STATEMENT BY MR. R.K. SINGH PATEL, MEMBER OF PARLIAMENT, ON AGENDA ITEM<br />

140 – ADMINISTRATION OF JUSTICE AT THE FIFTH COMMITTEE OF THE 65 TH<br />

SESSION OF THE UNITED NATIONS GENERAL ASSEMBLY ON NOVEMEBR 10, 2010<br />

Mr. Chairman,<br />

At the outset, my delegati<strong>on</strong> thanks the Executive Director <str<strong>on</strong>g>of</str<strong>on</strong>g> the Office <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Administrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice, Mr. Andrei Terekhov for introducing the report <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Secretary General <strong>on</strong> Administrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice at the United Nati<strong>on</strong>s. We also thank the<br />

United Nati<strong>on</strong>s Ombudsman, Mr. Johnst<strong>on</strong> Ba<str<strong>on</strong>g>rk</str<strong>on</strong>g>at, for introducing the report <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Secretary General <strong>on</strong> the activities <str<strong>on</strong>g>of</str<strong>on</strong>g> his Office. We c<strong>on</strong>vey our appreciati<strong>on</strong> to Ms.<br />

Susan Mclurg, the Chairpers<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Advisory Committee <strong>on</strong> Administrative and<br />

Budgetary Questi<strong>on</strong>s (ACABQ), for introducing the related report <str<strong>on</strong>g>of</str<strong>on</strong>g> the advisory<br />

committee. We further thank the Vice-President <str<strong>on</strong>g>of</str<strong>on</strong>g> the Staff-Management Coordinati<strong>on</strong><br />

Committee (SMCC), Ms. Paulina Analena for her <str<strong>on</strong>g>statement</str<strong>on</strong>g>.


My delegati<strong>on</strong> aligns itself with the <str<strong>on</strong>g>statement</str<strong>on</strong>g> made <str<strong>on</strong>g>by</str<strong>on</strong>g> Yemen <strong>on</strong> behalf <str<strong>on</strong>g>of</str<strong>on</strong>g> the Group<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> 77 and China.<br />

Mr. Chairman,<br />

My delegati<strong>on</strong> is encouraged with the progress recorded <str<strong>on</strong>g>by</str<strong>on</strong>g> the new system <str<strong>on</strong>g>of</str<strong>on</strong>g> internal<br />

justice since its birth in July 2009. Even in the short time that the system has been<br />

operati<strong>on</strong>al, it is evident that it represents a ma<str<strong>on</strong>g>rk</str<strong>on</strong>g>ed improvement over its predecessor.<br />

Some <str<strong>on</strong>g>of</str<strong>on</strong>g> the benefits from the new system are already visible. We particularly welcome<br />

the timelier dispositi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> cases since last year with finalizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a case taking an<br />

average <str<strong>on</strong>g>of</str<strong>on</strong>g> six m<strong>on</strong>ths. The new system accords primacy <str<strong>on</strong>g>of</str<strong>on</strong>g> place to the fundamental<br />

axiom <str<strong>on</strong>g>of</str<strong>on</strong>g> “justice delayed is justice denied.”<br />

In this regard, we would like to place <strong>on</strong> record our appreciati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the commendable<br />

effort and dedicati<strong>on</strong> dem<strong>on</strong>strated <str<strong>on</strong>g>by</str<strong>on</strong>g> the judges and staff in navigating the transiti<strong>on</strong><br />

from the old system.<br />

Mr. Chairman,<br />

We remain supportive <str<strong>on</strong>g>of</str<strong>on</strong>g> informal c<strong>on</strong>flict resoluti<strong>on</strong> through the use <str<strong>on</strong>g>of</str<strong>on</strong>g> ombudsman<br />

and mediati<strong>on</strong> services as a first step <str<strong>on</strong>g>of</str<strong>on</strong>g> recourse under the new system. These efforts<br />

should be further strengthened, so as to enhance accountability and have a positive<br />

impact <strong>on</strong> human resources management <str<strong>on</strong>g>by</str<strong>on</strong>g> facilitating speedier resoluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> disputes<br />

and promoting mutual trust, harm<strong>on</strong>y and understanding between the staff and the<br />

management.<br />

We share the disappointment <str<strong>on</strong>g>of</str<strong>on</strong>g> the ACABQ with regard to delays in finalizing cost<br />

sharing agreements with the funds and programmes. We reiterate paragraph 62 <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

resoluti<strong>on</strong> 62/228, wherein the General Assembly had approved the cost sharing<br />

arrangement for the new system <str<strong>on</strong>g>of</str<strong>on</strong>g> administrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> justice <strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

“headcount” approach, rather than <strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g> actual cases disposed, as proposed<br />

<str<strong>on</strong>g>by</str<strong>on</strong>g> the funds and programmes. We urge the Secretary-General to expedite early<br />

c<strong>on</strong>clusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the cost-sharing arrangement.<br />

Mr. Chairman,<br />

My delegati<strong>on</strong> broadly c<strong>on</strong>curs with the ACABQ’s reas<strong>on</strong>ing that any meaningful<br />

assessment <str<strong>on</strong>g>of</str<strong>on</strong>g> the new system would require more time and experience before a<br />

determinati<strong>on</strong> <strong>on</strong> what more needs to be d<strong>on</strong>e is taken. Nevertheless, we remain open<br />

to c<strong>on</strong>sidering specific resource requests <strong>on</strong> a case-<str<strong>on</strong>g>by</str<strong>on</strong>g>-case basis. We further support<br />

strengthening <str<strong>on</strong>g>of</str<strong>on</strong>g> the Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Staff Legal Assistance as we believe that the c<strong>on</strong>tinued<br />

availability <str<strong>on</strong>g>of</str<strong>on</strong>g> legal assistance to staff is crucial to the efficacy <str<strong>on</strong>g>of</str<strong>on</strong>g> the new system.


We have noted the Secretary-General’s requests for adequate funds for translati<strong>on</strong> and<br />

interpretati<strong>on</strong> services, and for granting travel entitlements to the Appeals Tribunal<br />

judges based <strong>on</strong> that provided to former judges <str<strong>on</strong>g>of</str<strong>on</strong>g> the United Nati<strong>on</strong>s Administrative<br />

Tribunal.<br />

Mr. Chairman,<br />

In c<strong>on</strong>cluding, it must be underscored that the new system will ultimately be judged <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

the c<strong>on</strong>fidence it inspires am<strong>on</strong>gst Staff that their grievances will be addressed<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>ally, fairly and in a timely manner. We further hope that the new system <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

administrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> justice would remain c<strong>on</strong>sistent<br />

with the outcome <str<strong>on</strong>g>of</str<strong>on</strong>g> the overall reform <str<strong>on</strong>g>of</str<strong>on</strong>g> human resources management within the<br />

United Nati<strong>on</strong>s System.<br />

A good beginning has been made. Let us build <strong>on</strong> it so as to meet the goal <str<strong>on</strong>g>of</str<strong>on</strong>g> an<br />

independent, transparent, pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>alized, adequately resourced and decentralized<br />

system <str<strong>on</strong>g>of</str<strong>on</strong>g> internal justice.<br />
