br />

Correctional Services<br />

(DCS), Legal Aid South<br />

Africa, the Department<br />

of Home Affairs, the<br />

Department of Health<br />

<strong>and</strong> NGOs.<br />
