UNDERSTANDING ON<br />

LABOUR COOPERATION<br />

BETWEEN<br />

HONG KONG, CHINA<br />

AND NEW ZEALAND


The <strong>Labour</strong> Department <str<strong>on</strong>g>of</str<strong>on</strong>g> the Government <str<strong>on</strong>g>of</str<strong>on</strong>g> the H<strong>on</strong>g K<strong>on</strong>g<br />

Special Administrative Regi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the People’s Republic <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

China, in the name <str<strong>on</strong>g>of</str<strong>on</strong>g> H<strong>on</strong>g K<strong>on</strong>g, China, and the Department<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Labour</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> New Zealand, in the name <str<strong>on</strong>g>of</str<strong>on</strong>g> New Zealand<br />

(hereinafter referred to as “the Parties” or individually as<br />

“Party”, unless the c<strong>on</strong>text otherwise requires):<br />

Desiring to strengthen the trade and ec<strong>on</strong>omic relati<strong>on</strong>ship<br />

between H<strong>on</strong>g K<strong>on</strong>g, China and New Zealand;<br />

C<strong>on</strong>sidering the H<strong>on</strong>g K<strong>on</strong>g, China - New Zealand Closer<br />

Ec<strong>on</strong>omic Partnership Agreement;<br />

C<strong>on</strong>sidering the objectives <str<strong>on</strong>g>of</str<strong>on</strong>g> the Internati<strong>on</strong>al <strong>Labour</strong><br />

Organisati<strong>on</strong> (“ILO”), which the Parties firmly support;<br />

Committed to the pursuit <str<strong>on</strong>g>of</str<strong>on</strong>g> sustainable development, taking<br />

into account the social, envir<strong>on</strong>mental, cultural and ec<strong>on</strong>omic<br />

circumstances <str<strong>on</strong>g>of</str<strong>on</strong>g> the Parties, and noting that it is essential for<br />

ec<strong>on</strong>omic prosperity;<br />

Recognising the commitments made by the Parties in this<br />

<str<strong>on</strong>g>Memorandum</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Understanding</str<strong>on</strong>g> <strong>on</strong> <strong>Labour</strong> Cooperati<strong>on</strong><br />

between H<strong>on</strong>g K<strong>on</strong>g, China and New Zealand (“MOU”), with<br />

each Party seeking to improve working c<strong>on</strong>diti<strong>on</strong>s and protect<br />

and enhance basic workers’ rights in its own Area, taking into<br />

account the different domestic c<strong>on</strong>texts, including<br />

development, social, cultural and historical backgrounds;<br />

Desiring to strengthen bilateral cooperati<strong>on</strong> <strong>on</strong> labour matters<br />

to c<strong>on</strong>tribute to the development <str<strong>on</strong>g>of</str<strong>on</strong>g> appropriate approaches to<br />

sustainable development issues;<br />

Reaffirming the commitment <str<strong>on</strong>g>of</str<strong>on</strong>g> the Parties to develop the<br />

c<strong>on</strong>tent <str<strong>on</strong>g>of</str<strong>on</strong>g> their bilateral agenda and to share the knowledge<br />

and experience gained; and<br />

C<strong>on</strong>vinced that cooperati<strong>on</strong> between the Parties in the<br />

abovementi<strong>on</strong>ed matters will serve their mutual interests;<br />

Have agreed as follows:<br />

Article 1: Objectives<br />

The objectives <str<strong>on</strong>g>of</str<strong>on</strong>g> the Parties under this MOU are to:<br />

(a) through cooperati<strong>on</strong> and dialogue between the<br />

Parties, strengthen the broader relati<strong>on</strong>ship and<br />

facilitate the improvement <str<strong>on</strong>g>of</str<strong>on</strong>g> the Parties’ capacities<br />

to address labour matters;<br />

(b) enhance the well-being <str<strong>on</strong>g>of</str<strong>on</strong>g> the respective Parties’<br />

workforces progressively, through the promoti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

sound labour policies and practices, and better<br />

understanding <str<strong>on</strong>g>of</str<strong>on</strong>g> each Party’s labour system; and<br />

(c) provide a forum to discuss and exchange views <strong>on</strong><br />

labour issues <str<strong>on</strong>g>of</str<strong>on</strong>g> interest or c<strong>on</strong>cern.<br />

Article 2: General Provisi<strong>on</strong>s<br />

1. The Parties respect the right <str<strong>on</strong>g>of</str<strong>on</strong>g> each Party to set its own<br />

policies and priorities, and to set, administer and enforce<br />

its own labour laws and regulati<strong>on</strong>s.<br />

2. The Parties affirm their respective commitment to the<br />

principles <str<strong>on</strong>g>of</str<strong>on</strong>g> the ILO Declarati<strong>on</strong> <strong>on</strong> Fundamental<br />

Principles and Rights at Work and its Follow-up (1998).<br />

3. The Parties recognise that it is inappropriate to set or<br />

use their labour laws, regulati<strong>on</strong>s, policies and practices<br />

for trade protecti<strong>on</strong>ist purposes.<br />

4. The Parties recognise that it is inappropriate to<br />

encourage trade or investment by weakening or<br />

reducing the protecti<strong>on</strong>s afforded in their labour laws,<br />

regulati<strong>on</strong>s, policies and practices.<br />

5. Recognising the desirability <str<strong>on</strong>g>of</str<strong>on</strong>g> clear and well understood<br />

labour policies and practices and the utility <str<strong>on</strong>g>of</str<strong>on</strong>g> broad<br />

domestic c<strong>on</strong>sultati<strong>on</strong> with stakeholders in formulating<br />

these policies, each Party shall, inter alia, maintain close<br />

dialogue with its stakeholders.<br />

6. Each Party shall promote public awareness <str<strong>on</strong>g>of</str<strong>on</strong>g> its labour<br />

laws and regulati<strong>on</strong>s domestically.<br />

Article 3: Scope and Means <str<strong>on</strong>g>of</str<strong>on</strong>g> Cooperati<strong>on</strong><br />

1. The Parties agree to cooperate <strong>on</strong> labour matters <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

mutual interest and benefit. Such cooperati<strong>on</strong> shall be<br />

subject to the availability <str<strong>on</strong>g>of</str<strong>on</strong>g> resources, the respective<br />

priorities <str<strong>on</strong>g>of</str<strong>on</strong>g> the Parties and their domestic laws. The<br />

Parties shall mutually determine specific labour<br />

cooperative activities.<br />

2. The Parties’ intenti<strong>on</strong> is to identify and cooperate in<br />

labour areas <str<strong>on</strong>g>of</str<strong>on</strong>g> comm<strong>on</strong> interest and c<strong>on</strong>cern. To<br />

facilitate this, as an initial step, the Parties shall<br />

exchange lists <str<strong>on</strong>g>of</str<strong>on</strong>g> their areas <str<strong>on</strong>g>of</str<strong>on</strong>g> interest and expertise.<br />

3. Cooperative activities may be implemented through a<br />

variety <str<strong>on</strong>g>of</str<strong>on</strong>g> means, such as the exchange <str<strong>on</strong>g>of</str<strong>on</strong>g> best practice<br />

and informati<strong>on</strong>, joint projects, studies, exchange visits,<br />

visits, workshops and dialogue, as the Parties may<br />

mutually determine.<br />

4. Each Party may, having regard to its own domestic<br />

circumstances, decide to involve its uni<strong>on</strong>s and<br />

employers and/or other pers<strong>on</strong>s and organisati<strong>on</strong>s in its<br />

Area in identifying potential areas for cooperati<strong>on</strong> and in<br />

undertaking cooperative activities.<br />

Article 4: Instituti<strong>on</strong>al Arrangements<br />

1. Each Party shall appoint a c<strong>on</strong>tact point within the six<br />

m<strong>on</strong>ths following the entry into force <str<strong>on</strong>g>of</str<strong>on</strong>g> this MOU to:<br />

(a) facilitate communicati<strong>on</strong> between the Parties relating<br />

to the implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this MOU;<br />

(b) establish a cooperati<strong>on</strong> programme to be carried out<br />

within a specified period; and<br />

(c) coordinate the cooperative activities referred to in this<br />

MOU.<br />

2. The resources for cooperative activities shall be decided<br />

by the Parties <strong>on</strong> a case-by-case basis and shall depend<br />

<strong>on</strong> the budgets available. Any specific activity or<br />

project launched by mutual determinati<strong>on</strong> may, if<br />

necessary, be dealt with in a separate arrangement.<br />

3. Each Party shall seek to obtain the resources required<br />

to support the mutually determined cooperative<br />

activities, and shall undertake the coordinati<strong>on</strong> for the<br />

effective implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this MOU.<br />

4. The Parties, including senior <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials <str<strong>on</strong>g>of</str<strong>on</strong>g> the government<br />

agencies resp<strong>on</strong>sible for relevant labour matters, shall<br />

meet within the first year after this MOU enters into<br />

force, and then <strong>on</strong> a regular basis, as mutually<br />

determined, to:<br />

(a) establish an agreed work programme <str<strong>on</strong>g>of</str<strong>on</strong>g> cooperative<br />

activities;<br />

(b) oversee and evaluate cooperative activities;<br />

(c) serve as a channel for dialogue <strong>on</strong> matters <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

mutual interest;<br />

(d) review the operati<strong>on</strong> and outcomes <str<strong>on</strong>g>of</str<strong>on</strong>g> this MOU;<br />

and<br />

(e) provide a forum to discuss and exchange views <strong>on</strong><br />

labour issues <str<strong>on</strong>g>of</str<strong>on</strong>g> interest or c<strong>on</strong>cern with a view to<br />

reaching better understanding or c<strong>on</strong>sensus<br />

between the Parties <strong>on</strong> those issues.<br />

5. The Parties may meet in pers<strong>on</strong>, via telec<strong>on</strong>ference, via<br />

video-c<strong>on</strong>ference, or through any other means, as<br />

mutually determined by the Parties. The Parties may<br />

exchange informati<strong>on</strong> and coordinate activities between<br />

meetings using email, video-c<strong>on</strong>ferencing or other<br />

means <str<strong>on</strong>g>of</str<strong>on</strong>g> communicati<strong>on</strong>.<br />

6. Each Party may, having regard to its own domestic<br />

circumstances, decide to c<strong>on</strong>sult with members <str<strong>on</strong>g>of</str<strong>on</strong>g> its<br />

public or domestic n<strong>on</strong>-government sectors over<br />

matters relating to the operati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this MOU by<br />

whatever means that Party c<strong>on</strong>siders appropriate.<br />

Article 5: C<strong>on</strong>sultati<strong>on</strong>s<br />

1. Should any issue arise over the interpretati<strong>on</strong>,<br />

implementati<strong>on</strong> or applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this MOU, a Party may<br />

request c<strong>on</strong>sultati<strong>on</strong>s with the other Party, through its<br />

c<strong>on</strong>tact point. The c<strong>on</strong>tact point shall identify the <str<strong>on</strong>g>of</str<strong>on</strong>g>fice<br />

or <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial resp<strong>on</strong>sible for the issue and assist as<br />

necessary in facilitating communicati<strong>on</strong>s between the<br />

Parties. Any difference between the Parties under this<br />

MOU shall be settled amicably through c<strong>on</strong>sultati<strong>on</strong> and<br />

negotiati<strong>on</strong>. Neither Party shall refer any such<br />

difference to any third party or internati<strong>on</strong>al tribunal for<br />

settlement.<br />

2. If either Party requests a meeting with the other Party to<br />

assist in the resoluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> any issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the nature set out<br />

in Paragraph 1, the Parties shall meet as so<strong>on</strong> as<br />

practicable and, unless otherwise mutually determined,<br />

no later than 90 days following the receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> the request.<br />

3. The Parties may refer any issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the nature set out in<br />

Paragraph 1 to a joint meeting <str<strong>on</strong>g>of</str<strong>on</strong>g> the Parties, which may<br />

include Ministers, Secretaries or Commissi<strong>on</strong>ers, for<br />

c<strong>on</strong>sultati<strong>on</strong>s.<br />

Article 6: Final Provisi<strong>on</strong>s<br />

1. This MOU shall enter into force 60 days after the<br />

Parties exchange written notificati<strong>on</strong> that any necessary<br />

domestic procedures for the entry into force <str<strong>on</strong>g>of</str<strong>on</strong>g> this<br />

MOU have been completed, or after such other period<br />

as the Parties may agree in the written notificati<strong>on</strong>, and<br />

shall remain in force until terminati<strong>on</strong>.<br />

2. Either Party may terminate this MOU by giving six<br />

m<strong>on</strong>ths’ written notice <str<strong>on</strong>g>of</str<strong>on</strong>g> terminati<strong>on</strong> to the other Party.<br />

The terminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this MOU shall not affect the validity<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> any arrangements already made under this MOU.<br />

3. This MOU shall apply equally to any successor bodies<br />

or agencies <str<strong>on</strong>g>of</str<strong>on</strong>g> the <strong>Labour</strong> Department <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Government <str<strong>on</strong>g>of</str<strong>on</strong>g> the H<strong>on</strong>g K<strong>on</strong>g Special Administrative<br />

Regi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the People’s Republic <str<strong>on</strong>g>of</str<strong>on</strong>g> China and the<br />

Department <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Labour</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> New Zealand.<br />

IN WITNESS WHEREOF, the undersigned, being duly<br />

authorised by their respective Governments, have signed this<br />

MOU.<br />

D<strong>on</strong>e in duplicate at H<strong>on</strong>g K<strong>on</strong>g and Wellingt<strong>on</strong><br />

<strong>on</strong> the dates indicated, in the English language.<br />
