1 Q. So if Mr. Lipsitz previously testified that
2 you and Mr. Lipsitz and Mr. Tonacchio were out for
3 dinner at the Capital Grille in Fort Lauderdale, along
4 with Mr. Picou and that you approached Mr. Lipsitz
5 regarding helping Mr. Picou with the money situation,
6 would that comport with your recollection?
7 A. Yes.
8 Q. Does that help refresh your recollection at
9 all?
10 A. I recall Mr. Picou needing cash. I recall
11 that we did not have cash in the firm or in the Ponzi
12 scheme sufficient to assist him. I pitched it to
13 Mr. Lipsitz and ultimately to Mr. Tonacchio as a
14 friendly loan. They did not know the real reason that
15 Mr. Picou needed the money.
16 Q. Earlier I think you've testified about
17 before there was a settlement agreement related Ponzi
18 scheme going on, there was a sort of I think what
19 we've referred to generally as a bridge loan scheme;
20 is that correct?
21 A. Yes, sir.
22 Q. Was this initial deal regarding Mr. Picou,
23 was that part of that bridge loan scheme?
24 A. No, because the bridge loan that you are
25 referring to was a methodology that I created to
