The agreement must state that:<br />
•Participation by both the mentor and protégé is<br />
voluntary;<br />
•Participation is neither a guarantee for a contract<br />
opportunity nor a promise <strong>of</strong> business;<br />
•Program's intent is to foster positive long-term<br />
business relationships.<br />

The agreement must state that (Cont.):<br />
• Identification <strong>of</strong> the developmental areas;<br />
• Time period (no more than 2 years);<br />
• General Information (e.g., Name, contact<br />
persons, etc.);<br />
• Notification to Terminate Relationship; and,<br />
• Timeline to report progress <strong>of</strong> the relationship to<br />
the sponsoring agency.<br />

Procurements and Contract<br />
A respondent's participation in a <strong>Mentor</strong>-Protégé<br />
Program under Government Code, §2161.065, and the<br />
submission <strong>of</strong> a protégé as a subcontractor in the HUB<br />
subcontracting plan constitutes a good faith effort for<br />
the particular area to be subcontracted with the protégé.<br />
When submitted, state agencies may accept a <strong>Mentor</strong>-<br />
Protégé Agreement that has been entered into by the<br />
respondent (mentor) and a certified HUB (protégé).<br />

<strong>Mentor</strong> Protégé Requirements for<br />
Procurements and Contract<br />
The agency shall consider the following in<br />
determining the respondent's good faith effort:<br />
• (A) if the respondent has entered into a fully executed<br />
<strong>Mentor</strong>-Protégé Agreement that has been registered<br />
with the comptroller prior to submitting the plan,<br />
and,<br />
• (B) if the respondent's HUB subcontracting plan<br />
identifies the areas <strong>of</strong> subcontracting that will be<br />
performed by the protégé.<br />
