PRESIDENT’S MESSAGE
Rolling out a ‘New
Professional Image’
It is with some reservation that I write this
month’s President’s message because I
know some members will not fully agree
with my views, while others will reject
them outright and will seek to tell me so
directly.
Notwithstanding, I don’t shy away from
my firm view that the revised appearance
standards for police members that
commenced at the start of this month
is a very positive and long-overdue
step forward.
Despite some negative reaction, I’m
confident, based on many conversations I’ve
had with members of all ranks from a broad
cross-section of areas in the Force, the
overwhelming majority of members agree
with me in welcoming a return to a more
professional image.
Moreover, I’m confident that this view is
largely shared by the community we serve
and protect.
The Uniform
The new ‘American’ style uniform that’s
set to be rolled out later this year has been
described as having a "more authoritative
punch" that will toughen up our image.
Although I personally like the look of the new
uniform, I don’t think it is the colour that
makes the difference.
Ultimately it is how members carry and
present themselves that determines
authority and respect.
The uniform has seen a number of changes
over the years from the replacement of the
old round helmet to the flat top hat in 1947,
to the complete overhaul in 1979 when the
colour went from almost black to the blue
we now know.
The current uniform and dress standards
have been allowed to slowly slip to the
point where sometimes it’s hard to tell the
difference between the police at the scene
of an incident from the council worker. It’s
about time we improved our professional
image by standing out from the crowd
as what we should be, well presented,
uniformed, proud members of the Force who
look and act the part.
The Association and the membership have
been involved in the consultation process for
the new uniform and look forward to its full
implementation in due course.
Appearance standards
For some members this is a little more
controversial, however the feeling I get from
the greater membership is that they largely
support the changes that have been made.
Some have expressed doubts over the Chief
Commissioner’s authority to make such
changes.
The Association’s legal advice in this regard
is clear - the Chief Commissioner does have
the authority to make the changes to policy
about grooming and accessories under
relevant legislation.
Some have suggested that directing
members to be clean shaven and to
maintain a certain hair length and style
breaches discrimination laws.
Again, our legal advice is that the Victoria
Police Force has reasonable arguments
PHILLIP PEARSON > President
to defend any claim that the changes are
discriminatory.
I am sure you have all read the proposed
changes to the appearance standards and
I don’t need to repeat them here, other
than to say I believe they will assist the
Victoria Police Force in portraying the more
professional image that many members and
the wider public have been advocating for
many years.
2012
As you read this many of you will have
returned to work after having a welldeserved
Christmas break or alternatively
you might be packing up the car for a family
holiday before having to get the kids back to
school.
No matter what your situation is, I hope you
had a safe and enjoyable Christmas with
family and friends.
The 23rd of January 2012 begins the Chinese
New Year − the year of the Dragon.
In Chinese mythology, the Dragon
symbolises success and happiness.
However, I am not too sure that having the
head of an ox, muzzle of a donkey, eyes of
a shrimp, horns of a deer, body of a serpent
covered with fish scales, and feet of a
phoenix would make you all that happy.
Having said that, I wish you all every success,
both personally and professionally, and most
of all stay happy.
SECRETARY’S MESSAGE
Gearing up for a
year of consolidation
I
wish every member a happy and
prosperous New Year and I trust the
"festive season" was an enjoyable and
pleasant time for all of you, including
those who continued to protect Victorians
at all times of the day and night throughout
that period.
This edition of the Journal is, basically,
a directory for members. We have tried to
put faces to the names of all of our people,
with whom you may speak when you
contact our office.
There is a complete list of Delegates,
including their photographs, and a full list of
Assistant Delegates, so that every member
can recognise their local representatives.
There is also a short "bio" on each of your
Executive Members, which is designed to
give you a closer look at the balance and
wide range of policing experience of your
Executive.
Of the 12 Executive Members, six are
uniform members, four are detectives and
two are Highway Patrol members. There
are five senior sergeants, five sergeants
and two senior constables; ten males and
two females. One member is based in the
Latrobe Valley, one on the Mornington
Peninsular and two work in the Geelong
area. The remainder are based in the
Metropolitan area.
That’s a diverse mix, in anyone’s language -
and that has to be good.
As far as the Association is concerned (and
without the assistance of a crystal ball) 2012
will be a year for consolidation, building and
planning for the future.
We need to consolidate and build on the
achievements of recent times, on your
behalf.
As there always is, we expect there will be
a number of EB implementation issues to
address although, given the planning and
the spirit in which the negotiations were
conducted with the Force, we believe the
issues will be fewer than usual.
Naturally, we understand that for those
members who are affected by those issues,
they will be of major personal concern. We
will tackle them in that knowledge.
We will be building on the gains made in the
area of police numbers, by ensuring that we
keep a close eye on Force numbers as we
head through the Parliamentary election
cycle. While we’re all (including most of the
community) very grateful for the additional
numbers, we equally all know that the extra
1,700 personnel will still leave us well behind
the national average of police to population
ratios. A population increase of 82,000 last
year won’t help that Victorian average.
That means there is a whole lot of work to
be done in the lead-up to the next election.
We will need to provide the contemporary
data and persuasive argument to, and seek
public undertakings from, all sides of politics
on the medium to long-term police numbers
GREG DAVIES > SECRETARY
issue. We simply cannot be allowed to
return to the parlous levels we were at,
before we’re even out of the woods.
Obviously, if Government meets its’ target
of 1,700 additional police and 940 PSOs, we
will need to be in a position to maintain and
increase our service provision to members,
as the size of that membership increases.
We have already increased the numbers in
our Industrial Relations area and we have
purchased one additional holiday home
(which is yet to ‘settle’) but there are many
other aspects of our future business that
need to be addressed.
So, after record recruiting announcements
and a pay deal that is unsurpassed in any
other Australasian police jurisdiction in the
current round of bargaining, there is still
much to do.
And it is work that we will do in the course
of this year, with the best interests of all
members as our Number one priority.
Good luck to all for a safe and happy 2012.
IR News
What are your rights,
obligations and options
if you’ve been overpaid?
When members are advised they’ve been overpaid,
it is often a source of anxiety.
This anxiety is exacerbated when
they’re also told they’ll have
to pay back the overpayment
without any proper consultation
or opportunity to choose a
repayment option that suits them.
From the outset, members must not
be under any illusion when it comes to
overpayments - they must be repaid but
only once you have agreed on a suitable
repayment option with the Force.
While the obligation to repay overpaid
money is beyond dispute, members should
be aware that in this situation they do have
certain rights and options.
Recently, The Police Association has
successfully intervened in a number of cases
where the Victoria Police Force had sought
to deduct repayments from the salary of
members who had been overpaid without
them being afforded their rights.
Such cases have served to highlight the lack
of awareness on the part of both members
and the employer with respect to their
respective rights and obligations whenever
members have been overpaid.
When it comes to the recovery of salary
overpayments, these rights and obligations
are clearly set out in the new 2011
Enterprise Agreement (the Agreement).
These are all underpinned by a key principle.
That being that the employer has no
unilateral right to recover money from
members who have been overpaid unless
they have first notified the member of an
overpayment.
Failing to do this is a clear breach of the Fair
Work Act and the Agreement.
What rights are afforded to members
when they’ve been overpaid?
While there is an obvious legal obligation on
the part of a member who has been overpaid
to pay back the overpaid sum, the Agreement
affords to them the following rights:
> > The Force must advise the member in the
event that they become aware that an
overpayment of salary, allowance or other
payment has occurred. This right cuts
both ways, in that the member is obliged
to notify the Force if they believe they’ve
been overpaid.
> > Where an overpayment has occurred, the
member has to repay the overpayment
through a mutually agreed process.
> > The member must receive written
notification that they’ve been overpaid
including details of the overpayment.
> > If the member cannot immediately repay
the full amount or disputes the overpaid
amount advised by the employer then
discussions must be held between the
member and the Force to resolve any
points of dispute.
> > The Force will not make deductions from
wages without written agreement from
the member in relation to the sum of
money to be deducted from their pay
and how frequently these deductions
will occur.
> > Under no circumstances can the
deductions result in the member being
paid less than the Federal Minimum
Wage during the period in which the
deductions occur.
What should you do if you’ve been
overpaid?
If members are notified of an overpayment
by the Force, whether it is for salary or
allowances, you should take the following
action:
> > Firstly, check what the overpayment was
for and that is has actually occurred.
> > Make sure the calculations are correct
so that you know exactly how much you
need to repay.
> > Enter into discussions with the Force to
agree on the best repayment option to
suit your financial circumstances.
Chris Kennedy >
There are a few different methods of
repayment that members can choose
from depending on their financial situation,
including a lump sum payment or
repayment by instalments.
It is important to note that members have
a month, from the date they are notified, to
negotiate a repayment plan with the Force.
If the member is proposing a repayment
schedule that will take a significant amount
of time to clear the debt (i.e. longer than a
year), they may be required to disclose their
financial circumstances to the Force.
Can your obligation to pay back
overpaid money be waived?
Members should be aware that you can
apply to waive your obligation to pay back
overpaid money should you find yourself in
difficult financial circumstances.
Recently the Association has had some
successful outcomes where the Minister has
waived the recovery of an overpayment for
members on compassionate grounds.
Any application to the Minister must include
a full disclosure of the members’ financial
situation. We strongly recommend members
seeking to pursue this course to contact the
Association in the first instance.
Further advice
Members that have been notified of an
overpayment and are unsure about their
rights and obligations or cannot come to a
mutually agreeable repayment plan with
the Force, should contact the Association’s
Industrial Relations section for advice on
Newsflash
The challenges of reporting
crime to the masses
To our members, the media is very often a friend and occasionally a foe, but as
Dan Ziffer reports, the relentless 24-hour news cycle creates pressures on police
reporters which police members would relate to.
Victoria’s most prominent police
reporters aren’t sworn and don’t
carry guns, but find themselves an
essential link between the community and
the law.
"Nothing quite captures the public
imagination like cops and robbers," said
Brendan Roberts of National Nine News.
"It’s so far away from people’s experience of
life that it’s fascinating − look at Underbelly,
films, all that".
The people who report about police, crime
and punishment don’t know what any given
day will bring. And they love it.
"We’re first responders too, in a way," said
Lisa Maksimovic from ABC TV. "Sometimes
the chief of staff will call: ‘Get out of bed,
there’s a plane crash in Horsham. The
cameraman will be at your house in 10
minutes’. For me, that’s the really thrilling
part of the job. It happens and you’ve
got to be somewhere. It’s dangerous, it’s
developing and you’re there".
Candice Wyatt of Ten News said the job was
ridiculously unpredictable.
"That’s an understatement," she said. "You
never know what you’re doing".
The reporters all detail a lifestyle surprisingly
akin to many members: they respond to
events − both ordinary and horrific − and try
to file an accurate report.
"I never over-estimate how important
we are," says Seven News police reporter
Cameron Baud. "Every time there’s a missing
person or a suspect the media can be a
massive help, but we’re not on the front line
or doing the work that police do".
Even though there’s no ‘average’ day, all tell
the Journal about familiar routines.
Most start around 6am, checking overnight
reports and preparing any breaking news
08 Protect Represent Support. www.tpav.org.au
for the breakfast programs. ("You can be on
national TV within the hour," Baud said.)
Reporters will then head into the office, calling
their contacts to follow up stories and chase
new leads. Then there are frequent press
conferences at the Victoria Police Centre and
preparation for the evening’s bulletin.
"Or all of a sudden there’ll be a shooting in
Brunswick or something and for the next
few hours you’ll be on the spot, trying to
gather information," Roberts said.
"I’m too disorganised to have an overnight
bag packed, but I should. You find yourself
in some far-out country destination with no
toothbrush or change of clothing, wondering
how you’re going to the cross for the
breakfast show."
Reporters often meet people on the worst
day of their lives: flung into prominence
through violence, notoriety or bad luck.
Maksimovic said that the "death knock" was
a moment every journalist dreaded.
"You have every kind of reaction," she said.
After a group of teenagers were killed in
a car crash, the grandfather of one victim
collapsed on her, weeping.
"That’s terribly upsetting," she said.
"Then I knock on another door and
they’re incredibly hostile. All you can
do is − with sincerity − report on that
family with as much sensitivity as you
can. The day you don’t get upset by
something like that ... maybe you need
to call it quits".
The reporters are constantly interacting
with members, from Constables to the Chief
Commissioner. Understandably, they react
to reporters in different ways.
"Some police are more than willing to engage
you and inform you on what’s taken place,
and I really appreciate that," said Baud.
"You’re trying to get something correct and
accurate, and I think that’s only positive for
all those involved".
Maksimovic agreed, adding: "Particularly
in country areas they’re happier to speak
to you, they’re good at interacting with
people in the bush".
For Roberts, the best members to find
at a scene are people you already know.
"Someone I’ve got a relationship with," he
said. "Preferably someone I’ve spent many
beers with".
CAMERON BAUD > Police Reporter, Seven News
Previous jobs: Radio cadetship, WIN News, Ten News
Worst days: "Car accidents in general, specifically two-year-old Matthew Bond, who died in Sorrento
in September when his mother accidentally ploughed into a veranda where he was sitting with his
grandfather".
Lighter moment: "Benji Veniamin had just been killed and we were at a press conference in the middle of
Rathdowne Street. I turned around and there’s Carl Williams sitting in. I told my cameraman, all the other
crews noticed and started chasing him. All you needed was the Benny Hill music".
LISA MAKSIMOVIC > Police and Emergency Services Reporter, ABC TV
Previous jobs: Police reporter at ABC Adelaide, sports and general reporter
Worst days: "Black Saturday and Cyclone Yasi. Two toddlers drowning in the River Torrens. Anything
involving children is distressing".
Lighter moments: "The Judy Moran impersonator turning up at Des Moran’s funeral. Unbelievable".
BRENDAN ROBERTS > Police Reporter, National Nine News
Previous jobs: Yarra Ranges Journal, Herald Sun
Worst days: "Any job involving a deceased child is no good, and that’s pretty often".
Lighter moment: "Having runaway driver Puneet Puneet invite me into his house for coffee and biscuits
before telling me a cat, rather than half a dozen scotches was to blame for his fatal car crash".
YVETTE GRAY > Police reporter, 3AW
Previous jobs: Leader Newspapers, WIN TV Albury
Worst days: "Darcey Freeman. We had a call to the newsroom that said, ‘I just saw someone throw a child
off the bridge’."
Lighter moment: "I did a live cross with (breakfast hosts) Ross and John at a brothel fire in South
Melbourne. They decided to challenge themselves to include as many ‘brothel jokes’ as they could ..."
CANDICE WYATT > Police reporter, Ten News
Previous jobs: Werribee Times, Seven Tasmania, ABC Radio
Worst days: "A two-year-old girl run down in the early morning. The distraught mother comes out of the
house screaming. Hopefully stories like that raise awareness for other parents".
Lighter moment: "Not lighter as such, but I don’t think that anything I do will be able to top Beaconsfield
(mine rescue). Tragic, terrible ... triumphant".
OPINION
Top-level OPI exits speak volumes
as corruption body collapses
Last month, just days before
the state government
introduced legislation to
set up a new independent,
broad-based anti-corruption
commission, two of the most
senior officers from the
body which the new IBAC
will replace announced their
intention to call it quits.
Against this background,
the Herald Sun newspaper
invited, Police Association
Secretary, Greg Davies to
provide his assessment
of the OPI’s short, but
controversial, history.
Greg’s opinion piece was
published in the paper’s 3
December 2011 edition and
is re-produced below:
The announcements from
Michael Strong, Director Police
Integrity, and his deputy, Paul
Jevtcovic, prove something is badly amiss
at the OPI.
Why have the two senior people left
prematurely?
The Government has apparently advised
Mr. Strong that there will be no place for
him at the proposed IBAC, to be established
"some time" in 2012.
It’s an announcement that would not
surprise many and it should not have
surprised Mr. Strong. Governments don’t
do away with anti-corruption bodies, and
replace them with something that’s hoped
will be better, if they are happy with their
performance and that of its’ head.
The proposals that the IBAC Commissioner
and the Deputy be required to hold
qualification for appointment to the
Supreme Court, rule out Mr. Jevtcovic for
either of the top jobs.
One can understand that, after hearing that
news, Mr. Jevtcovic might jump if the right
job came along any time soon. Apparently it
has, and he is said to be off to the Australian
Crime Commission, although it’s unknown in
what capacity.
Jevtcovic came to Victoria from the
Australian Federal Police, and he returns to
the Federal jurisdiction. It’s impossible to
criticise anyone for providing for their family,
yet it never ceases to amaze that anyone
bitten by the "Police Corruption Bug" always
seems to find a chair when the music stops
− as it surely has for the OPI in Victoria.
One wonders how many other OPI
employees will have to follow the example
of their leaders and either head interstate
or retire, for surely there can be no
employment for them in the new IBAC.
Anyone who has followed the incompetent
capers of the OPI over the years will be aware
of its’ dreadful performance. Those with any
detailed knowledge will harbour more than a
sneaking suspicion that much or most of the
first year’s work of the IBAC will involve the
investigation of criminal conduct allegations
against the OPI and some of its personnel.
To suggest that any individual could remove
their OPI Star, pin on an IBAC badge and head
off to investigate serious allegations against
themselves and their current or former
colleagues, from that happy time when they
were accountable to no-one, would surely
see the opponents of ‘Police investigating
Police’ swooning into their chardonnay.
Serious questions remain unanswered over
the OPI’s most public failures. Paul Mullett
and Noel Ashby were put on a show trial and
no evidence of any criminality was produced.
Mullett received a nolle prosequi from the
Office of Public Prosecutions and Ashby was
denied his day in court because of a simple
administrative blunder that a Year 11 legal
studies student should have spotted.
And what was the serious criminal offence
alleged against either of them that allowed
the OPI to obtain telephone interception
warrants against them?
What was the serious criminal offence said
to have been committed by Sir Ken Jones, or
Tristan Weston, that allowed their telephones
to be intercepted under Federal Warrants?
No-one knows, because never, at any time,
has that offence been alleged against any
of them. The appalling lack of oversight that
prevents accused persons from accessing
the warrants, let alone the "evidence" used to
obtain them, must be rectified with the IBAC.
And where are the masses of corrupt police
the OPI promised to flush out? It can’t be
denied that any group of 12,500 people will
probably have a couple of rotten apples, but
either there are none left or the OPI couldn’t
find them − there is no third alternative.
By contrast, if IBAC investigations are to be
thorough and professionally conducted, they
must be controlled by investigators − not
barristers.
There are many brilliant minds among the
judiciary and legal profession in Victoria,
but not too many of them are trained
investigators. It is folly to think that
being a former judge makes for a trained
investigator; no different to saying that a
Detective Constable has the skills to be
a Supreme Court Judge. Each has their
qualities, skills and abilities but they are two
entirely different fields.
To mix them is like mixing oil and water −
it can’t be done successfully and it will fail.
It must be done properly next time.
Legal News
Guidelines for members
under investigation
These guidelines are intended to give you basic
advice if you are going to be interviewed for a
criminal or disciplinary matter.
Tony Walsh > Legal Manager
1. It is not intended that these guidelines
provide comprehensive advice, or that
they cover every possible situation.
Before you are interviewed, you should
carefully consider your position and
seek advice from The Police Association
or referral to appointed solicitor for
preliminary legal advice.
2. It is important to note that the advice
contained in this document is general in
nature. Each case must be considered on
its merits.
3. Before any interview commences,
you should always ascertain from the
Ethical Standards Department or the
Investigator whether you are going to
be subjected to a criminal interview or a
disciplinary interview.
CRIMINAL MATTERS
1. If you are the subject of a criminal interview,
a caution pursuant to Section 464 of the
Crimes Act 1958 should be administered.
If that occurs, you have the same right
to silence as any other member of the
community. Before you abrogate that
right, you should consider your alternatives
carefully. It is not only a guilty person who
can exercise his or her right to silence. Even
an innocent person, in answering questions
in a Record of Interview, can provide
inconsistent answers.
2. As a general rule, you should decline
to answer any questions in a criminal
interview, other than denying the
allegation that is being made against you
at the end of the caution. Your reason for
refusing to answer questions should be
based on legal advice. You should seek
legal advice prior to any criminal interview.
3. It is common for suspects in a tape
recorded record of interview to read out
20 Protect Represent Support. www.tpav.org.au
a prepared statement at the end of the
criminal caution and then decline to
answer all questions put to him or her.
The Assistant Commissioner for ESD
has directed that this procedure will not
be available to Police Officers. If a Police
Officer seeks to read out a prepared
statement and then declines to answer
all questions, the tape recording will be
terminated. Serving Police Officers are
the only citizens in Victoria to whom
this applies.
4. Often, if the subject of the complaint
relates to an "on duty" incident, you may
already have made a statement as part of
your duties as a police officer, for inclusion
in a prosecution brief of evidence. You will
have made that statement voluntarily
and at a time when you were not a
suspect. Accordingly, such a statement
may be admissible evidence against you
in any event. Providing the statement is
accurate, you should in this circumstance,
at the end of the caution state that
you have already made a statement
which has been acknowledged, that the
statement contains a full account of
your actions, and that you do not wish
to answer any further questions but rely
upon your statement.
5. If there is sufficient evidence to
constitute a prima facie case against
you, you will probably be charged
regardless of whether you answer
questions or not. Often, answering
questions will not detract from the
prima facie case that already exists,
and will only put forward an opposing
view. The investigating police may then
consider that it is a matter for the court
to determine the facts in issue. If a
prima facie case exists, it is unlikely that
responding to questions will alter the
existing situation. Obvious examples
of providing a contrary account to the
principal allegation of the complainant,
is admitting that you were involved in
an altercation but that you were acting
in self defence, or admitting that you
engaged in sexual conduct with a person,
but that it was fully consensual.
6. If the Ethical Standards Department
only charge members where there is
sufficient evidence to constitute a prima
facie case, exercising your right to silence
and refusing to answer questions cannot
provide more evidence beyond what
already exists. Either there is sufficient
evidence to constitute a prima facie
case or there is not. Refusing to answer
questions cannot provide more evidence.
You should not be charged just because
you have exercised your right to silence
on legal advice.
7. If you decide to refuse to answer
questions, you should ensure that each
and every question is answered "no
comment". You should never answer
questions on a selective basis.
8. You should also remember that any person
that you speak to about the circumstances
surrounding an alleged offence has the
capacity to make a statement to the
investigators relaying the contents of your
conversation. It is quite possible that
the contents of the conversation may be
lead against you in evidence. Accordingly,
you should be cautious about talking to
other people about the matter. Police
Officers can be compelled to make a
statement about conversations they
have conducted with colleagues.
9. You should not participate in a reenactment
or identification parade under
any circumstances.
DISCIPLINARY MATTERS
1. The Police Regulation Act 1958 and
The Police Integrity Act 2008 empower
the Director of Police Integrity and the
Chief Commissioner of Police, in an
investigation into a breach of discipline,
to direct a member of the Force to
furnish any relevant information,
produce any relevant documentation or
answer any relevant question.
2. This coercive power can relate to
investigations into what would ordinarily
be considered criminal matters. In some
circumstances the investigation can be
conducted on a disciplinary basis if the
Chief Commissioner or the Director of
Police Integrity so directs.
3. If you are interviewed in relation to a
disciplinary offence and you are given
a direction to do so under S.86Q of the
Police Regulation Act 1958, or S.47(1)
of The Police Integrity Act 2008, you
are required to co-operate only in the
above mentioned areas. You are not
obliged to provide any form of bodily or
forensic sample and you are not required
to do anything other than "furnish
any relevant information, produce any
relevant documents or answer any
relevant question".
4. At times, the Director of Police Integrity
has sought to compel a police officer
to answer questions under oath for
the purposes of S.47 of The Police
Integrity Act 2008. Legal advice obtained
by The Police Association suggests that
there is no lawful basis for that demand
despite the Director’s opinion to the
contrary.
5. The powers of compulsion referred
to above do not extend to interviews
concerning criminal matters where a
caution is administered pursuant to
Section 464 of the Crimes Act 1958. If
you are given a criminal caution, you
have the same rights as any other
citizen in the community, namely the
right to decline to answer questions.
6. The High Court of Australia has held
that a member’s right to refuse to
answer questions on the basis of
self-incrimination does not apply
to questions asked in an interview
concerning a disciplinary offence. The
High Court held that it is only in a
criminal investigation that a member can
decline to answer questions on the basis
of self-incrimination.
7. A subsequent decision of the Police
Services Board held that a member
may refuse to answer questions in a
disciplinary interview if the answers
to those questions could lead to the
yielding of potential derivative evidence
which could incriminate a member in
relation to a criminal offence. Before
refusing to answer questions in a
disciplinary interview on that basis, you
should seek legal advice, as the refusal
to answer questions in a disciplinary
interview will, unless justified, constitute
a disciplinary offence.
8. If a member has been interviewed
in relation to criminal matters and a
caution has been administered, he or
she should not then be the subject of a
disciplinary interview if the substance
of the interview is the same. Before
being compelled to answer questions
in those circumstances, all criminal
charges should have been concluded,
or alternatively, the member should be
told, either on tape or in writing, that any
criminal matters will not be proceeded
with. It would improper for the Ethical
Standards Department to use the power
of compulsion as a means of acquiring
evidence in support of a criminal
prosecution.
9. You should comply with the obligation
imposed upon you in a disciplinary
interview unless you are justified in
refusing to answer questions (which
will only arise rarely). However, you
should keep your answers specific to the
question asked.
10. Prior to any disciplinary interview
commencing, members are strongly
advised to contact The Police Association
Discipline Advocates on 9495 6899.
Appropriate advice will be provided. This
service is available 24 hours a day, seven
days a week via the Police Association.
OFFICE OF POLICE INTEGRITY
1. The Office of Police Integrity was
established in November 2004. The
Director, Police Integrity, has the power
under Sections 53(1) or (2) of The Police
Integrity Act 2008 to summon a person
to attend before the Director, Police
Integrity or his delegate.
2. Confidentiality provisions usually apply
to service of such a Summons. In such
circumstances, it is a criminal offence
to disclose to any person the existence
of the Summons or the subject matter
of the investigation to which it relates,
unless the person has a "reasonable
excuse". If the confidentiality provisions
apply, you will be served with a Notice
setting out the requirements when you
receive the Summons. You are permitted
to contact the Police Association only for
the purpose of obtaining legal advice.
3. A person served with a Summons
to attend before the Director, Police
Integrity, may, at the discretion of
the Director’s Delegate, be legally
represented. The hearing can be
conducted in private or in public.
Pursuant to S.69 of The Police Integrity
Act 2008, a person’s privilege against
self-incrimination is abrogated and a
person who receives a summons is not
excused from answering a question,
producing a document or other thing or
giving information for the purposes of
an investigation by the Director on the
ground that the answer to the question,
the production of the document or other
thing or the giving of the information
might tend to incriminate the person or
make the person liable to a penalty.
4. As a consequence of the privilege against
self-incrimination being abrogated in
respect of hearings before the Director
or his Delegate, S.69(3) provides the
protection that the answer, information,
document or thing provided by the
person the subject of the examination is
not admissible in evidence against that
person before any Court or person acting
judicially, except in proceedings for:
a. Perjury or giving false information; or
b. A breach of discipline by a member of
the force; or
c. Failure to comply with a direction
under section 47; or
d. Failure to answer a question or
produce a document or other thing
that he or she was required to
answer or produce or answer a
summons to attend;
e. Contempt of the Director
5. The OPI has demonstrated that it may
conduct a private hearing before a
member receives a Summons to give
evidence at a public examination. It
should not be assumed that the totality
of the evidence will be put to a member
at a private examination. Experience
has shown that where the OPI has
decided to conduct a public examination,
The Police Association Victoria Journal January 2012
21
THE POLICE ASSOCIATION
it will hold a private hearing where the
member is examined. Evidence such as
tape recorded telephone conversations
or film footage of incidents is often not
put to the member, but rather, shown to
him or her for the first time at the public
examination.
6. Any member who receives a Summons
to appear before the Director, Police
Integrity, should contact The Police
Association for referral to a Solicitor.
General Investigative
Practices
1. As with any investigation undertaken
into serious crimes, investigators,
including those attached to ESD, have
at their disposal a range of investigation
tools. These include all forms of
electronic surveillance and include
telephone interceptions and listening
devices. However the authority to
undertake these forms of surveillance
is generally restricted to investigations
relating to serious crimes. It is important
to be mindful of the potential existence
of electronic surveillance methods when
dealing with suspects or witnesses
who, you suppose, may be the subject
of an investigation into serious criminal
activity as any of your conversations that
are lawfully recorded may be admitted
into evidence that ultimately has the
potential to cause you embarrassment.
You may also be in breach of the
‘Declarable Associations’ policy.
2. If you are being spoken to by a
member of the OPI, or the Ethical
Standards Department, it should
be on the basis that you are either
suspected of committing a criminal
offence, a disciplinary offence or you
are being treated strictly as a witness.
If you are being treated as a witness,
you should seek an assurance from
the investigating police officer that
you are not suspected of involvement
in the commission of an offence.
There is no such thing as an "off the
record chat". You should not submit
yourself to a situation where any
Jack Knife is the story of ex Senior Constable Paul ‘Little Jack’ Horner’s decade-long journey serving as a member of the NSW Police.
It is a book about trust, loyalty and mateship. It deals with real issues that confront police every day, physically and mentally.
‘Jack Knife contains a range of operational police stories varying between saving peoples lives to almost losing my own
and an array of stories in between. This book has been written to educate, not only serving police officers and their
families but the general public. And it is a must read for anyone who has had to deal with mental illness. This book is the
truth as to what really goes on behind the frontline of the policing world.’
Thanks
On behalf of retired Chief Inspector Gary Jose
and I, may I take this opportunity to express our
sincere appreciation to The Police Association
for your generous donation to our annual
retired member’s lunch that was held in
October at Williamstown RSL. Your donation
certainly went a long way in ensuring an
excellent day was had by all. We had 104
retired and serving members in attendance
which translated to in excess of 3000 years
of police service. We were most pleased to
have your newly appointed President, Phillip
Pearson, present and he addressed the
audience in a most enlightening manner.
Thank you to all your staff.
Peter Egan
Retired Senior Sergeant 15892
I have been on leave and out of the country
for the last six weeks. I returned to find the
result of the EB negotiations. I would like
to personally thank the Secretary and his
team for the effort and the outstanding
result of the negotiations. Whilst there are
frontline, high profile employees of TPA who
were the face of the negotiations, I not only
congratulate them, but also the support staff
behind the scenes who worked diligently on
our behalf. I can only imagine the pressure
and frustration that your team must have
experienced along the journey. Well done.
Regards
Peter Given
Senior Sergeant 17742
Please accept our grateful thanks for the
generosity bestowed on us by The Police
Association in relation to the donation
we received that greatly assisted us
towards defraying our costs. From the
many compliments received the luncheon
(Southern Metro Regional Luncheon) was
a great success. Dermot Avon was warmly
welcomed as the Association representative
and on behalf on Joan (Paffett) and myself,
we wish all members a Merry Christmas and
happy, safe and healthy New Year.
Retirements
After almost 34 years in the job, it is with
sadness that I write to inform you that on
3/12/2011 I will retire from the Victoria
24 Protect Represent Support. www.tpav.org.au
Police Force on disability pension and will
therefore be concluding my membership
with the Association. A big thanks to Les
in WorkCover for his advice and guidance
over the past 12 months. Thank you to all at
the Association for all your hard work and
dedication over the years and for being there
when needed.
Bruce Watt
Sergeant 20763
It is with a saddened heart that I am taking
early retirement from Victoria Police as of
25/11/2011 after 37 years 9 months service.
I have loved my job in particular the last 20
years as the Officer in Charge at Warrandyte.
I am retiring to pursue new challenges
outside of Victoria Police. I have met some
wonderful people along the way and must
say that it has been a terrific journey. I would
like to take this opportunity to thank The
Police Association for the help you have
provided along the way. It has been very
comforting to know that you were there. Can
I send a special thank you to Kaye Murphy
who has provided welfare support to several
of my staff over the years. What a wonderful
person she is and great asset to not only
The Police Association but Victoria Police.
Best wishes for the future
Keith Walker
Sergeant 18926
I am writing to advise that as of 30
December 2011, I will be resigning from
the Victoria Police Force after 23 years
continuous service, and will therefore be
withdrawing from The Police Association
membership. The Police Association has
assisted me on several occasions over
the years for vastly different matters
with professionalism and diligence. The
organisation has changed so much since
joining in 1989 it is hardly recognisable.
I enjoyed my service and leave with no
regrets.
All the best to you and the membership
beyond 2011.
Andrew Gibson
Detective Senior Constable 27730
I wish to advise you that I will be retiring
from Victoria Police on the 9 December, 2011,
after 37 years and 3 months and therefore
tender my resignation as a member of The
Police Association. While I have only ever
had to contact the Association for relatively
minor matters I have always found the staff
to be very helpful with appropriate advice
to resolve the issue. I congratulate the TPA
on what appears to be a very good outcome
for members on the current EB and wish
everyone well in the future.
Jim Woods
Sergeant 18630
Mr President, members of the Executive
and the Association, it is with mixed
emotions that I write to inform you of my
retirement, on 3 December 2011, after
40 years of membership with The Police
Association that has gone ‘hand in glove’
with the length of my operational service
with Victoria Police. I give heartfelt thanks
to the Association for the legal assistance
provided to my colleagues and I during a
rather protracted coronial inquest some
years ago. I will miss the camaraderie of
my colleagues and being a member of the
Association, which in my opinion has served
the membership well.
Yours sincerely
Ian MacDonald
Leading Senior Constable 17014
It is with deep regret and disappointment
that I write to The Police Association to
inform you of my resignation from Vic Pol
after 10 years. I am a mother to three young
children and have been unsuccessful in
obtaining leave without pay to allow me
to spend a couple of years as a full-time
mother. I am extremely saddened that I
have been forced to resign and feel that Vic
Pol are only disadvantaging themselves by
forcing police women out of the job because
they want to spend quality time with their
children during their formative years. I am
very grateful to the Association who have
provided invaluable support and advice to me
over the past 10 years. I hate to think what
the workforce would be like without you.
FINANCE
Does the ESSSuper death and disability
benefit protect members for injuries
sustained off duty?
If you are an ESSS Defined Benefit (DB) Fund member,
then the simple answer is, YES.
Unlike some insurance companies
who may classify police officers as
‘high risk’ employees and either don’t
offer cover, or include excessive premiums
and exclusions, the ESS DB Fund death and
disability benefit covers you 24/7 for injury,
illness or death, anywhere, any time − not
just when you’re are at work.
These entitlements came about with thanks
to various emergency services unions,
including the Victorian Police Association,
who fought long and hard to ensure that
those who protect our community would
also be protected by means of adequate
death and disability cover through their
super fund. And, as most emergency
services workers are on-call even when they
are off duty, it makes sense to ensure you
are protected at all times.
So, it’s fair to say that the ESSS DB Fund
death and disability benefits have been
designed with police officers in mind.
How does it work?
Your ESSS DB Fund membership includes
death and disability benefits at no additional
cost to you. The cover is based on a formula
that includes your accrued benefit at the
date of claim, along with a projected benefit
to age 55. The amount you receive, however,
is dependant on the contributions you have
paid from your before or after tax salary
to your ESSS DB Fund account during your
membership. So, it pays to understand the
relationship between contributions and how
your benefits are calculated.
To help you keep track of the insurance
benefit payable, ESSSuper includes these
details on your Annual Benefit Statement
each year. When assessing if you have
enough death and disability cover, you may
wish to consider:
> > Is additional insurance needed?
How much would you need to live on
if you were off work for a long period
due to an injury or illness, or how much
your family would need in the event of
your death? It’s possible that the death
and disability benefits provided by the
ESSS DB Fund may not be enough to
suit your needs.
> > Did you join the force later in life?
You may find that your death and
disability benefits cover provided is less
than fellow officers who joined when they
were younger, as your projected service
to age 55 will be less.
If any of the above is relevant to you, you
may wish to consider additional insurance
through your Accumulation Plan account.
The Accumulation Plan offers a range of
insurance options including death, disability
and income protection through a premium
from your super balance. You can apply for
as much or as little additional insurance you
want to suit your needs.
Where to from here?
To get a better understanding of how your
insurance cover works, you can find more
information on the ESSSuper website
www.esssuper.com.au/insurance or
through the ESSS DB Fund Product
Disclosure Statement, available for
download from this insurance page of our
website. You can also use the insurance
calculators available at www.esssuper.
com.au/calculators to estimate how much
insurance you need. Alternatively, you can
call the ESSSuper Member Contact Centre on
1300 650 161 between 8:30am and 5:30pm,
Monday to Friday.
Make your new pay
whatever life brings.
Over time, your financial requirements
change − you may need to plan for
education, home, cars, renovations,
holidays and retirement. You may also
need to consider how best to protect your
possessions, your lifestyle and your family.
There are a number of PC products and
services that can assist you to reach your
financial goals, help you build your wealth
and ensure your financial future.
It’s never too early or late to invest in
your future
No matter what your life stage, or whatever
your situation, at PC we can help provide you
with options.
Property investment
A popular choice for many Australians
is property. Properties have in the past
increased in value, providing capital growth
and rental income to assist in repaying the
asset. Interest expenses that result from
buying an asset for investment purposes
are tax deductible and you may benefit from
negative gearing.
While there are positives associated
with property investment, there are also
negatives. Property investment isn’t
for everyone and it’s not a short term
investment. If you need to reduce your
investment, you can’t sell half a house.
Selling property can also take time, unless
you’re prepared to lower your asking price to
sell quickly. And property prices can fall too!
Non-property investment
Varying your share investments or managed
funds portfolio can be a lot easier. But timing
can be critical to whether your investment
has made positive or negative returns.
At Police Credit, we have a range of
investment loan options for all your
investment needs and will soon be
introducing a new range of products
specifically designed for wealth builders.
Not sure if property or non-property
investment is for you? A chat with our PC
planners will help you work out the strategy
that suits you best.
Just starting out
A high interest savings account or term
deposit might be the best way to begin. Once
you’ve reached a short term goal, you can
revise your financial goals and think bigger.
> > Term Deposits: reach your savings goal
with a PC Term Deposit. Ranging from
3 to 60 months, and with a minimum
deposit of $5,000, you have the flexibility
to choose the term you like.
> > High Interest Savings Account: set up
regular savings contributions and watch
your savings grow with a PC Bonus Saver
and easyinvest account. It’s a great way
to start saving.
The Peer Support Program
What is Peer Support?
Peer Support is a process whereby
employees, trained to recognise various
signs and symptoms of stress, assist their
colleagues by listening, understanding
and providing appropriate referrals when
necessary.
The Role of Peer Support Officers
Peer Support Officers are volunteers
and undertake their roles in addition to
normal policing duties. They are available
when rostered for duty to provide initial
support, information and options to enable
employees to make their own decisions
about the assistance they require.
Rank does not exist when a person is
receiving support and no notes are taken.
The role of a Peer Support Officer is to:
> > offer initial support and assistance to
colleagues regarding work, family and
personal issues
> > assess the need for critical incident
stress defusing or debriefing
> > make referrals to appropriate health
and support services if necessary
> > provide follow-up support for colleagues.
The Officers are not counsellors, but they
have received training in:
> > managing general stress
> > critical incident stress management
> > communication styles
> > counselling techniques
> > suicide awareness
> > bereavement skills
> > ethics and confidentiality.
Confidentiality
Confidentiality is strictly maintained at
all times. Peer Support Officers work in
accordance with the principles and practices
developed by Police Psychology.
Contacts
The Peer Support Officer Contact List
is available on the welfare pages of
The Police Association website -
www.tpav.org.au
This list is also available on the Victoria
Police Force Intranet.
Peer Support Officers can be contacted
while they are on duty. In situations where
a Peer Support Officer cannot be released
from operational duties, assistance can be
arranged by contacting the Welfare Services
Unit on 9301 6900, who will locate an
appropriate Peer.
