須 知 事 項
Note
1 「 工 作 經 驗 學 員 」 學 生 身 份 確 認 書 ( 下 稱 「 確 認 書 」) 適 用 於 以 工 作 經 驗 學 員 身 份 與 其 僱 主 在 僱 傭 合 約
期 內 , 協 議 一 段 為 期 最 長 連 續 59 天 獲 豁 免 學 生 僱 用 期 的 學 生 。 根 據 《 最 低 工 資 條 例 》( 第 608 章 ),「 工
作 經 驗 學 員 」 是 指 :

(a) 修 讀 經 評 審 課 程 的 學 生 ; 或
2
(b) 居 於 香 港 , 並 修 讀 非 本 地 教 育 課 程 的 學 生 ,
而 該 學 生 正 根 據 某 僱 傭 合 約 受 聘 , 且 在 該 合 約 開 始 時 , 仍 未 滿 26 歲 。
The Confirmation of student status for “work experience student” (“Confirmation”) applies to a work
experience student who agrees with his employer to treat a continuous period of up to 59 days during the
contract of employment as a period of exempt student employment. Under the Minimum Wage Ordinance
(Cap. 608), “work experience student” means a student who:
(a) is enrolled in an accredited programme 1 ; or
(b) is resident in Hong Kong and enrolled in a non-local education programme 2 ,
and who is engaged under a contract of employment at the beginning of which he is under the age of 26 years.

備 存 教 育 機 構 發 出 的 文 件 或 其 副 本 , 以 顯 示 該 工 作 經 驗 學 員 於 有 關 獲 豁 免 學 生 僱 用 期 開 始 時 , 正 修 讀 該
教 育 機 構 提 供 的 課 程 ( 該 課 程 屬 《 最 低 工 資 條 例 》 第 2 條 中 「 工 作 經 驗 學 員 」 的 定 義 所 涵 蓋 的 類 別 )。 本
確 認 書 樣 本 供 教 育 機 構 參 考 , 以 確 認 學 生 僱 員 正 修 讀 該 教 育 機 構 提 供 , 並 屬 《 最 低 工 資 條 例 》 中 「 工 作
經 驗 學 員 」 的 定 義 所 涵 蓋 的 課 程 類 別 。 如 僱 主 對 學 生 僱 員 是 否 正 修 讀 有 關 課 程 有 任 何 疑 問 , 應 向 有 關 的
教 育 機 構 查 詢 , 以 免 違 反 豁 免 安 排 的 規 定 。 同 時 , 學 生 僱 員 如 在 獲 豁 免 學 生 僱 用 期 內 修 畢 或 終 止 修 讀 有
關 課 程 , 亦 應 盡 快 通 知 僱 主 。
Statutory Minimum Wage does not apply to a work experience student during a period of exempt student
employment. Under the Employment Ordinance (Cap. 57), the employer shall keep a document (or copy of a
document) issued by an education institution showing that the work experience student is at the
commencement of the employment enrolled in a programme being provided by the education institution that is
of a kind covered by the definition of “work experience student” in section 2 of the Minimum Wage Ordinance.
This Specimen Confirmation is for education institutions’ reference in confirming that the student employee is
enrolled in a programme being provided by the education institution that is of a kind covered by the definition
of “work experience student” in the Minimum Wage Ordinance. The employer should approach the
education institution concerned for enquiries if there is doubt as to whether the student employee is enrolled in
a programme that complies with the exemption conditions. At the same time, the student employee should
inform the employer as soon as possible when he is no longer enrolled in the programme during the period of
exempt student employment.
3 香 港 特 別 行 政 區 政 府 勞 工 處 的 執 法 人 員 會 前 往 不 同 的 工 作 地 點 視 察 , 以 確 保 僱 主 遵 行 由 勞 工 處 負 責 執 行
的 法 例 。 如 有 需 要 , 僱 用 工 作 經 驗 學 員 的 僱 主 須 根 據 《 僱 傭 條 例 》 的 要 求 , 出 示 僱 員 的 資 料 及 紀 錄 , 包
括 確 認 書 ( 如 適 用 ), 以 供 查 閱 。 若 有 關 的 獲 豁 免 學 生 僱 用 涉 嫌 違 反 相 關 法 例 的 要 求 , 確 認 書 所 載 的 資
料 會 被 勞 工 處 用 作 執 法 之 用 , 勞 工 處 亦 可 能 將 有 關 資 料 轉 交 其 他 政 府 部 門 及 機 關 , 作 進 一 步 調 查 。 有 關
政 府 部 門 及 機 關 或 會 就 確 認 書 內 的 工 作 經 驗 學 員 資 料 , 向 相 關 教 育 機 構 查 詢 。
Public officers of the Labour Department (LD) of the Government of the Hong Kong Special Administrative
Region conduct inspection visits to places of employment to ensure employers’ compliance with ordinances
administered by the LD. Employers taking on work experience students are required under the Employment
Ordinance to provide employees’ information and records, including the Confirmation (if applicable), for
inspection by public officers of the LD when necessary. Should there be any suspected contravention of any
relevant ordinances in connection with the concerned exempt student employment, the information provided in
the Confirmation may be used by the LD for law enforcement purpose. The LD may also transfer the
information to relevant government departments and authorities for further investigation. Government
departments and authorities may contact the education institution concerned to enquire about the information
on the work experience student as provided in the Confirmation.

The Minimum Wage Ordinance provides that “accredited programme” means a full-time programme that:
(a) is provided by an education institution specified in Schedule 1 (see the list on next page);
(b) is a learning programme of a kind described in section 1, 2 or 3 of Schedule 3 to the Accreditation of Academic and Vocational Qualifications
Ordinance (Cap. 592); and
(c) if provided by a school registered or provisionally registered under the Education Ordinance (Cap. 279), is at the level of post secondary education
(within the meaning of that Ordinance).
