Mr. Chairman, The ong>theong>me ong>ofong> this conference is particularly relevant, focusing on women and children, as challenges faced by ong>theong>m due ong>toong> disability are ong>ofong>ten furong>theong>r compounded for ong>theong>m. Our discussions here help refocus ong>atong>tention ong>toong> this aspect thong>atong> requires a coordinong>atong>ed response not only among different government departments but also among relevant stakeholders. Mr. Chairman, The Government ong>ofong> India had early on recognized ong>theong> need for specific policy intervention ong>toong> support disabled people. Our legislong>atong>ive framework is anchored in ong>theong> Persons with Disabilities (Equal Opportunities, Protection ong>ofong> Rights and Full Participong>atong>ion) Act passed in ong>theong> year 1995, before ong>theong> ong>Conventionong> was drafted. The Act recognized thong>atong> persons with disabilities are a valuable human resource and seeks ong>toong> creong>atong>e an enabling environment thong>atong> provides ong>theong>m with equal opportunities, protection ong>ofong> ong>theong>ir rights and full participong>atong>ion in society, including in areas ong>ofong> educong>atong>ion and employment. The nodal Ministry ong>ofong> Social Justice and Empowerment works with several ministries ong>toong> coordinong>atong>e and implement programs and schemes in ong>theong> areas ong>ofong> health, educong>atong>ion and employment.

equal opportunities, protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir rights and full particip<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> in society,<br />

including in areas <str<strong>on</strong>g>of</str<strong>on</strong>g> educ<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> and employment. The nodal Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Social<br />

Justice and Empowerment works with several ministries <str<strong>on</strong>g>to</str<strong>on</strong>g> coordin<str<strong>on</strong>g>at</str<strong>on</strong>g>e and<br />

implement programs and schemes in <str<strong>on</strong>g>the</str<strong>on</strong>g> areas <str<strong>on</strong>g>of</str<strong>on</strong>g> health, educ<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> and<br />

employment.


Mr. Chairman,<br />

This legisl<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> was supplemented by <str<strong>on</strong>g>the</str<strong>on</strong>g> N<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong>al Policy for Pers<strong>on</strong>s with<br />

Disabilities announced in 2006. This policy in fact specifically focuses <strong>on</strong> issues<br />

c<strong>on</strong>cerning women and children with disabilities.<br />

Ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r Act - <str<strong>on</strong>g>the</str<strong>on</strong>g> N<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong>al Trust for Welfare <str<strong>on</strong>g>of</str<strong>on</strong>g> Pers<strong>on</strong>s with Autism,<br />

Cerebral Palsy, Mental Retard<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> and Multiple Disability Act was passed in 1999.<br />

This Act laid out provisi<strong>on</strong>s for legal guardianship <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> four c<str<strong>on</strong>g>at</str<strong>on</strong>g>egories <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

pers<strong>on</strong>s with disabilities and for <str<strong>on</strong>g>the</str<strong>on</strong>g> cre<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> an enabling envir<strong>on</strong>ment for <str<strong>on</strong>g>the</str<strong>on</strong>g>m.<br />

This Act is also undergoing revisi<strong>on</strong> in light <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> UNCRPD.<br />

In 2010, <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Social Justice & Empowerment c<strong>on</strong>stituted a<br />

Committee <str<strong>on</strong>g>to</str<strong>on</strong>g> harm<strong>on</strong>ise <str<strong>on</strong>g>the</str<strong>on</strong>g> existing legisl<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> with <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> CRPD.<br />

This Committee submitted its recommend<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong>s <strong>on</strong> a revised draft Bill <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Ministry in June 2011. This is presently undergoing c<strong>on</strong>sult<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong>s am<strong>on</strong>g all<br />

stakeholders, particularly <str<strong>on</strong>g>the</str<strong>on</strong>g> St<str<strong>on</strong>g>at</str<strong>on</strong>g>es, in whose domain “disability” figures under<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> country.<br />

Mr. Chairman,<br />

The Government has instituted a scheme <str<strong>on</strong>g>of</str<strong>on</strong>g> N<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong>al Awards for<br />

empowerment <str<strong>on</strong>g>of</str<strong>on</strong>g> pers<strong>on</strong>s with disabilities as also <str<strong>on</strong>g>to</str<strong>on</strong>g> encourage o<str<strong>on</strong>g>the</str<strong>on</strong>g>rs for cre<str<strong>on</strong>g>at</str<strong>on</strong>g>ing<br />

a barrier free envir<strong>on</strong>ment for <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>s with disabilities. Special focus is paid <strong>on</strong><br />

achievements <str<strong>on</strong>g>of</str<strong>on</strong>g>, and initi<str<strong>on</strong>g>at</str<strong>on</strong>g>ives pertaining <str<strong>on</strong>g>to</str<strong>on</strong>g> women with disabilities, particularly<br />

those from <str<strong>on</strong>g>the</str<strong>on</strong>g> rural areas and self-employed women.<br />

The N<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong>al Plan <str<strong>on</strong>g>of</str<strong>on</strong>g> Acti<strong>on</strong> for Children, 2005 seeks <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure <str<strong>on</strong>g>the</str<strong>on</strong>g> right <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

survival, care, protecti<strong>on</strong> and security for all <str<strong>on</strong>g>the</str<strong>on</strong>g> children with disabilities. The<br />

Right <str<strong>on</strong>g>to</str<strong>on</strong>g> Educ<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> Act, 2009 mand<str<strong>on</strong>g>at</str<strong>on</strong>g>es for free and compulsory elementary<br />

educ<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> all children with special needs up <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> age <str<strong>on</strong>g>of</str<strong>on</strong>g> 18 years. The<br />

Copyright Act has also been suitably amended <str<strong>on</strong>g>to</str<strong>on</strong>g> facilit<str<strong>on</strong>g>at</str<strong>on</strong>g>e access <str<strong>on</strong>g>to</str<strong>on</strong>g> students with<br />

disabilities.<br />

Mr. Chairman,<br />

The Government has established seven N<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong>al Institutes (NIs) dealing with<br />

different types <strong>on</strong> disabilities and seven Composite Regi<strong>on</strong>al Centers (CRCs) <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

promote research and c<strong>on</strong>duct training for delivery <str<strong>on</strong>g>of</str<strong>on</strong>g> services <str<strong>on</strong>g>to</str<strong>on</strong>g> disabled pers<strong>on</strong>s.<br />

The Government also funds a large number <str<strong>on</strong>g>of</str<strong>on</strong>g> NGOs providing disability<br />

services, and has established a N<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong>al Handicapped Finance and Development<br />

Corpor<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> (NHFDC) which provides loans <str<strong>on</strong>g>at</str<strong>on</strong>g> c<strong>on</strong>cessi<strong>on</strong>al r<str<strong>on</strong>g>at</str<strong>on</strong>g>es <str<strong>on</strong>g>to</str<strong>on</strong>g> pers<strong>on</strong>s with<br />

disabilities for self-employment.<br />

Mr. Chairman,<br />

With a view <str<strong>on</strong>g>to</str<strong>on</strong>g> fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r improve implement<str<strong>on</strong>g>at</str<strong>on</strong>g>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> government policies, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Government decided, in principle, in January 2012 <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>vert <str<strong>on</strong>g>the</str<strong>on</strong>g> 'Disability<br />

Divisi<strong>on</strong>' <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Social Justice & Empowerment in<str<strong>on</strong>g>to</str<strong>on</strong>g> a separ<str<strong>on</strong>g>at</str<strong>on</strong>g>e<br />

Department for more effective liaising with <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>cerned Ministries/Departments<br />

and fulfilment <str<strong>on</strong>g>of</str<strong>on</strong>g> its resp<strong>on</strong>sibilities <str<strong>on</strong>g>to</str<strong>on</strong>g>wards <str<strong>on</strong>g>the</str<strong>on</strong>g> disabled.<br />

Mr. Chairman,<br />

The C<strong>on</strong>stituti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> India ensures equality, freedom, justice and dignity <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

all individuals and mand<str<strong>on</strong>g>at</str<strong>on</strong>g>es an inclusive society for all, including <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>s with<br />

disabilities. We remain committed <str<strong>on</strong>g>to</str<strong>on</strong>g> building an enabling envir<strong>on</strong>ment so th<str<strong>on</strong>g>at</str<strong>on</strong>g> all<br />

pers<strong>on</strong>s with disabilities, including women and children, are able <str<strong>on</strong>g>to</str<strong>on</strong>g> enjoy <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

rights and realise <str<strong>on</strong>g>the</str<strong>on</strong>g>ir full potential.<br />
