constituted state or local zoning authority or other authorized public body to be in violation ofstate or local laws,
regulations, or ordinances that are intended to discourage or otherwise restrict land development or occupancy in
flood-prone areas.
Significant hazard dam means a dam assigned the significant hazard potential classification where failure may
cause damage to main roads, minor railroads, or cause interruption ofuse, or service ofrelatively important public
utilities.
Special flood hazard area (SFHA) means that portion ofthe floodplain subject to inundation by the base flood
and/or flood-related erosion hazards as shown on a FHBM or FIRM as Zone A, AE, Al - A30, AH, AO, AR, V,
VE, or VI-V30.
Start ofconstruction (for other than new construction or substantial improvements under the Coastal Barrier
Resources Act P. L. 97~348), includes substantial improvement, and means the date the building permit was issued,
provided the actual start ofconstruction, repair, reconstruction, or improvement was within 180 days ofthe permit
date. The actual start means the first placement ofpennanent construction ofa building (including a manufactured
home) on a site, such as the pouring ofslabs or footings, installation ofpiles, construction ofcolumns, or any work
beyond the stage ofexcavation or placement ofa manufactured home on a foundation. Permanent construction does
not include land preparation, such as clearing, grading and filling; nor does it include the installation ofstreets
and/or walkways; nor does it include excavation for a basement, footings, piers or foundations or the erection of
temporary forms; nor does it include the installation on the property ofaccessory buildings, such as garages or sheds
not occupied as dwelling units or not part ofthe main building. For substantial improvement, the actual start of
construction means the first alteration ofany wall, ceiling, floor, or other structural part ofa building, whether or not
that alteration affects the external dimensions ofthe building.
Structure, for floodplain management purposes, means a walled and roofed building, including a gas or liquid
storage tank that is principally above ground, as well as a manufactured home.
Structure, for insurance purposes, means a building with two or more outside rigid walls and a fully secured roof,
that is affixed to a permanent site; a manufactured home built on a permanent chassis, transported to its site in one or
more sections, and affixed to a permanent foundation; or a travel trailer without wheels, built on a chassis and
affixed to a permanent foundation, that is regulated under the community's floodplain management and building
ordinances or laws.
Subrogation means an action brought by FEMA when flood damages have occurred, flood insurance has been paid,
and all or part ofthe damage can be attributed to acts or omissions by a community or other third party.
Substantial Damage means damage ofany origin sustained by a structure whereby the cost ofrestoring the
structure to its before damaged condition would equal or exceed 50 percent ofthe market value ofthe structure
before the damage occurred. "Substantial damage" also means f1ood~related damages sustained by a structure on
two separate occasions during the life ofthe structure for which the cost ofrepairs at the time ofeach flood event, on
the average, equals or exceeds 25 percent ofthe market value of the structure before the damage occurred.
For the purposes ofthis definition, "repair" is considered to occur when the first repair or reconstruction ofany wall,
ceiling, floor, or other structural part ofthe building commences.
The term does not apply to:

Any project for improvement ofa building required to comply with existing health, sanitary, or safety code
specifications which have been identified by the Code Enforcement Official and which are solely necessary
to assure safe living conditions, or
Any alteration of a "historic structure" provided that the alteration will not preclude the structure's
continued designation as a "historic structure."
