a. The code changes themselves do not impact the environment;
b. Any building that might be built or modified pursuant to these code changes, when
implemented in the context of the entire Code, will not negatively impact the
environment. With respect to impact on neighborhoods; any impact is expected to be
positive and/or minor.
c. These are simple modifications to improve the implementation of the Code. In some
instances, with curb cut modifications as an example, storm water quality is actually
improved and therefore better for the environment.
Accordingly, this Local Law is adopted with a negative SEQRA Declaration.
2. This Board takes note of the positive recommendation of the Planning Board of the Town
of DeWitt made by resolution adopted August 28, 2008, and incorporates said resolution into
these findings.
3. This Board takes note of the findings of Syracuse Onondaga County Planning Agency
which found no negative countywide impact countywide with respect to this legislation.
4. Many of the matters addressed in this legislation are “cleanup” items, including
typographical errors and clarification of Local Law #6 of the year 2007, which was adopted as a
comprehensive overhaul of the prior zoning code.
5. Other sections of this legislation assist the Town in moving toward full effectiveness of the
new Zoning Code, as well as the Comprehensive Plan of the Town.
6. Many of the changes in this legislation have come from a careful re-review of Local Law
#6 of the year 2007 and further public input, resulting in modifications to the Zoning Code which
address rear and side yard setback issues in a residential zone, curb cuts and other such
improvements.
7. This Local Law and the modifications to the Zoning Code therein are generally minor
and come with the recommendation with the Zoning Update Committee following its study of
these matters.
