PRESIDENT’S MESSAGE<br />

Rolling out a ‘New<br />

Professional Image’<br />

It is with some reservation that I write this<br />

month’s President’s message because I<br />

know some members will not fully agree<br />

with my views, while others will reject<br />

them outright and will seek to tell me so<br />

directly.<br />

Notwithstanding, I don’t shy away from<br />

my firm view that the revised appearance<br />

standards for police members that<br />

commenced at the start of this month<br />

is a very positive and long-overdue<br />

step forward.<br />

Despite some negative reaction, I’m<br />

confident, based on many conversations I’ve<br />

had with members of all ranks from a broad<br />

cross-section of areas in the Force, the<br />

overwhelming majority of members agree<br />

with me in welcoming a return to a more<br />

professional image.<br />

Moreover, I’m confident that this view is<br />

largely shared by the community we serve<br />

and protect.<br />

<strong>The</strong> Uniform<br />

<strong>The</strong> new ‘American’ style uniform that’s<br />

set to be rolled out later this year has been<br />

described as having a "more authoritative<br />

punch" that will toughen up our image.<br />

Although I personally like the look of the new<br />

uniform, I don’t think it is the colour that<br />

makes the difference.<br />

Ultimately it is how members carry and<br />

present themselves that determines<br />

authority and respect.<br />

<strong>The</strong> uniform has seen a number of changes<br />

over the years from the replacement of the<br />

old round helmet to the flat top hat in 1947,<br />

to the complete overhaul in 1979 when the<br />

colour went from almost black to the blue<br />

we now know.<br />

<strong>The</strong> current uniform and dress standards<br />

have been allowed to slowly slip to the<br />

point where sometimes it’s hard to tell the<br />

difference between the police at the scene<br />

of an incident from the council worker. It’s<br />

about time we improved our professional<br />

image by standing out from the crowd<br />

as what we should be, well presented,<br />

uniformed, proud members of the Force who<br />

look and act the part.<br />

<strong>The</strong> <strong>Association</strong> and the membership have<br />

been involved in the consultation process for<br />

the new uniform and look forward to its full<br />

implementation in due course.<br />

Appearance standards<br />

For some members this is a little more<br />

controversial, however the feeling I get from<br />

the greater membership is that they largely<br />

support the changes that have been made.<br />

Some have expressed doubts over the Chief<br />

Commissioner’s authority to make such<br />

changes.<br />

<strong>The</strong> <strong>Association</strong>’s legal advice in this regard<br />

is clear - the Chief Commissioner does have<br />

the authority to make the changes to policy<br />

about grooming and accessories under<br />

relevant legislation.<br />

Some have suggested that directing<br />

members to be clean shaven and to<br />

maintain a certain hair length and style<br />

breaches discrimination laws.<br />

Again, our legal advice is that the <strong>Victoria</strong><br />

<strong>Police</strong> Force has reasonable arguments<br />

to defend any claim that the changes are<br />

discriminatory.<br />

I am sure you have all read the proposed<br />

changes to the appearance standards and<br />

I don’t need to repeat them here, other<br />

than to say I believe they will assist the<br />

<strong>Victoria</strong> <strong>Police</strong> Force in portraying the more<br />

professional image that many members and<br />

the wider public have been advocating for<br />

many years.<br />

<strong>2012</strong><br />

As you read this many of you will have<br />

returned to work after having a welldeserved<br />

Christmas break or alternatively<br />

you might be packing up the car for a family<br />

holiday before having to get the kids back to<br />

school.<br />

No matter what your situation is, I hope you<br />

had a safe and enjoyable Christmas with<br />

family and friends.<br />

<strong>The</strong> 23rd of <strong>January</strong> <strong>2012</strong> begins the Chinese<br />

New Year − the year of the Dragon.<br />

In Chinese mythology, the Dragon<br />

symbolises success and happiness.<br />

However, I am not too sure that having the<br />

head of an ox, muzzle of a donkey, eyes of<br />

a shrimp, horns of a deer, body of a serpent<br />

covered with fish scales, and feet of a<br />

phoenix would make you all that happy.<br />

Having said that, I wish you all every success,<br />

both personally and professionally, and most<br />

of all stay happy.<br />

SECRETARY’S MESSAGE<br />

Gearing up for a<br />

year of consolidation<br />

I<br />

wish every member a happy and<br />

prosperous New Year and I trust the<br />

"festive season" was an enjoyable and<br />

pleasant time for all of you, including<br />

those who continued to protect <strong>Victoria</strong>ns<br />

at all times of the day and night throughout<br />

that period.<br />

This edition of the Journal is, basically,<br />

a directory for members. We have tried to<br />

put faces to the names of all of our people,<br />

with whom you may speak when you<br />

contact our office.<br />

<strong>The</strong>re is a complete list of Delegates,<br />

including their photographs, and a full list of<br />

Assistant Delegates, so that every member<br />

can recognise their local representatives.<br />

<strong>The</strong>re is also a short "bio" on each of your<br />

Executive Members, which is designed to<br />

give you a closer look at the balance and<br />

wide range of policing experience of your<br />

Executive.<br />

Of the 12 Executive Members, six are<br />

uniform members, four are detectives and<br />

two are Highway Patrol members. <strong>The</strong>re<br />

are five senior sergeants, five sergeants<br />

and two senior constables; ten males and<br />

two females. One member is based in the<br />

Latrobe Valley, one on the Mornington<br />

Peninsular and two work in the Geelong<br />

area. <strong>The</strong> remainder are based in the<br />

Metropolitan area.<br />

That’s a diverse mix, in anyone’s language -<br />

and that has to be good.<br />

As far as the <strong>Association</strong> is concerned (and<br />

without the assistance of a crystal ball) <strong>2012</strong><br />

will be a year for consolidation, building and<br />

planning for the future.<br />

We need to consolidate and build on the<br />

achievements of recent times, on your<br />

behalf.<br />

As there always is, we expect there will be<br />

a number of EB implementation issues to<br />

address although, given the planning and<br />

the spirit in which the negotiations were<br />

conducted with the Force, we believe the<br />

issues will be fewer than usual.<br />

Naturally, we understand that for those<br />

members who are affected by those issues,<br />

they will be of major personal concern. We<br />

will tackle them in that knowledge.<br />

We will be building on the gains made in the<br />

area of police numbers, by ensuring that we<br />

keep a close eye on Force numbers as we<br />

head through the Parliamentary election<br />

cycle. While we’re all (including most of the<br />

community) very grateful for the additional<br />

numbers, we equally all know that the extra<br />

1,700 personnel will still leave us well behind<br />

the national average of police to population<br />

ratios. A population increase of 82,000 last<br />

year won’t help that <strong>Victoria</strong>n average.<br />

That means there is a whole lot of work to<br />

be done in the lead-up to the next election.<br />

We will need to provide the contemporary<br />

data and persuasive argument to, and seek<br />

public undertakings from, all sides of politics<br />

on the medium to long-term police numbers<br />

issue. We simply cannot be allowed to<br />

return to the parlous levels we were at,<br />

before we’re even out of the woods.<br />

Obviously, if Government meets its’ target<br />

of 1,700 additional police and 940 PSOs, we<br />

will need to be in a position to maintain and<br />

increase our service provision to members,<br />

as the size of that membership increases.<br />

We have already increased the numbers in<br />

our Industrial Relations area and we have<br />

purchased one additional holiday home<br />

(which is yet to ‘settle’) but there are many<br />

other aspects of our future business that<br />

need to be addressed.<br />

So, after record recruiting announcements<br />

and a pay deal that is unsurpassed in any<br />

other Australasian police jurisdiction in the<br />

current round of bargaining, there is still<br />

much to do.<br />

And it is work that we will do in the course<br />

of this year, with the best interests of all<br />

members as our Number one priority.<br />

What are your rights,<br />

obligations and options<br />

if you’ve been overpaid?<br />

When members are advised they’ve been overpaid,<br />

it is often a source of anxiety.<br />

This anxiety is exacerbated when<br />

they’re also told they’ll have<br />

to pay back the overpayment<br />

without any proper consultation<br />

or opportunity to choose a<br />

repayment option that suits them.<br />

From the outset, members must not<br />

be under any illusion when it comes to<br />

overpayments - they must be repaid but<br />

only once you have agreed on a suitable<br />

repayment option with the Force.<br />

While the obligation to repay overpaid<br />

money is beyond dispute, members should<br />

be aware that in this situation they do have<br />

certain rights and options.<br />

Recently, <strong>The</strong> <strong>Police</strong> <strong>Association</strong> has<br />

successfully intervened in a number of cases<br />

where the <strong>Victoria</strong> <strong>Police</strong> Force had sought<br />

to deduct repayments from the salary of<br />

members who had been overpaid without<br />

them being afforded their rights.<br />

Such cases have served to highlight the lack<br />

of awareness on the part of both members<br />

and the employer with respect to their<br />

respective rights and obligations whenever<br />

members have been overpaid.<br />

When it comes to the recovery of salary<br />

overpayments, these rights and obligations<br />

are clearly set out in the new 2011<br />

Enterprise Agreement (the Agreement).<br />

<strong>The</strong>se are all underpinned by a key principle.<br />

That being that the employer has no<br />

unilateral right to recover money from<br />

members who have been overpaid unless<br />

they have first notified the member of an<br />

overpayment.<br />

Failing to do this is a clear breach of the Fair<br />

Work Act and the Agreement.<br />

What rights are afforded to members<br />

when they’ve been overpaid?<br />

While there is an obvious legal obligation on<br />

the part of a member who has been overpaid<br />

to pay back the overpaid sum, the Agreement<br />

affords to them the following rights:<br />

> > <strong>The</strong> Force must advise the member in the<br />

event that they become aware that an<br />

overpayment of salary, allowance or other<br />

payment has occurred. This right cuts<br />

both ways, in that the member is obliged<br />

to notify the Force if they believe they’ve<br />

been overpaid.<br />

> > Where an overpayment has occurred, the<br />

member has to repay the overpayment<br />

through a mutually agreed process.<br />

> > <strong>The</strong> member must receive written<br />

> > If the member cannot immediately repay<br />

the full amount or disputes the overpaid<br />

amount advised by the employer then<br />

discussions must be held between the<br />

member and the Force to resolve any<br />

points of dispute.<br />

> > <strong>The</strong> Force will not make deductions from<br />

wages without written agreement from<br />

the member in relation to the sum of<br />

money to be deducted from their pay<br />

and how frequently these deductions<br />

will occur.<br />

> > Under no circumstances can the<br />

deductions result in the member being<br />

paid less than the Federal Minimum<br />

Wage during the period in which the<br />

deductions occur.<br />

What should you do if you’ve been<br />

overpaid?<br />

If members are notified of an overpayment<br />

by the Force, whether it is for salary or<br />

allowances, you should take the following<br />

action:<br />

> > Firstly, check what the overpayment was<br />

for and that is has actually occurred.<br />

> > Make sure the calculations are correct<br />

so that you know exactly how much you<br />

need to repay.<br />

> > Enter into discussions with the Force to<br />

agree on the best repayment option to<br />

suit your financial circumstances.<br />

<strong>The</strong>re are a few different methods of<br />

repayment that members can choose<br />

from depending on their financial situation,<br />

including a lump sum payment or<br />

repayment by instalments.<br />

It is important to note that members have<br />

a month, from the date they are notified, to<br />

negotiate a repayment plan with the Force.<br />

If the member is proposing a repayment<br />

schedule that will take a significant amount<br />

of time to clear the debt (i.e. longer than a<br />

year), they may be required to disclose their<br />

financial circumstances to the Force.<br />

Can your obligation to pay back<br />

overpaid money be waived?<br />

Members should be aware that you can<br />

apply to waive your obligation to pay back<br />

overpaid money should you find yourself in<br />

difficult financial circumstances.<br />

Recently the <strong>Association</strong> has had some<br />

successful outcomes where the Minister has<br />

waived the recovery of an overpayment for<br />

members on compassionate grounds.<br />

Any application to the Minister must include<br />

a full disclosure of the members’ financial<br />

situation. We strongly recommend members<br />

seeking to pursue this course to contact the<br />

<strong>Association</strong> in the first instance.<br />

<strong>The</strong> challenges of reporting<br />

crime to the masses<br />

To our members, the media is very often a friend and occasionally a foe, but as<br />

Dan Ziffer reports, the relentless 24-hour news cycle creates pressures on police<br />

reporters which police members would relate to.<br />

<strong>Victoria</strong>’s most prominent police<br />

reporters aren’t sworn and don’t<br />

carry guns, but find themselves an<br />

essential link between the community and<br />

the law.<br />

"Nothing quite captures the public<br />

imagination like cops and robbers," said<br />

Brendan Roberts of National Nine News.<br />

"It’s so far away from people’s experience of<br />

life that it’s fascinating − look at Underbelly,<br />

films, all that".<br />

<strong>The</strong> people who report about police, crime<br />

and punishment don’t know what any given<br />

day will bring. And they love it.<br />

"We’re first responders too, in a way," said<br />

Lisa Maksimovic from ABC TV. "Sometimes<br />

the chief of staff will call: ‘Get out of bed,<br />

there’s a plane crash in Horsham. <strong>The</strong><br />

cameraman will be at your house in 10<br />

minutes’. For me, that’s the really thrilling<br />

part of the job. It happens and you’ve<br />

got to be somewhere. It’s dangerous, it’s<br />

developing and you’re there".<br />

Candice Wyatt of Ten News said the job was<br />

ridiculously unpredictable.<br />

"That’s an understatement," she said. "You<br />

never know what you’re doing".<br />

<strong>The</strong> reporters all detail a lifestyle surprisingly<br />

akin to many members: they respond to<br />

events − both ordinary and horrific − and try<br />

to file an accurate report.<br />

"I never over-estimate how important<br />

we are," says Seven News police reporter<br />

Cameron Baud. "Every time there’s a missing<br />

person or a suspect the media can be a<br />

massive help, but we’re not on the front line<br />

or doing the work that police do".<br />

Even though there’s no ‘average’ day, all tell<br />

the Journal about familiar routines.<br />

Most start around 6am, checking overnight<br />

reports and preparing any breaking news<br />

for the breakfast programs. ("You can be on<br />

national TV within the hour," Baud said.)<br />

Reporters will then head into the office, calling<br />

their contacts to follow up stories and chase<br />

new leads. <strong>The</strong>n there are frequent press<br />

conferences at the <strong>Victoria</strong> <strong>Police</strong> Centre and<br />

preparation for the evening’s bulletin.<br />

"Or all of a sudden there’ll be a shooting in<br />

Brunswick or something and for the next<br />

few hours you’ll be on the spot, trying to<br />

gather information," Roberts said.<br />

"I’m too disorganised to have an overnight<br />

bag packed, but I should. You find yourself<br />

in some far-out country destination with no<br />

toothbrush or change of clothing, wondering<br />

how you’re going to the cross for the<br />

breakfast show."<br />

Reporters often meet people on the worst<br />

day of their lives: flung into prominence<br />

through violence, notoriety or bad luck.<br />

Maksimovic said that the "death knock" was<br />

a moment every journalist dreaded.<br />

"You have every kind of reaction," she said.<br />

After a group of teenagers were killed in<br />

a car crash, the grandfather of one victim<br />

collapsed on her, weeping.<br />

"That’s terribly upsetting," she said.<br />

"<strong>The</strong>n I knock on another door and<br />

they’re incredibly hostile. All you can<br />

do is − with sincerity − report on that<br />

family with as much sensitivity as you<br />

can. <strong>The</strong> day you don’t get upset by<br />

something like that ... maybe you need<br />

to call it quits".<br />

<strong>The</strong> reporters are constantly interacting<br />

with members, from Constables to the Chief<br />

Commissioner. Understandably, they react<br />

to reporters in different ways.<br />

"Some police are more than willing to engage<br />

you and inform you on what’s taken place,<br />

and I really appreciate that," said Baud.<br />

"You’re trying to get something correct and<br />

accurate, and I think that’s only positive for<br />

all those involved".<br />

Maksimovic agreed, adding: "Particularly<br />

in country areas they’re happier to speak<br />

to you, they’re good at interacting with<br />

people in the bush".<br />

For Roberts, the best members to find<br />

at a scene are people you already know.<br />

"Someone I’ve got a relationship with," he<br />

said. "Preferably someone I’ve spent many<br />

beers with".

Executive<br />

<strong>The</strong> <strong>Police</strong> <strong>Association</strong> is governed by<br />

an Executive of 12 people, which is<br />

required to manage the <strong>Association</strong><br />

on behalf of the membership.<br />

<strong>The</strong> key role of the elected Executive is to set <strong>Association</strong> policy<br />

for the betterment of the entire membership.<br />

<strong>The</strong> processes by which the Executive is elected are detailed<br />

in <strong>The</strong> <strong>Police</strong> <strong>Association</strong> Constitution. Executive members are<br />

elected for a term of three years and four Executive members<br />

are up for re-election each year. <strong>The</strong>se are your current elected<br />

Executive members.<br />

Phil Pearson<br />

President<br />

Phil Pearson was first elected to the Executive in 2003 after a nine year period<br />

as a delegate. Phil joined the Force in 1975 and has worked his entire career at<br />

busy police stations including Flemington, Ascot Vale Crime Cars,<br />

Broadmeadows, Coburg and Fawkner. Phil commenced his tenure as President<br />

of <strong>The</strong> <strong>Police</strong> <strong>Association</strong> in October 2011.<br />

John Laird<br />

Senior<br />

Vice-President<br />

John Laird is a Senior Sergeant stationed at South Melbourne CIU. He has been<br />

a member of the Force for 31 years and has broad operational experience at<br />

inner city stations and CIUs including City West, Northcote, Carlton, Prahran<br />

and Fitzroy. John has served as an <strong>Association</strong> Delegate and joined the<br />

Executive in 2005.<br />

Paul O’Connell<br />

Junior Vice-President<br />

Paul O’Connell has been an operational police officer for the entirety of his 23<br />

years service, working at a variety of general duties stations, CIU and the Crime<br />

Dept. He is currently a Sergeant at Moreland CIU. Paul is married with two<br />

children and has been a member of the <strong>Victoria</strong> <strong>Police</strong> since 1988. Prior to<br />

becoming a member of the Executive in September 2006, Paul often advocated<br />

for members who had applied for legal assistance.<br />

Dean Anderson<br />

Dean Anderson joined <strong>Victoria</strong> <strong>Police</strong> Force in 2001 and has been operational his<br />

entire career. He is a Senior Constable currently stationed at the Transit Safety<br />

Division and was elected to the Executive in October 2010. During his career,<br />

Dean has worked at the Melbourne East <strong>Police</strong> Station, City Patrol Group, the<br />

Drug Squad, Melbourne TMU, and completed the CIRT course in 2007.<br />

Colin Birch<br />

Colin Birch is a Sergeant at Geelong Crime Scene Services. He joined the <strong>Victoria</strong><br />

<strong>Police</strong> Force in 1988. He has served at various uniform stations and CIU offices<br />

throughout the CBD, western suburbs and Geelong as well as duties at the<br />

Security Intelligence Ground and AFP-JCTT. Colin was elected to the Executive<br />

in 2010.<br />

Dean Thomas<br />

Dean Thomas is a Detective Senior Sergeant and the Officer in Charge at the<br />

LaTrobe CIU. He was elected to the Executive in October 2004. Dean has<br />

previously performed duty at the Homicide Squad, Lorimer Task Force,<br />

Dandenong CIU, Springvale CIU, Prahran CIU, St Kilda, Dandenong and Footscray<br />

<strong>Police</strong> Stations and the Morwell Regional Response Unit.<br />

Karl David APM<br />

Treasurer<br />

Karl David APM is a Sergeant stationed at Frankston. He joined the Force in<br />

1988 has been a uniformed operational member for 23 years and has broad<br />

experience of policing in inner city, suburban and country areas. He was elected<br />

to the Executive in March 2005.<br />

Dermot Avon<br />

Assistant Treasurer<br />

Dermot Avon joined the Executive in 2006 and was previously an <strong>Association</strong><br />

Delegate. He is a Senior Sergeant at Prahran <strong>Police</strong> Station. He has worked at<br />

Collingwood, Footscray, St. Kilda, South Melbourne, and San Remo <strong>Police</strong><br />

Stations, Russell Street and City West CIB, the Arson squad, Security Intelligence<br />

Group and the Properties Branch.<br />

Di Wilson<br />

PFA Delegate<br />

Diane Wilson is Senior Sergeant and the Officer in Charge of Glen Waverley<br />

<strong>Police</strong> Station. She joined <strong>Victoria</strong> <strong>Police</strong> in 1986 and has worked at both general<br />

duties and the CIU. She has broad operational experience having worked at<br />

stations including Russell Street, Richmond, Northcote, Preston, Camberwell,<br />

Boroondara, Nunawading along with the Crime Dept and Caulfield CIU. She was<br />

first elected to the Executive in September 2007 and re-elected in 2011.<br />

Mark Rose<br />

Mark Rose is a Sergeant at Melbourne HWP. He has been a member of the<br />

Force since 1993 and has been stationed at Carlton, Richmond, Melbourne East,<br />

Melbourne West, St Kilda Road, Melbourne TMU, Wyndham TMU and Werribee.<br />

He joined the <strong>Victoria</strong> <strong>Police</strong> Force in 1993 and was elected to the Executive<br />

in 2006.<br />

Brigette De Chirico<br />

Brigette De Chirico is a Detective Senior Constable at Yarra Ranges CIU. She has<br />

had 17 years of operational service at various inner-city and outer-east<br />

stations. Brigette has previously served as an <strong>Association</strong> Assistant and<br />

Delegate since 2007 and was elected to the Executive in 2011.<br />

Maurie Banks<br />

Maurie Banks is a Leading Senior Constable at Geelong Highway Patrol. He has<br />

39 years of operational experience starting in the western suburbs but has<br />

been with Highway Patrol since 1978. Maurie served as an <strong>Association</strong> Delegate<br />

for four years since 2007 and was elected to the Executive in 2011.<br />

Top-level OPI exits speak volumes<br />

as corruption body collapses<br />

Last month, just days before<br />

the state government<br />

introduced legislation to<br />

set up a new independent,<br />

broad-based anti-corruption<br />

commission, two of the most<br />

senior officers from the<br />

body which the new IBAC<br />

will replace announced their<br />

intention to call it quits.<br />

Against this background,<br />

the Herald Sun newspaper<br />

invited, <strong>Police</strong> <strong>Association</strong><br />

Secretary, Greg Davies to<br />

provide his assessment<br />

of the OPI’s short, but<br />

controversial, history.<br />

Greg’s opinion piece was<br />

published in the paper’s 3<br />

December 2011 edition and<br />

is re-produced below:<br />

<strong>The</strong> announcements from<br />

Michael Strong, Director <strong>Police</strong><br />

Integrity, and his deputy, Paul<br />

Jevtcovic, prove something is badly amiss<br />

at the OPI.<br />

Why have the two senior people left<br />

prematurely?<br />

<strong>The</strong> Government has apparently advised<br />

Mr. Strong that there will be no place for<br />

him at the proposed IBAC, to be established<br />

"some time" in <strong>2012</strong>.<br />

It’s an announcement that would not<br />

surprise many and it should not have<br />

surprised Mr. Strong. Governments don’t<br />

do away with anti-corruption bodies, and<br />

replace them with something that’s hoped<br />

will be better, if they are happy with their<br />

performance and that of its’ head.<br />

<strong>The</strong> proposals that the IBAC Commissioner<br />

and the Deputy be required to hold<br />

qualification for appointment to the<br />

Supreme Court, rule out Mr. Jevtcovic for<br />

either of the top jobs.<br />

One can understand that, after hearing that<br />

news, Mr. Jevtcovic might jump if the right<br />

job came along any time soon. Apparently it<br />

has, and he is said to be off to the Australian<br />

Crime Commission, although it’s unknown in<br />

what capacity.<br />

Jevtcovic came to <strong>Victoria</strong> from the<br />

Australian Federal <strong>Police</strong>, and he returns to<br />

the Federal jurisdiction. It’s impossible to<br />

criticise anyone for providing for their family,<br />

yet it never ceases to amaze that anyone<br />

bitten by the "<strong>Police</strong> Corruption Bug" always<br />

seems to find a chair when the music stops<br />

− as it surely has for the OPI in <strong>Victoria</strong>.<br />

One wonders how many other OPI<br />

employees will have to follow the example<br />

of their leaders and either head interstate<br />

or retire, for surely there can be no<br />

employment for them in the new IBAC.<br />

Anyone who has followed the incompetent<br />

capers of the OPI over the years will be aware<br />

of its’ dreadful performance. Those with any<br />

detailed knowledge will harbour more than a<br />

sneaking suspicion that much or most of the<br />

first year’s work of the IBAC will involve the<br />

investigation of criminal conduct allegations<br />

against the OPI and some of its personnel.<br />

To suggest that any individual could remove<br />

their OPI Star, pin on an IBAC badge and head<br />

off to investigate serious allegations against<br />

themselves and their current or former<br />

colleagues, from that happy time when they<br />

were accountable to no-one, would surely<br />

see the opponents of ‘<strong>Police</strong> investigating<br />

<strong>Police</strong>’ swooning into their chardonnay.<br />

Serious questions remain unanswered over<br />

the OPI’s most public failures. Paul Mullett<br />

and Noel Ashby were put on a show trial and<br />

no evidence of any criminality was produced.<br />

Mullett received a nolle prosequi from the<br />

Office of Public Prosecutions and Ashby was<br />

denied his day in court because of a simple<br />

administrative blunder that a Year 11 legal<br />

studies student should have spotted.<br />

And what was the serious criminal offence<br />

alleged against either of them that allowed<br />

the OPI to obtain telephone interception<br />

warrants against them?<br />

What was the serious criminal offence said<br />

to have been committed by Sir Ken Jones, or<br />

Tristan Weston, that allowed their telephones<br />

to be intercepted under Federal Warrants?<br />

No-one knows, because never, at any time,<br />

has that offence been alleged against any<br />

of them. <strong>The</strong> appalling lack of oversight that<br />

prevents accused persons from accessing<br />

the warrants, let alone the "evidence" used to<br />

obtain them, must be rectified with the IBAC.<br />

And where are the masses of corrupt police<br />

the OPI promised to flush out? It can’t be<br />

denied that any group of 12,500 people will<br />

probably have a couple of rotten apples, but<br />

either there are none left or the OPI couldn’t<br />

find them − there is no third alternative.<br />

By contrast, if IBAC investigations are to be<br />

thorough and professionally conducted, they<br />

must be controlled by investigators − not<br />

barristers.<br />

<strong>The</strong>re are many brilliant minds among the<br />

judiciary and legal profession in <strong>Victoria</strong>,<br />

but not too many of them are trained<br />

investigators. It is folly to think that<br />

being a former judge makes for a trained<br />

investigator; no different to saying that a<br />

Detective Constable has the skills to be<br />

a Supreme Court Judge. Each has their<br />

qualities, skills and abilities but they are two<br />

entirely different fields.<br />

To mix them is like mixing oil and water −<br />

it can’t be done successfully and it will fail.<br />

It must be done properly next time.<br />

scholarships<br />

Scholarships now available for<br />

school-age children in <strong>2012</strong> and beyond<br />

Applications close 31 <strong>January</strong> <strong>2012</strong><br />

Are you a <strong>Police</strong> <strong>Association</strong> member with school-age children?<br />

If so, your child may be eligible for a <strong>Police</strong><br />

<strong>Association</strong>-funded scholarship to cover<br />

some of their education expenses in <strong>2012</strong><br />

and beyond.<br />

As we have done for many years, <strong>The</strong> <strong>Police</strong><br />

<strong>Association</strong> has again teamed up with the<br />

<strong>Victoria</strong>n Department of Education to make<br />

scholarships available to four students from<br />

<strong>Victoria</strong>n policing families.<br />

Depending on their year level your child<br />

can apply for one of three of the following<br />

available scholarships.<br />

What scholarships are available?<br />

Graham Davidson Scholarship<br />

This scholarship, valued at $600, is awarded<br />

to a student who has completed year-6 in<br />

2011. <strong>The</strong> scholarship is for a period of two<br />

years at an allowance of $300 for each year.<br />

Angela Taylor Scholarship<br />

<strong>The</strong>re are scholarships available for two<br />

students, each valued at $250. <strong>The</strong>y are<br />

awarded to students who have completed<br />

year-8 in 2011. <strong>The</strong> scholarships are<br />

awarded for one year.<br />

E C James Scholarship<br />

This scholarship, valued at $750, is<br />

awarded to a student who has completed<br />

year-9 in 2011. <strong>The</strong> scholarship is for a<br />

period of three years at an allowance of $250<br />

per year.<br />

Who can apply?<br />

To be eligible to apply, students must meet<br />

the following criteria.<br />

1. Must be a child of a current <strong>Police</strong><br />

<strong>Association</strong> member, police pensioner or<br />

police widow(er).<br />

2. Student must attend a school located<br />

in <strong>Victoria</strong> (regardless of whether it is a<br />

public or private school).<br />

3. Student must be involved in school /<br />

community activities.<br />

4. Student’s end-of-year results for 2011<br />

will also be assessed.<br />

Who determines the<br />

successful applicants?<br />

Scholarship recipients are selected by a<br />

panel from the Department of Education<br />

and Early Childhood Development having<br />

regard to the above criteria.<br />

While <strong>The</strong> <strong>Police</strong> <strong>Association</strong> fully funds<br />

these scholarships, it has no involvement in<br />

the selection process.<br />

Guidelines for members<br />

under investigation<br />

<strong>The</strong>se guidelines are intended to give you basic<br />

advice if you are going to be interviewed for a<br />

criminal or disciplinary matter.<br />

Tony Walsh > Legal Manager<br />

1. It is not intended that these guidelines<br />

provide comprehensive advice, or that<br />

they cover every possible situation.<br />

Before you are interviewed, you should<br />

carefully consider your position and<br />

seek advice from <strong>The</strong> <strong>Police</strong> <strong>Association</strong><br />

or referral to appointed solicitor for<br />

preliminary legal advice.<br />

2. It is important to note that the advice<br />

contained in this document is general in<br />

nature. Each case must be considered on<br />

its merits.<br />

3. Before any interview commences,<br />

you should always ascertain from the<br />

Ethical Standards Department or the<br />

Investigator whether you are going to<br />

be subjected to a criminal interview or a<br />

disciplinary interview.<br />

CRIMINAL MATTERS<br />

1. If you are the subject of a criminal interview,<br />

a caution pursuant to Section 464 of the<br />

Crimes Act 1958 should be administered.<br />

If that occurs, you have the same right<br />

to silence as any other member of the<br />

community. Before you abrogate that<br />

right, you should consider your alternatives<br />

carefully. It is not only a guilty person who<br />

can exercise his or her right to silence. Even<br />

an innocent person, in answering questions<br />

in a Record of Interview, can provide<br />

inconsistent answers.<br />

2. As a general rule, you should decline<br />

to answer any questions in a criminal<br />

interview, other than denying the<br />

allegation that is being made against you<br />

at the end of the caution. Your reason for<br />

refusing to answer questions should be<br />

based on legal advice. You should seek<br />

legal advice prior to any criminal interview.<br />

3. It is common for suspects in a tape<br />

recorded record of interview to read out<br />

a prepared statement at the end of the<br />

criminal caution and then decline to<br />

answer all questions put to him or her.<br />

<strong>The</strong> Assistant Commissioner for ESD<br />

has directed that this procedure will not<br />

be available to <strong>Police</strong> Officers. If a <strong>Police</strong><br />

Officer seeks to read out a prepared<br />

statement and then declines to answer<br />

all questions, the tape recording will be<br />

terminated. Serving <strong>Police</strong> Officers are<br />

the only citizens in <strong>Victoria</strong> to whom<br />

this applies.<br />

4. Often, if the subject of the complaint<br />

relates to an "on duty" incident, you may<br />

already have made a statement as part of<br />

your duties as a police officer, for inclusion<br />

in a prosecution brief of evidence. You will<br />

have made that statement voluntarily<br />

and at a time when you were not a<br />

suspect. Accordingly, such a statement<br />

may be admissible evidence against you<br />

in any event. Providing the statement is<br />

accurate, you should in this circumstance,<br />

at the end of the caution state that<br />

you have already made a statement<br />

which has been acknowledged, that the<br />

statement contains a full account of<br />

your actions, and that you do not wish<br />

to answer any further questions but rely<br />

upon your statement.<br />

5. If there is sufficient evidence to<br />

constitute a prima facie case against<br />

you, you will probably be charged<br />

regardless of whether you answer<br />

questions or not. Often, answering<br />

questions will not detract from the<br />

prima facie case that already exists,<br />

and will only put forward an opposing<br />

view. <strong>The</strong> investigating police may then<br />

consider that it is a matter for the court<br />

to determine the facts in issue. If a<br />

prima facie case exists, it is unlikely that<br />

responding to questions will alter the<br />

existing situation. Obvious examples<br />

of providing a contrary account to the<br />

principal allegation of the complainant,<br />

is admitting that you were involved in<br />

an altercation but that you were acting<br />

in self defence, or admitting that you<br />

engaged in sexual conduct with a person,<br />

but that it was fully consensual.<br />

6. If the Ethical Standards Department<br />

only charge members where there is<br />

sufficient evidence to constitute a prima<br />

facie case, exercising your right to silence<br />

and refusing to answer questions cannot<br />

provide more evidence beyond what<br />

already exists. Either there is sufficient<br />

evidence to constitute a prima facie<br />

case or there is not. Refusing to answer<br />

questions cannot provide more evidence.<br />

You should not be charged just because<br />

you have exercised your right to silence<br />

on legal advice.<br />

7. If you decide to refuse to answer<br />

questions, you should ensure that each<br />

and every question is answered "no<br />

comment". You should never answer<br />

questions on a selective basis.<br />

8. You should also remember that any person<br />

that you speak to about the circumstances<br />

surrounding an alleged offence has the<br />

capacity to make a statement to the<br />

investigators relaying the contents of your<br />

conversation. It is quite possible that<br />

the contents of the conversation may be<br />

lead against you in evidence. Accordingly,<br />

you should be cautious about talking to<br />

other people about the matter. <strong>Police</strong><br />

Officers can be compelled to make a<br />

statement about conversations they<br />

have conducted with colleagues.<br />

9. You should not participate in a reenactment<br />

or identification parade under<br />

any circumstances.


DISCIPLINARY MATTERS<br />

1. <strong>The</strong> <strong>Police</strong> Regulation Act 1958 and<br />

<strong>The</strong> <strong>Police</strong> Integrity Act 2008 empower<br />

the Director of <strong>Police</strong> Integrity and the<br />

Chief Commissioner of <strong>Police</strong>, in an<br />

investigation into a breach of discipline,<br />

to direct a member of the Force to<br />

furnish any relevant information,<br />

produce any relevant documentation or<br />

answer any relevant question.<br />

2. This coercive power can relate to<br />

investigations into what would ordinarily<br />

be considered criminal matters. In some<br />

circumstances the investigation can be<br />

conducted on a disciplinary basis if the<br />

Chief Commissioner or the Director of<br />

<strong>Police</strong> Integrity so directs.<br />

3. If you are interviewed in relation to a<br />

disciplinary offence and you are given<br />

a direction to do so under S.86Q of the<br />

<strong>Police</strong> Regulation Act 1958, or S.47(1)<br />

of <strong>The</strong> <strong>Police</strong> Integrity Act 2008, you<br />

are required to co-operate only in the<br />

above mentioned areas. You are not<br />

obliged to provide any form of bodily or<br />

forensic sample and you are not required<br />

to do anything other than "furnish<br />

any relevant information, produce any<br />

relevant documents or answer any<br />

relevant question".<br />

4. At times, the Director of <strong>Police</strong> Integrity<br />

has sought to compel a police officer<br />

to answer questions under oath for<br />

the purposes of S.47 of <strong>The</strong> <strong>Police</strong><br />

Integrity Act 2008. Legal advice obtained<br />

by <strong>The</strong> <strong>Police</strong> <strong>Association</strong> suggests that<br />

there is no lawful basis for that demand<br />

despite the Director’s opinion to the<br />

contrary.<br />

5. <strong>The</strong> powers of compulsion referred<br />

to above do not extend to interviews<br />

concerning criminal matters where a<br />

caution is administered pursuant to<br />

Section 464 of the Crimes Act 1958. If<br />

you are given a criminal caution, you<br />

have the same rights as any other<br />

citizen in the community, namely the<br />

right to decline to answer questions.<br />

6. <strong>The</strong> High Court of Australia has held<br />

that a member’s right to refuse to<br />

answer questions on the basis of<br />

self-incrimination does not apply<br />

to questions asked in an interview<br />

concerning a disciplinary offence. <strong>The</strong><br />

High Court held that it is only in a<br />

criminal investigation that a member can<br />

decline to answer questions on the basis<br />

of self-incrimination.<br />

7. A subsequent decision of the <strong>Police</strong><br />

Services Board held that a member<br />

may refuse to answer questions in a<br />

disciplinary interview if the answers<br />

to those questions could lead to the<br />

yielding of potential derivative evidence<br />

which could incriminate a member in<br />

relation to a criminal offence. Before<br />

refusing to answer questions in a<br />

disciplinary interview on that basis, you<br />

should seek legal advice, as the refusal<br />

to answer questions in a disciplinary<br />

interview will, unless justified, constitute<br />

a disciplinary offence.<br />

8. If a member has been interviewed<br />

in relation to criminal matters and a<br />

caution has been administered, he or<br />

she should not then be the subject of a<br />

disciplinary interview if the substance<br />

of the interview is the same. Before<br />

being compelled to answer questions<br />

in those circumstances, all criminal<br />

charges should have been concluded,<br />

or alternatively, the member should be<br />

told, either on tape or in writing, that any<br />

criminal matters will not be proceeded<br />

with. It would improper for the Ethical<br />

Standards Department to use the power<br />

of compulsion as a means of acquiring<br />

evidence in support of a criminal<br />

prosecution.<br />

9. You should comply with the obligation<br />

imposed upon you in a disciplinary<br />

interview unless you are justified in<br />

refusing to answer questions (which<br />

will only arise rarely). However, you<br />

should keep your answers specific to the<br />

question asked.<br />

10. Prior to any disciplinary interview<br />

commencing, members are strongly<br />

advised to contact <strong>The</strong> <strong>Police</strong> <strong>Association</strong><br />

Discipline Advocates on 9495 6899.<br />

Appropriate advice will be provided. This<br />

service is available 24 hours a day, seven<br />

days a week via the <strong>Police</strong> <strong>Association</strong>.<br />

OFFICE OF POLICE INTEGRITY<br />

1. <strong>The</strong> Office of <strong>Police</strong> Integrity was<br />

established in November 2004. <strong>The</strong><br />

Director, <strong>Police</strong> Integrity, has the power<br />

under Sections 53(1) or (2) of <strong>The</strong> <strong>Police</strong><br />

Integrity Act 2008 to summon a person<br />

to attend before the Director, <strong>Police</strong><br />

Integrity or his delegate.<br />

2. Confidentiality provisions usually apply<br />

to service of such a Summons. In such<br />

circumstances, it is a criminal offence<br />

to disclose to any person the existence<br />

of the Summons or the subject matter<br />

of the investigation to which it relates,<br />

unless the person has a "reasonable<br />

excuse". If the confidentiality provisions<br />

apply, you will be served with a Notice<br />

setting out the requirements when you<br />

receive the Summons. You are permitted<br />

to contact the <strong>Police</strong> <strong>Association</strong> only for<br />

the purpose of obtaining legal advice.<br />

3. A person served with a Summons<br />

to attend before the Director, <strong>Police</strong><br />

Integrity, may, at the discretion of<br />

the Director’s Delegate, be legally<br />

represented. <strong>The</strong> hearing can be<br />

conducted in private or in public.<br />

Pursuant to S.69 of <strong>The</strong> <strong>Police</strong> Integrity<br />

Act 2008, a person’s privilege against<br />

self-incrimination is abrogated and a<br />

person who receives a summons is not<br />

excused from answering a question,<br />

producing a document or other thing or<br />

giving information for the purposes of<br />

an investigation by the Director on the<br />

ground that the answer to the question,<br />

the production of the document or other<br />

thing or the giving of the information<br />

might tend to incriminate the person or<br />

make the person liable to a penalty.<br />

4. As a consequence of the privilege against<br />

self-incrimination being abrogated in<br />

respect of hearings before the Director<br />

or his Delegate, S.69(3) provides the<br />

protection that the answer, information,<br />

document or thing provided by the<br />

person the subject of the examination is<br />

not admissible in evidence against that<br />

person before any Court or person acting<br />

judicially, except in proceedings for:<br />

a. Perjury or giving false information; or<br />

b. A breach of discipline by a member of<br />

the force; or<br />

c. Failure to comply with a direction<br />

under section 47; or<br />

d. Failure to answer a question or<br />

produce a document or other thing<br />

that he or she was required to<br />

answer or produce or answer a<br />

summons to attend;<br />

e. Contempt of the Director<br />

5. <strong>The</strong> OPI has demonstrated that it may<br />

conduct a private hearing before a<br />

member receives a Summons to give<br />

evidence at a public examination. It<br />

should not be assumed that the totality<br />

of the evidence will be put to a member<br />

at a private examination. Experience<br />

has shown that where the OPI has<br />

decided to conduct a public examination,<br />

it will hold a private hearing where the<br />

member is examined. Evidence such as<br />

tape recorded telephone conversations<br />

or film footage of incidents is often not<br />

put to the member, but rather, shown to<br />

him or her for the first time at the public<br />

examination.<br />

6. Any member who receives a Summons<br />

to appear before the Director, <strong>Police</strong><br />

Integrity, should contact <strong>The</strong> <strong>Police</strong><br />

<strong>Association</strong> for referral to a Solicitor.<br />

General Investigative<br />

Practices<br />

1. As with any investigation undertaken<br />

into serious crimes, investigators,<br />

including those attached to ESD, have<br />

at their disposal a range of investigation<br />

tools. <strong>The</strong>se include all forms of<br />

electronic surveillance and include<br />

telephone interceptions and listening<br />

devices. However the authority to<br />

undertake these forms of surveillance<br />

is generally restricted to investigations<br />

relating to serious crimes. It is important<br />

to be mindful of the potential existence<br />

of electronic surveillance methods when<br />

dealing with suspects or witnesses<br />

who, you suppose, may be the subject<br />

of an investigation into serious criminal<br />

activity as any of your conversations that<br />

are lawfully recorded may be admitted<br />

into evidence that ultimately has the<br />

potential to cause you embarrassment.<br />

You may also be in breach of the<br />

‘Declarable <strong>Association</strong>s’ policy.<br />

2. If you are being spoken to by a<br />

member of the OPI, or the Ethical<br />

Standards Department, it should<br />

be on the basis that you are either<br />

suspected of committing a criminal<br />

offence, a disciplinary offence or you<br />

are being treated strictly as a witness.<br />

If you are being treated as a witness,<br />

you should seek an assurance from<br />

the investigating police officer that<br />

you are not suspected of involvement<br />

in the commission of an offence.<br />

<strong>The</strong>re is no such thing as an "off the<br />

record chat". You should not submit<br />

yourself to a situation where any<br />

conversation that you have with an<br />

investigating police officer is being tape<br />

recorded and your status as to whether<br />

you are a suspect or a witness has not<br />

been determined.<br />

3. If you are being treated as a witness and<br />

you are concerned that you may become a<br />

suspect, you can be compelled to make a<br />

statement as a police officer, however, you<br />

cannot be compelled in terms of what you<br />

say in your statement. If in doubt, you should<br />

insert a sentence at the commencement<br />

of the statement to the following effect:<br />

"This statement constitutes the evidence<br />

which I am prepared to give in the event<br />

that I am called as a witness in any<br />

proceedings relating to this matter. I am<br />

making this statement under direction.<br />

I do so after being informed none of the<br />

information contained in this statement<br />

shall be used in evidence against me<br />

for the purpose of any criminal or<br />

disciplinary proceedings against me".<br />

organisation has changed so much since<br />

joining in 1989 it is hardly recognisable.<br />

rather protracted coronial inquest some<br />

years ago. I will miss the camaraderie of<br />

my colleagues and being a member of the<br />

<strong>Association</strong>, which in my opinion has served<br />

obtaining leave without pay to allow me<br />

to spend a couple of years as a full-time<br />

mother. I am extremely saddened that I<br />

have been forced to resign and feel that Vic<br />

Pol are only disadvantaging themselves by<br />

forcing police women out of the job because<br />

they want to spend quality time with their<br />

children during their formative years. I am<br />

very grateful to the <strong>Association</strong> who have<br />

provided invaluable support and advice to me<br />

over the past 10 years. I hate to think what<br />

Does the ESSSuper death and disability<br />

benefit protect members for injuries<br />

sustained off duty?<br />

If you are an ESSS Defined Benefit (DB) Fund member,<br />

then the simple answer is, YES.<br />

Unlike some insurance companies<br />

who may classify police officers as<br />

‘high risk’ employees and either don’t<br />

offer cover, or include excessive premiums<br />

and exclusions, the ESS DB Fund death and<br />

disability benefit covers you 24/7 for injury,<br />

illness or death, anywhere, any time − not<br />

just when you’re are at work.<br />

<strong>The</strong>se entitlements came about with thanks<br />

to various emergency services unions,<br />

including the <strong>Victoria</strong>n <strong>Police</strong> <strong>Association</strong>,<br />

who fought long and hard to ensure that<br />

those who protect our community would<br />

also be protected by means of adequate<br />

death and disability cover through their<br />

super fund. And, as most emergency<br />

services workers are on-call even when they<br />

are off duty, it makes sense to ensure you<br />

are protected at all times.<br />

So, it’s fair to say that the ESSS DB Fund<br />

death and disability benefits have been<br />

designed with police officers in mind.<br />

How does it work?<br />

Your ESSS DB Fund membership includes<br />

death and disability benefits at no additional<br />

cost to you. <strong>The</strong> cover is based on a formula<br />

that includes your accrued benefit at the<br />

date of claim, along with a projected benefit<br />

to age 55. <strong>The</strong> amount you receive, however,<br />

is dependant on the contributions you have<br />

paid from your before or after tax salary<br />

to your ESSS DB Fund account during your<br />

membership. So, it pays to understand the<br />

relationship between contributions and how<br />

your benefits are calculated.<br />

To help you keep track of the insurance<br />

benefit payable, ESSSuper includes these<br />

details on your Annual Benefit Statement<br />

each year. When assessing if you have<br />

enough death and disability cover, you may<br />

wish to consider:<br />

> > Is additional insurance needed?<br />

How much would you need to live on<br />

if you were off work for a long period<br />

due to an injury or illness, or how much<br />

your family would need in the event of<br />

your death? It’s possible that the death<br />

and disability benefits provided by the<br />

ESSS DB Fund may not be enough to<br />

suit your needs.<br />

> > Did you join the force later in life?<br />

You may find that your death and<br />

disability benefits cover provided is less<br />

than fellow officers who joined when they<br />

were younger, as your projected service<br />

to age 55 will be less.<br />

If any of the above is relevant to you, you<br />

may wish to consider additional insurance<br />

through your Accumulation Plan account.<br />

<strong>The</strong> Accumulation Plan offers a range of<br />

insurance options including death, disability<br />

and income protection through a premium<br />

from your super balance. You can apply for<br />

as much or as little additional insurance you<br />

want to suit your needs.<br />

<strong>The</strong> Peer Support Program<br />

What is Peer Support?<br />

Peer Support is a process whereby<br />

employees, trained to recognise various<br />

signs and symptoms of stress, assist their<br />

colleagues by listening, understanding<br />

and providing appropriate referrals when<br />

necessary.<br />

<strong>The</strong> Role of Peer Support Officers<br />

Peer Support Officers are volunteers<br />

and undertake their roles in addition to<br />

normal policing duties. <strong>The</strong>y are available<br />

when rostered for duty to provide initial<br />

support, information and options to enable<br />

employees to make their own decisions<br />

about the assistance they require.<br />

Rank does not exist when a person is<br />

receiving support and no notes are taken.<br />

<strong>The</strong> role of a Peer Support Officer is to:<br />

> > offer initial support and assistance to<br />

colleagues regarding work, family and<br />

personal issues<br />

> > assess the need for critical incident<br />

stress defusing or debriefing<br />

> > make referrals to appropriate health<br />

and support services if necessary<br />

> > provide follow-up support for colleagues.<br />

<strong>The</strong> Officers are not counsellors, but they<br />

have received training in:<br />

> > managing general stress<br />

> > critical incident stress management<br />

> > communication styles<br />

> > counselling techniques<br />

> > suicide awareness<br />

> > bereavement skills<br />

> > ethics and confidentiality.<br />

Confidentiality<br />

Confidentiality is strictly maintained at<br />

all times. Peer Support Officers work in<br />

accordance with the principles and practices<br />

developed by <strong>Police</strong> Psychology.<br />

Peer Support Officers can be contacted<br />

while they are on duty. In situations where<br />

a Peer Support Officer cannot be released<br />

from operational duties, assistance can be<br />

arranged by contacting the Welfare Services<br />

Unit on 9301 6900, who will locate an<br />

appropriate Peer.<br />
