Department of Basic Education ➔ and building access to the physical needs of learners with disabilities, etc. As such, schools and the relevant DoEs must, in the interpretation and fulfilment of their responsibilities to provide adequate water, sanitation and access, be guided by what is adequate for the full range of (especially vulnerable) learners. Protection against discrimination for failure to pay school fees The South African Schools Act (s5) prohibits any discrimination or the exclusion of any child from school on the grounds that the child/ caregiver is unable to pay school fees. Schools must encourage pregnant learners to continue with their education before and after the birth of the baby.
