The invalidity of any provision of this Local law shall not affect the validity of any other provision of this Local Law that can be given effect without such invalid provision. Section 12. This local law shall take effect immediately upon filing in the Office of the Secretary of State. The Supervisor recessed the meeting and called to order a public hearing at 8:05 p.m. to consider a proposed local law establishing zoning districts in the hamlet of Jamesville. Proof of publication in the Syracuse Post-Standard dated August 29, 2008 was read and filed. The matter was presented and reviewed by Attorney Sutphen. She noted the support of the Planning Board by resolution dated July 24, 2008. The Supervisor closed the hearing. Motion by Councilor Mannion, seconded by Councilor Scruton. RESOLVED, that the following findings are made in connection with and subsequent to the public hearing for the proposed Local Law entitled “Establishment of Hamlet Zoning Districts”: 1. This Board finds with respect to SEQRA that an environmental impact statement was prepared and noted no negative environmental impact by reason of these modifications to the Zoning Code inasmuch as: a. This code change merely establishes the areas of the Town which will be impacted by separately enacted Hamlet Zoning Provisions; such establishment of areas does not negatively impact the environment; 38
Accordingly, this Local Law is adopted with a negative SEQRA Declaration. 2. This Board takes note of the positive recommendation of the Planning Board of the Town of DeWitt by resolution adopted July 24, 2008, and incorporates and adopts by reference herein the findings of the Planning Board in said recommendation. 3. This Local Law is required to separately establish areas of the Town which will be affected by the Hamlet Zoning Provisions, separately enacted, and contains no substantive zoning provisions on its own. 4. This Board takes note of the findings of Syracuse Onondaga County Planning Agency which found no countywide negative impact with respect to this legislation. 5. The Zoning Update Committee subcommittee and the Hamlet Committee recommended the areas of the Town to be affected by the legislation after careful study. Motion by Councilor Mannion, seconded by Councilor Scruton. Adopted 6 Ayes Town of DeWitt Local Law #9 of the Year 2008 Establishment of Hamlet Zoning Districts Be it enacted by the Town Board of the Town of DeWitt as follows: Section 1. Title This local law shall be referred to as "Establishment of Hamlet Zoning Districts". Section 2. Purpose and Intent The purpose of this Local Law is to change the Zoning Classification of the hereinafter listed premises as they appear on the Official Zoning map of the Town of DeWitt in an area of the Town of DeWitt known as the Jamesville Hamlet and also referred to herein as "The Hamlet". Section 3. The 1989 Zoning Map of the Town of DeWitt, as amended, as provided in Section 192-5 of the Code of the Town of DeWitt was recently amended by Local Law No. 3-2008 of the Town of DeWitt to conform with the comprehensive changes made to the Town of DeWitt Zoning Code, Chapter 192 of the Code of the Town of DeWitt.. Chapter 192 of the Code of the Town of DeWitt has undergone further revisions and changes relating to the area of the Town known as the Jamesville Hamlet, by Local Law #8-2008 of the Town of DeWitt, adopted simultaneously herewith.
