STATEMENT BY MR. JANARDAN DWIVED, MEMBER OF PARLIAMENT, ON AGENDA<br />

ITEM 79 – REPORT OF THE INTERNATIONAL LAW COMMISSION ON THE WORK OF<br />

ITS SIXTY SECOND SESSION [PART – 1, CHAP I-IIIIV AND XIII] AT THE SIXTH<br />

COMMITTEE OF THE 65 TH SESSION OF THE UNITED NATIONS GENERAL ASSEMBLY ON<br />

OCTOBER 26, 2010<br />

Madam Chairpers<strong>on</strong>,<br />

Thank you for giving me the floor. As I am speaking in this Committee for the first time,<br />

let me first c<strong>on</strong>gratulate you and other <str<strong>on</strong>g>member</str<strong>on</strong>g>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the bureau <strong>on</strong> your electi<strong>on</strong>. I<br />

assure you <str<strong>on</strong>g>of</str<strong>on</strong>g> full cooperati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> my delegati<strong>on</strong>.<br />

Let me join others in <str<strong>on</strong>g>of</str<strong>on</strong>g>fering c<strong>on</strong>dolences <strong>on</strong> the untimely death <str<strong>on</strong>g>of</str<strong>on</strong>g> Paula Escarameia.<br />

She was an active participant in the work <str<strong>on</strong>g>of</str<strong>on</strong>g> the Internati<strong>on</strong>al Law Commissi<strong>on</strong> and


made significant c<strong>on</strong>tributi<strong>on</strong> to its work. She will be f<strong>on</strong>dly re<str<strong>on</strong>g>member</str<strong>on</strong>g>ed <str<strong>on</strong>g>by</str<strong>on</strong>g> her<br />

colleagues in the Commissi<strong>on</strong> as well as in the Sixth Committee as a voice for the<br />

integrity <str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al law and prop<strong>on</strong>ent <str<strong>on</strong>g>of</str<strong>on</strong>g> its core values, particularly as regards<br />

human rights and the role <str<strong>on</strong>g>of</str<strong>on</strong>g> civil society.<br />

We also express our deep sorrow <strong>on</strong> the passing away <str<strong>on</strong>g>of</str<strong>on</strong>g> Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essor Ian Brownlie,<br />

former <str<strong>on</strong>g>member</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Internati<strong>on</strong>al Law Commissi<strong>on</strong>, in a tragic accident at the<br />

beginning <str<strong>on</strong>g>of</str<strong>on</strong>g> this year. Sir Ian Brownlie made a significant c<strong>on</strong>tributi<strong>on</strong> to internati<strong>on</strong>al<br />

law and to the work <str<strong>on</strong>g>of</str<strong>on</strong>g> the Commissi<strong>on</strong>, especially as a Special Rapporteur <strong>on</strong> the topic<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> ‘effect <str<strong>on</strong>g>of</str<strong>on</strong>g> armed c<strong>on</strong>flict <strong>on</strong> treaties’. His untimely death is a great loss to<br />

internati<strong>on</strong>al law.<br />

Madam Chairpers<strong>on</strong>,<br />

I thank the Chairman <str<strong>on</strong>g>of</str<strong>on</strong>g> the Internati<strong>on</strong>al Law Commissi<strong>on</strong> for his lucid and<br />

comprehensive presentati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the report <strong>on</strong> the work <str<strong>on</strong>g>of</str<strong>on</strong>g> the Commissi<strong>on</strong> at its 62 nd<br />

Sessi<strong>on</strong> and especially <strong>on</strong> the detailed discourse <strong>on</strong> the guidelines. The Commissi<strong>on</strong>, at<br />

its last sessi<strong>on</strong>, has made c<strong>on</strong>siderable progress in the work <str<strong>on</strong>g>of</str<strong>on</strong>g> various matters <strong>on</strong> its<br />

agenda, including the identificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> possible new topics. We also welcome the new<br />

<str<strong>on</strong>g>member</str<strong>on</strong>g> who has joined the Commissi<strong>on</strong> this year, Mr. Huikang Huang <str<strong>on</strong>g>of</str<strong>on</strong>g> China.<br />

Madam Chairpers<strong>on</strong>,<br />

The rule <str<strong>on</strong>g>of</str<strong>on</strong>g> law c<strong>on</strong>stitutes the essence <str<strong>on</strong>g>of</str<strong>on</strong>g> the Commissi<strong>on</strong>’s work. India attaches high<br />

importance to the debates and exchange <str<strong>on</strong>g>of</str<strong>on</strong>g> views between the Commissi<strong>on</strong> and<br />

Member States in the Sixth Committee and c<strong>on</strong>siders that these debates are important<br />

tools not <strong>on</strong>ly for the progressive development <str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al law but also for the<br />

promoti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the rule <str<strong>on</strong>g>of</str<strong>on</strong>g> law at the nati<strong>on</strong>al and internati<strong>on</strong>al levels.<br />

The Commissi<strong>on</strong> has a symbiotic relati<strong>on</strong>ship with the Internati<strong>on</strong>al Court <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice,<br />

the highest judicial organ <str<strong>on</strong>g>of</str<strong>on</strong>g> the United Nati<strong>on</strong>s. Time and again, the Court has relied<br />

<strong>on</strong> treaties as binding instruments in themselves and other documents prepared <str<strong>on</strong>g>by</str<strong>on</strong>g> the<br />

Commissi<strong>on</strong> as evidence <str<strong>on</strong>g>of</str<strong>on</strong>g> customary internati<strong>on</strong>al law. C<strong>on</strong>versely, the Commissi<strong>on</strong><br />

has formulated draft articles <strong>on</strong> many subjects taking into account the jurisprudence<br />

developed through Court’s decisi<strong>on</strong>s. While the General Assembly has recognized the<br />

importance <str<strong>on</strong>g>of</str<strong>on</strong>g> the draft articles adopted <str<strong>on</strong>g>by</str<strong>on</strong>g> the Commissi<strong>on</strong> <strong>on</strong> different subjects, such<br />

rules have been relied <strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> nati<strong>on</strong>al and internati<strong>on</strong>al courts and tribunals in their<br />

work.<br />

Madam Chairpers<strong>on</strong>,<br />

Coming to the topic <str<strong>on</strong>g>of</str<strong>on</strong>g> reservati<strong>on</strong> to treaties, my delegati<strong>on</strong> would like to c<strong>on</strong>gratulate<br />

Special Rapporteur Mr. Alain Pellet for his hard work that has led the Commissi<strong>on</strong> to<br />

provisi<strong>on</strong>ally adopt the complete set <str<strong>on</strong>g>of</str<strong>on</strong>g> draft guidelines with commentaries, c<strong>on</strong>stituting


the Guide to Practice <strong>on</strong> Reservati<strong>on</strong> to Treaties. We find his explanati<strong>on</strong> to the<br />

guidelines immensely useful. The Draft Guidelines will serve as a comprehensive<br />

manual and would provide guidance to States and legal advisers <strong>on</strong> this subject.<br />

The Commissi<strong>on</strong> intends to adopt the final versi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Guide to Practice during its<br />

sixty-third sessi<strong>on</strong> in 2011 taking into c<strong>on</strong>siderati<strong>on</strong> the observati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> States and<br />

internati<strong>on</strong>al organizati<strong>on</strong>s. India will be submitting comments <strong>on</strong> the guidelines<br />

separately as requested <str<strong>on</strong>g>by</str<strong>on</strong>g> the Commissi<strong>on</strong>. However, I would like to make very<br />

preliminary comments at this stage <strong>on</strong> reservati<strong>on</strong>s to treaties.<br />

Madam Chairpers<strong>on</strong>,<br />

It may be recalled that quite early in its work <strong>on</strong> reservati<strong>on</strong>, there was c<strong>on</strong>sensus in<br />

the Commissi<strong>on</strong> that there should be no change in the relevant provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the Vienna<br />

C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Law <str<strong>on</strong>g>of</str<strong>on</strong>g> Treaties and that the Guidelines would <strong>on</strong>ly serve to<br />

elaborate and elucidate those rules. However in dealing with the issue <str<strong>on</strong>g>of</str<strong>on</strong>g> impermissible<br />

reservati<strong>on</strong>s the proposed guidelines appear to have g<strong>on</strong>e bey<strong>on</strong>d the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Vienna C<strong>on</strong>venti<strong>on</strong>, particularly in paragraph 4.5.2 which provides a new c<strong>on</strong>cept <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />

general presumpti<strong>on</strong> in the case <str<strong>on</strong>g>of</str<strong>on</strong>g> an impermissible reservati<strong>on</strong>. In such a case, under<br />

the proposed guideline, the reserving State becomes a party to the treaty without the<br />

benefit <str<strong>on</strong>g>of</str<strong>on</strong>g> the reservati<strong>on</strong> made <str<strong>on</strong>g>by</str<strong>on</strong>g> it unless it clearly indicates that under these<br />

circumstances it does not wish to be bound <str<strong>on</strong>g>by</str<strong>on</strong>g> the treaty in questi<strong>on</strong>. We have serious<br />

c<strong>on</strong>cerns about this c<strong>on</strong>cept as it may bring uncertainty to internati<strong>on</strong>al treaty relati<strong>on</strong>s.<br />

On the questi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> successi<strong>on</strong> to treaties, we note that the guidelines generally follow<br />

the 1978 Vienna C<strong>on</strong>venti<strong>on</strong>.<br />

We appreciate the decisi<strong>on</strong> to make the edited summary records <str<strong>on</strong>g>of</str<strong>on</strong>g> the Commissi<strong>on</strong>’s<br />

proceedings (incorporating the correcti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>member</str<strong>on</strong>g>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the Commissi<strong>on</strong>, and editorial<br />

changes <str<strong>on</strong>g>by</str<strong>on</strong>g> the Yearbook editors and in the form prior to typesetting and publicati<strong>on</strong>)<br />

up to 2004, available <strong>on</strong> a pilot basis, <strong>on</strong> the Commissi<strong>on</strong>’s website. C<strong>on</strong>sidering the<br />

delay in the publicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Summary Records, this will be <str<strong>on</strong>g>of</str<strong>on</strong>g> great assistance to<br />

<str<strong>on</strong>g>member</str<strong>on</strong>g> States and others in following the Commissi<strong>on</strong>’s work. Further, priority<br />

should be accorded to expedite preparati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the summary records <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Commissi<strong>on</strong>.<br />

Madam Chairpers<strong>on</strong>,<br />

We also support the Commissi<strong>on</strong>’s views c<strong>on</strong>cerning the questi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> h<strong>on</strong>oraria, resulting<br />

from the adopti<strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> the General Assembly <str<strong>on</strong>g>of</str<strong>on</strong>g> its resoluti<strong>on</strong> 56/272 <str<strong>on</strong>g>of</str<strong>on</strong>g> 27 March 2002.<br />

The decisi<strong>on</strong> to disc<strong>on</strong>tinue the h<strong>on</strong>oraria especially affects Special Rapporteurs from<br />

developing countries, as it compromises support for their research work. The Special<br />

Rapporteurs should also be given the opportunity to participate in the Meetings <str<strong>on</strong>g>of</str<strong>on</strong>g> the


Sixth Committee and interact with delegati<strong>on</strong>s during the c<strong>on</strong>siderati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> their topics.<br />

This would give them the opportunity to acquire a more comprehensive view <str<strong>on</strong>g>of</str<strong>on</strong>g> existing<br />

positi<strong>on</strong>s, to take note <str<strong>on</strong>g>of</str<strong>on</strong>g> observati<strong>on</strong>s made and to begin preparing their reports at an<br />

earlier stage.<br />
